- JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity:Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, NJ 07724 2. Description of Action: This proposed action is for a firm-fixed price delivery order to be issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC) for Pivotal Spring Framework warranty support. 3. Description of the Supplies or Services: The Department of Veterans Affairs (VA) Office of Information and Technology (OIT), Service Delivery and Engineer (SDE), Enterprise Program Management Office (EPMO), Region 5 Field Base Implementation Office has a requirement for brand name warranty support on Pivotal Spring Framework software currently in use as a tool to enhance and maintain the Image Management System (TIMS) application. TIMS is a Java code based system that is utilized to adjudicate Veteran's and dependent Education Claims. The Pivotal Spring Framework software is an open source software product that allows the Government to custom build fully functional Java and J2EE industry standard code for the TIMS web based system that is portable between system hardware and operating system platforms. VA requires warranty support for the above mentioned software in order to keep the software fully functional and operational. The software warranty will consist of software upgrades and updates to include major releases, point releases, service releases and security releases of the applicable software on a quarterly basis, and/or within 48 hours in case in which a high risk vulnerability fix becomes available. The period of performance for the warranty support shall be five years. 4. Statutory Authority: The statutory authority permitting this exception to fair opportunity is Section 41 U.S.C. 4106(c)(2) as implemented by the Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B), entitled "Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." 5. Rationale Supporting Use of Authority Cited Above: Based on extensive market research, as described in Section 8 of this justification, it was determined that limited competition is available among NASA SEWP V GWAC contract holders for the required brand name Pivotal Spring Framework Software warranty support. Utilization of the Pivotal Spring Framework software is necessary to effectively enhance and maintain the TIMS web based application to ensure optimal functionality. The Pivotal Spring Framework software currently in use is mature, stable, portable, well supported technology that is widely incorporated in the industry due to its many commercial and open source J2EE application servers. The TIMS web based application contains millions of lines of code, and its platform is built around the open source of Pivotal Spring Framework software. The Pivotal software is the only open source framework available that is interoperable and compatible with the Java-based TIMS application. The warranty support is required to provide software upgrades and updates to include major releases, point releases, service releases and security releases of the applicable software on a quarterly basis, and/or within 48 hours in case in which a high risk vulnerability fix becomes available. Although the Pivotal Spring Framework software is an open source software product, it is based on proprietary source code; therefore, no other software warranty provider has access to the proprietary source code to perform the necessary warranty support. Based on the market research conducted by the Government technical experts, it has been determined that only Pivotal Spring Framework Software warranty support can meet the Government's' requirements. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D) the resulting contract award will be synopsized on the Federal Business Opportunities Page within 14 days of award and this justification will be made publicly available. This Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed. 8. Market Research: Pivotal Spring Framework software is open source software package currently in use in the VA. When conducting market research in August 2016 and September 2016, the Government's technical experts reviewed warranty support packages available from other software warranty providers to ascertain if these items could meet VA's requirements. Specifically, the Government's technical experts conducted web-based research on similar software warranty packages available from companies such as Eclipse, myEclipse and Rational Software Developer. The research revealed that the no other companies can provide the required warranty support for the Pivotal Spring Framework software due to the proprietary nature of Pivotal' s source code. Market research was also conducted by utilizing the Provider Lookup Tool on the NASA SEWP V GWAC website, which found that there are two (2) contract holders that are resellers of Pivotal warranty support. Furthermore, a Request For Information (RFI) was issued on NASA SEWP which yielded responses from additional NASA SEWP contract holders, including one Service Disabled Veteran Owned Small Business, that are able to fulfill the Government requirements. In addition, NASA SEWP V GWAC has a dynamic catalog where line items can be added based on customer requests; therefore, as long as the required item or service is within scope of the NASA SEWP V GWAC holder's catalog on a daily basis. The requirements discussed herein have been found to be within scope of the NASA SEWP V GWAC in a separate determination. 9. Other Facts: None.
