Description
US Customs and Border Protection (CBP) intends to negotiate on a sole source basis under authority of FAR 6.302-1(a) with International Business Machines (IBM) Corp., 800 N Frederick Ave., Gaithersburg, MD 20879 to provide 1 year maintenance for Websphere Portal Server 6.1. The software provides organizations with the visibility, control, and automation needed to deliver quality services, manage risk and compliance, and accelerate business growth. Without this maintenance, ACE Production will not have vendor support or access to any fixes or security patches. Websphere Portal Server 6.1 is a proprietary Original Equipment Manufacturer (OEM) software that supports specific hardware and software products. Websphere Portal Server 6.1 software items are CBP Technical Reference Model (TRM) approved items specifically tested and certified to meet CBP architecture requirements. The software is directly linked to the continued functioning of many U.S. Customs and Border Protection mission critical applications previously purchased for Mission Critical Systems software and COTs tools. Support for these specific versions can only be procured from IBM direct. The IBM direct restriction only applies to those versions that have reached end of service and are no longer supported through IBM's standard offerings. The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is $38.5 M. The Government intends to solicit and negotiate directly with IBM. No solicitation package will be issued. This notice of intent is not a request for competitive proposals. However, if any interested party believes it can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. A determination to compete this action based on the responses received is in the sole discretion of the Government. All interested parties must express their interest and capabilities in writing via email. Documents over 10 pages total will not be accepted. No faxed documents will be accepted. Verifications of receipt of responses are the sole responsibility of the contractor. If no responsive statements are received by September 26 at 2:30 pm EST, an award will be made to IBM.
