Description
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Less Than $150,000 (FAR 6.303-2) 1. Identification of the Agency and the Contracting Activity: National Park Service, Denver Service Center 2. Nature and/or Description of the Action Being Approved: Contracting with Washington Department of Fish and Wildlife to implement specific fisheries monitoring activities required in the NOAA Biological Opinion for the Elwha Project, including: Collection of biological data and samples from adult Chinook salmon carcasses encountered in the Elwha River, its tributaries, and the WDFW Rearing Channel, summer 2016 and 2017. 3. A Description of the Supplies or Services Required to Meet the Agency's Needs, Including the Estimated Value: The services required include the collection of biological data and samples from adult Chinook salmon carcasses encountered in the Elwha River, its tributaries, and the WDFW Rearing Channel in summer/fall 2014, and delivery of a report on said activities including recommendations for any modifications or improvements for future seasons. Estimated total cost is $131,502. 4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: Federal Acquisition Regulation s Subpart 6.3, provides for circumstances permitting other than full and open competition. In this procurement, Subpart 6.302-1 (a) (2) is hereby incorporated into this justification; "Supplies or services may be considered to be available from only once source." The requirement is met under paragraph 6.302-1 (b) (1) (i): "Unique supplies or services available from only one source or only one supplier with unique capabilities." 5. A Demonstration That the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: Only the Washington Department of Fish and Wildlife (WDFW) or the Lower Elwha Tribe are legally authorized to take the designated threatened fish in support of collecting biological information to enhance fisheries recovery. Chinook salmon returning to the Elwha River are primarily the progeny of fish released as juveniles from the WDFW Elwha Rearing Channel. Many fish sampled will be taken from the WDFW rearing channel or captured during the WDFW brood stock capture activities in the river. 6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: In this case, WDFW has been determined as the only organization with the technical and legal capability to perform the work, as described in 5 above. A notice will not be published since other proposals will not be considered. In accordance with FAR 5.202(a)(13) the proposed action is for an amount not expected to exceed the simplified acquisition threshold and will be made through a means that provides access to the notice of the contract action through the GPE. 7. A Determination By the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: The proposed cost has been reviewed by staff at Olympic National Park with expertise in fisheries operations and the recommendation made to the Contracting Officer that the costs proposed are considered as fair and reasonable considering the work effort required to accomplish the scope of work. As such, the Contracting Officer with assistance from the technical staff has determined that the price proposed is fair and reasonable and in the best interest of the Government. 8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: The appropriate entity to perform the work was developed by an intergovernmental group of fisheries specialists. It was determined that WDFW had the capability to perform this work as part of the fisheries restoration effort. The recommendation of the fisheries restoration planning group that WDFW perform the work is determined as sufficient market research for this effort. 9.Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) - (iii) for some examples): The work includes the capture and handling protected species under the Endangered Species Act. As such, the Washington Department of Fish and Wildlife is considered the only capable agency to complete this work. 10. A Listing of the Sources, if any, That Expressed in Writing, an Interest in the Acquisition: None. 11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: The NPS has reviewed this requirement with the intent to competition. In doing so, it has determined that this requirement would present an increased risk to a private firm, causing delays in obtaining permits and land access that any potential savings anticipated through competition would be severely diminished due to other regulatory requirements. 12.
