- Pursuant to the Federal Acquisition Regulation (FAR) Subpart 8.405-6 and Bureau of Prisons Acquisition Policy (BPAP) Subpart 6.304, the Federal Bureau of Prisons has determined that restricting consideration is justified for this procurement action as only one sources is capable of providing the services because the services or unique. The acquisition is conducted under the authority of the General Services Administration's (GSA), Multiple Award Schedule (MAS) program. The following documentation is provided for this limited sources justification in accordance with FAR Subsection FAR 8.405-6(c)(2). 1. Contracting Agency - U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section. 2. Nature/Description of Action Being Approved - This action will be a conducted pursuant to the terms and conditions of GSA Multiple Award Schedules (MAS). The acquisition will a one-year task order issued against the GSA Federal Supply Schedule (FSS). 3. A description of the supplies or services required to meet the agency's needs - Inclusive of the Estimated Value- The Bureau has a requirement for the acquisition of annual maintenance and support from Smiths Detection for ion scanners. The requirement includes: 24 hours a day, 7 days a week, 365 days a year on-site service coverage, 36 hour response time, labor, travel time, travel expenses, replacement parts required, unlimited access to the technical support help desk, semi-annual preventive maintenance check (complete operational and calibration procedures performed), and a semi-annual radiation leak test. The estimated value is estimated at $428,450.11. 4. Authority and Supporting Rationale - This procurement is conducted under the authority of 41 U.S.C. 152(3), 40 U.S.C. 501 and MAS. In accordance with FAR 8.405- 6(a)(1)(i)(B), only one source is capable of providing the corrective and preventative maintenance required because of the uniqueness of providing support to equipment proprietary to Smiths Detection. 5. Contracting Officer's Best Value Determination - GSA has already determined that prices under schedule contracts to be fair and reasonable. The Contracting Officer has determined that utilizing GSA for this requirement is the best value for the Government. 6. Market Research - Market research revealed that Smiths Detection is the sole manufacturer of the equipment. Third party maintenance on the equipment voids the warranty. 7. Other Factors - The Bureau's physical security program requires narcotic trace detection. The Bureau has invested substantial resources in testing, procuring and maintaining Smiths Detection Ionscan Systems. Operational downtime of these systems would cause a physical security exposure and would compromise the security of the facility. Furthermore, corrective and preventative maintenance services are required to ensure the Bureau remains in compliance with Program Statement 5522.01 (Ion Spectrometry Device Program). 8. Statement of the Actions to Remove or Overcome any Barriers Smiths Detection is the only vendor capable of providing the required service maintenance for the scanners that will not void the warranty. The Bureau will continue to conduct market research and make efforts to obtain competition for future acquisitions when applicable.
