Description
8.405-6 and the Bureau of Prisons Acquisition Policy (BPAP) Subpart 6.304(b), the Federal Bureau of Prisons has determined that restricting consideration of schedule contractors is justified for this procurement action. This acquisition is conducted under the authority of the multiple Award Schedule (MAS) program. The following is a list of supporting documentation for this limited source justification in accordance with FAR Subpart 8.405-6(c): 1. Contracting Agency - United States Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section 2. Description of Action Being Approved - This action will be a one year task order issued pursuant to the terms and conditions of the referenced General Services Administration (GSA) Federal Supply Schedule (FSS) contract. Service is required October 1, 2016 through September 30, 2017. The Bureau is preparing this justification and requesting approval as required by FAR Subpart 8.405-6(c) (2) and BPAP Subpart 6.304 (b). 3. Description of Supplies and Services Required to Meet The Agency's Needs - Inclusive of the Estimate Value - The Bureau has a requirement to maintain their existing investigative software solution referred to as TRUINTEL. The TRUINTEL system, offered by ATG, is the only system capable of meeting the agency's requirement since it was developed and designed to operate within the BOP's Trust Fund Network (TRUNET) environment. TRUINTEL is a vital component of the Bureau's security protocols. The estimated cost of these services is $208,843.44. 4. Authority Cited - This acquisition is being conducted under the statutory authority for the MAS program which are 41 U.S.C. 152(3), Competitive Procedures, and Title 40 U.S.C. 501, Services for Executive Agencies. In accordance with FAR 8.405-6(a) (1) (i) (B), this justification is limiting sources as only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. Since ATG owns the proprietary rights and the source code for the TRUINTEL system as well as operates and maintains the TRUNET system, they are the only qualified contractor capable of providing this requirement. ATG has not granted reseller authority to any vendors for support and maintenance of the TRUNET or TRUNITEL system. 5. Contracting Officer's Best Value Determination - This award will be made in accordance with the terms and conditions of the referenced GSA FSS for which the GSA Contracting Officer has already determined the price to be fair and reasonable, pursuant to FAR 8.404 (d). A separate determination is not required. It is noted that there is no increase in price from the previous year. Based on a comparison of previous and current Government contract prices for these services, the Bureau's Contracting Officer has determined that the utilization of the GSA FSS represents the best value to the Government. 6. Market Research - TRUINTEL was developed by ATG and is the only solution that will operate within the TRUNET environment. However, market research did reveal that ATG does provide this requirement under their GSA FSS. ATG has not granted reseller authority and owns the proprietary rights. 7. Other Factors - TRUINTEL was designed to operate within TRUNET. TRUNET and TRUINTEL were developed by ATG. ATG owns the proprietary rights and the source code to the TRUNET system and does not allow other entities access to the source code. 8. Statement of Actions to Remove or Overcome Any Barrier - The Bureau is conducting extensive market research to determine if there are new solutions on the market in order to make a determination to compete a requirement for a new Trust Fund system.
