- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA259-16-AP-7266 1.Contracting Activity: Department of Veterans Affairs, VISN 19, Sheridan VA Medical Center, Mental Health Department. Purchase Request: 666-16-1-048-0002; 2.Nature and/or Description of the Action Being Processed: A new contract for psychiatrist services is required for a 1.5 month timeframe. The current contract (VA259-15-C-0116) expires on September 30, 2016 and after that date Sheridan VA will no longer have Psychiatrist personnel onsite to support the veteran population. A new, competitive contract will not be in place by 1 October 2016. In order to prevent a gap in services, VA intends to award a sole source contract for a 1.5 month period to the current contractor, NU-Breath International. The contract will be sole sourced to Nu-Breath under FAR 6.302-1, Only One Responsible Source, for the period of 1 October 2016 - 15 November 2016. FAR 52.217-8 will be included. FAR13.5 Simplified Procedures for Certain Commercial Items: This procurement is for four (4) psychiatrists to perform psychiatrist services at the Sheridan VAMC in accordance with FAR 13.5, Simplified Procedures for Certain Commercial Items and FAR 13.501, Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. 3.Description of Supplies/Services Required to Meet the Agency's Needs: Sheridan VAMC requires four (4) board-certified psychiatrists to perform psychiatrist services for the veteran population served by Sheridan VAMC. The psychiatrists will work full time hours. The period of performance will be 1 October 2016 - 15 November 2016. 4.Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(1), as implemented by FAR 6.302-1. (x) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; FAR13.5 Simplified Procedures for Certain Commercial Items: Contracted services require that psychiatrist personnel go through a Credentialing and Privileging process which can delay the contract's start date by 30-60 days because physicians cannot perform contracted services until they have passed the Credentialing and Privileging process. Psychiatrist services are mission critical and a gap in psychiatric services is unacceptable and may cause an adverse effect on the veteran population served by Sheridan VAMC. A short-term contract will allow VA time to get a five year, competitive contract in place while still serving the veteran population in the meantime. Nu-Breath's psychiatrists are already performing contracted services and have also passed the Credentialing and Privileging process. 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): NU-Breath International currently has psychiatrists onsite at Sheridan VAMC who are providing psychiatrist support services to the Sheridan veteran population. These psychiatrists are board-certified and have already passed the Credentialing and Privileging process. NU-Breath's psychiatrists will be able to begin performance under the new contract immediately because they have passed Credentialing and Privileging. All other vendors would require an additional 30-60 days to become Credentialed and Privileged. The original solicitation was posted to FSS as an SDVOSB set-aside and no vendors submitted an offer. Because that solicitation was unsuccessful, the acquisition plan had to be revised and a new solicitation will need to be reviewed, approved, and posted. This process will not be complete by 1 October 2016 which is the facility's need date for these services and the date the current contract (VA259-15-C-0116) expires. In order to prevent a gap in providing mission-critical services, VA intends to sole source a three month interim contract to NU-Breath for continued contractual performance. This will be for the period of1 October 2016 - 15 November 2016. A new, long-term contract will be competitively awarded during this time. a. Only One Responsible Source (FAR 6.302-1) - Accordingly, NU-Breath International is the only firm capable of providing the services described in Section III above without the Veteran's Health Administration experiencing unacceptable delays in fulfilling its requirements. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A solicitation was posted to the Federal Supply Schedules as an SDVOSB set-aside and was open from August 24, 2016 - September 5, 2016. No companies submitted an offer or expressed interest. A new solicitation is being prepared for competitive award; however it will not be in place by the need date of 1 October 2016. In order to ensure that services are not interrupted, a one and half month interim contract will be put in place and will include FAR 52.217-8. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: The costs used for this three month contract are the same costs as those quoted in the current contract, VA259-15-C-0116. These prices were determined to be fair and reasonable prior to contract award. Price fair and reasonableness was based on historical contract pricing and VA-published rates for physicians. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Please see Section 6, above. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: None. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Only Nu-Breath International has expressed interest in the interim, short-term contract. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A new solicitation is being prepared for competitive solicitation and award.
