Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation number is VA248-16-Q-1816 and is issued as a Request for Quote (RFQ). This solicitation documents and incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-89-1, effective 15 August 2016. This solicitation starts 09/27/2016 and will end 09/30/2016 at 14:00 pm EST and is set aside for 100% for Service Disabled Veteran Owned Business (SDVOSB) and Veteran Owned Small Business (VOSB) determined to be lowest price technically acceptable and price is determined to be reasonable. Network Contracting Activity 8 - Service Area Office -East intends to award a Firm Fixed Price requirements contract for a service contract for On Demand Courier service for the Pharmacy located at the C.W. Bill Young VAMC, Bay Pine, FL. This procurement is being conducted under the FAR part 13 and simplified acquisition procedures apply. The intent is to award a Firm-Fixed Price requirements service contract with a base year and 4 one year options. The base year Period of performance is 1 Oct 2016 - 30 Sep 2017. The North American Industrial Classification System (NAICS) code for this procurement is 492110 with a small business size standard of 1500 employees. This procurement is 100% set aside for Service Disabled Veteran Owned Business (SDVOSB) and Veteran Owned Small Business (VOSB) determined to be lowest price technically acceptable and price is determined to be reasonable; all eligible offerors may submit quotes. All offerors shall be registered in the System for Award Management (SAM) at https://www.sam.gov; and www.vetbiz.gov, if applicable, to be considered for an award of a federal contract. The record shall be complete and not missing elements such as representations and certifications. SDVOSB and VOSB shall be certified by the Center for Verification and Evaluation (CVE) and registered in Vetbiz for award consideration. Contractors interested in providing these services should submit their quotes via email to Reginald.Nettles2@va.gov. Quotes shall be received 30 Sep 2016 at 14:00 p.m. Eastern Time Zone and reference the solicitation number. Please direct all questions regarding this procurement to Reginald L. The following Contract Line Items (CLINS) are applicable to this requirement. For detailed service description review the attached SOW. Primary FOB location is C.W. Bill Young VAMC, Bay Pines, FL. SCHEDULE OF SERVICES The Contractor shall provide all supplies, materials, parts, equipment, labor, supervision, management and transportation to provide service for On Demand Courier service for the pharmacy located at the C.W. Bill Young VAMC, Bay Pines, FL in accordance with the terms and conditions herein. Contractors shall quote prices for all of the following Contract Line Item Number(s): See attached Price/Schedule to submit base and option year pricing. The following Federal Acquisition Regulation (FAR) and Veterans Affairs Acquisition Regulation (VAAR) provisions and clauses are applicable to this acquisition and are available for view at: http://www.acquisition.gov/far/index.html http://www.va.gov/oamm/oa/ars/policyreg/vaar/index.cfm FAR Provisions: 52.203-98 Prohibition on Contracting with Entities that require certain Internal Confidentiality Agreements - Representation (FEB 2015) (a) In accordance with section 743 of Division E, Title VII, of the Consolidated and further Continuing Resolution Appropriations Act, 2015 (Pub. L. 113-235), Government agencies are not permitted to use funds appropriated (or otherwise made available) under that or any other Act for contracts with an entity that requires employees or subcontractors of such entity seeking to report fraud, waste, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or contractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information. (Aug 2013) 52.209-7Information Regarding Responsibility Matters (JUL 2013) 52.212-1 Instructions to Offerors- Commercial Items (JUL 2013) QUOTATION SUBMISSION Offerors shall submit proposals electronically by the date and time in accordance with the Request for Proposal instructions. The Offerors proposal shall consist of three (3) volumes: Volume I -Technical; Volume II - Past Performance; and Volume III - Price. 52.212-2 Evaluation-Commercial Items (JAN 1999) The Government will award a firm fixed priced requirement contract to the responsible offeror who is the lowest priced technically acceptable. In order to be rated Technically Acceptable all technical factors shall be rated as pass. Offeror shall demonstrate their ability to meet these factors with their offer in accordance with Paragraphs I-III below, and offers shall meet the minimum qualifications below in order to be evaluated. Technical acceptability is rated as pass or fail based on the following: I.Technical a)Management Plan: In order to be considered acceptable for award, the offeror shall provide a detailed plan of how the contract will perform Pharmacy Courier transporting. An acceptable profile shall at a minimum include: i.Identify Key Personnel ii.Position, responsibility, and experience of Key Personnel iii.Plan for 24/7 plus holiday delivery for all designated locations iv.Outline secure delivery and tracking of Narcotics and high risk medications v.Copies of training for HIPPA and PHI b)Vehicle List: All vehicles shall be registered in the State of Florida at the time of award, and shall meet all specifications as required in accordance with the State of Florida. An acceptable Vehicle List shall at a minimum provide: i.List of vehicles, make, model, and year ii.Number vehicles dedicated to the requirement iii.Copies of licenses/permits to transport Pharmaceutical products. iv.Copies of insurance for protection of persons, damage of personal and/or public property, and negligence. Or v.Company certification that the contractor has and shall maintain the required licenses and permits required throughout the term of an awarded contract. II.Past Performance a)The offeror shall provide a minimum of three past performance references for work similar in cost and technical scope. Past performance references shall identify the agency name, point of contact, phone number, contract or delivery order number, a brief scope of contract, and contract value. The past performance shall have occurred within the last 5 years of the date of submittal. An acceptable past performance reference shall show a list of (3) current references with the following information: a.Contractor's name b.Facility address and telephone number c.Point of contact d.Contract number, value, award date and completion date e.Description of the requirement f.Any subcontractors must be listed. Specify, if no subcontractors will be used. g.Contact person and phone number of the past performance contact h.Fax number and email address of past performance reference if applicable Offerors with no relevant past performance or whom information is not available, shall not be evaluated favorably or unfavorably on past performance. III.Price An acceptable Price/Schedule shall illustrate the basis for pricing including: labor, equipment, operating supplies, profit, and overhead. 52.212-3 Certifications and & Representations (NOV 2013) Offeror shall include a completed copy of the provision 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer. 52.217-5Evaluation of Options (JUL 1990) Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. (Dec 2014) 52.212-4 Contract Terms and Conditions- Commercial Items (SEP 2013) This clause applies to this solicitation and the clauses that are incorporated into 52.212-4 as an addendum to this contract are as follows: 52.216-18Ordering (OCT 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from 1 October 2016 through 30 September 2017. (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. 52.216-19Order Limitation (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $100 per day, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor -- (1) Any order for a single item in excess of $1500 per day; (2) Any order for a combination of items in excess of $15,000 per day; or (3) A series of orders from the same ordering office within 2 hours that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section. (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. 52.216-21 Requirements (Oct 1995) (a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule. (d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract. (e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source. (f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 30 Sep 2021. 52.217-8 Option to Extend Services (NOV 1999) 52.217-9 Option to Extend Term of the Contract (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within no later than 30 days before contract expiration; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
