Description

JUSTIFICATION FOR SINGLE SOURCE AWARDS IAW FAR 13.106-1 (OVER MICRO-PURCHASE THRESHOLD($3.5K) BUT NOT EXCEEDING THE SAT ($150K)) IAW FAR13.104, COs must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase. When competition is not practicable, IAW FAR13.106-1(b), COs solicit from a single source for purchases not exceeding the simplified acquisition threshold. COs may solicit from one source if the CO determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). IAW FAR13.106-3(b)(3),COs are required to include additional statements explaining the absence of competition (see 13.106-1 for brand name purchases) if only one source is solicited and the acquisition does not exceed the simplified acquisition threshold (does not apply to an acquisition of utility services available from only one source) or supporting the award decision if other than price-related factors were considered in selecting the supplier. This template when completed can be used to document single source awards IAW FAR13.106-3(b)(3). Note: Statements such as "only known source" or "only source which can meet the required delivery date" are inadequate to support a sole source purchase. 1. ACQUISITION PLAN ACTION ID: VA248-16-AP-82511A. PROJECT/TASK No. 548-16-3-5543-01531B. ESTIMATED AMOUNT: $35,321.53 2. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The West Palm Beach VA Medical Center in West Palm Beach, Florida requests authorization to process as a firm-fixed-price, sole source contract below the Simplified Acquisition Threshold, citing 41 U.S.C. 3304(a)(5), as authorized by 38 U.S.C. 8127(b)). This requirement is for water purification equipment. The NAICS code for this requirement is 238220 - Plumbing, Heating, and Air-Conditioning Contractors, with a size standard of $15M. The PSC code is 4610 - Water Purification Equipment. 3. UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: Proposed award of this contract is to Richard Hourigan, Inc., DBA: TheWaterTreatmentStore.com, a VIP Verified VOSB, is in the best interest of the Government and is based on its capability to provide technically acceptable, commercially-off-the-shelf systems capable of continuously monitoring incoming water for: Pressure, Temperature, PH Level, Dissolved Solids, Oxidant Residual (Total Chlorine). Additionally, the systems that this contractor can provide can be installed, monitored, and maintained exclusively by VA personnel. Multiple SDVOSB/VOSBs exist in the VIP database; however, the determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one VOSB concern is available to meet the requirement is not required. The CO has determined that a sole source award to Richard Hourigan, Inc., DBA: TheWaterTreatmentStore.com., under Veterans First Contracting Program as authorized by 38 U.S.C. 8127 and 8128 (Pub. L. 109-461, as amended), implemented under subpart 819.70 is in the best interest of the Government. 4. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND RESULTS OR STATEMENT WHY IT WAS NOT CONDUCTED: Market research was performed and demonstrates that Vetbiz.gov revealed 702 potential SDVOSB/VOSB vendors under NAICS code 238220. A total of 4 SDVOSB/VOSB GSA vendors under Source 03FAC - FACILITIES MAINTENANCE AND MANAGEMENT, Category 871 210 Water Conservation were found, but none were found to have the needed equipment under GSA contract. So, RFI VA248-16-N-1299 was subsequently posted on FBO 07-01-16 through 07-12-16. This provided several potential SDVOSB/VOSB contractors who expressed interest in meeting the Agency's needs through a variety of design-build and other complex proprietary systems, requiring monitoring and maintenance agreements. Ultimately, VIP Verified VOSB, Richard Hourigan, Inc., DBA: TheWaterTreatmentStore.com was determined to be the contractor, capable of best meeting the agency's needs, as identified in #3 above. 5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3.
