- Justification for Other Than Full and Open Competition (JOFOC) This document sets forth the justification and approval for award of a contract or order by means providing for other than full and open competition per 41 U.S.C. § 6101, and, as applicable, FAR 6.302, FAR 13.106-1, FAR 8.405, and FAR 16.505. Contracting without competition shall not be justified on the basis of a lack of advance planning or concerns related to availability of funds. This form shall be used to support instances where competition will be limited to a single source, a limited number of sources, including where a brand name product is required. Part 1 - Identification 1. Identification of Agency and the Contracting Activity. The General Services Administration Office of Inspector General (OIG), Contracting Office (JPC), is responsible for this procurement, on behalf of the GSA Office of Inspector General, Office of Investigation, JI. Address: 1800 F Street, NW Washington DC 20405 2. Nature and/or Description of the Action. ☒ New Contract PR Number: JI16-073 ☐ Modification: Contractor (if applicable): West, a Thomson Reuters Business GS-02F- 026DA ☒ GSA Schedule or GWAC Estimated Value: $29,973.60 ☐ Other: Period of Performance: 10.01.2016-09.30.2017 3. Description of the Supplies or Services. This requirement was submitted by OIG, Office of Investigations (JI), 1800 F Street NW, Washington, DC 20405. The contractor shall provide an investigation system, Clear Investigator with Web Analytics. Clear is an investigative platform that allows for investigation into businesses, healthcare providers, insurance, and all other avenues leading to the possibility of Government Fraud. Clear offers realtime data, instantaneous analysis, and Integrated Solutions to increase efficiency while reducing risk, identifying fraud, eliminating waste and managing investigations. Additionally, Clear offers access to mobile device such as smartphones, tablets or iPads. Access is allowed 85 authorized agency users. Access provided for unlimited simultaneous usage. This software was approved for use by the OIG Office of Technology, JPM. Total cost renewal pricing for the period of October 1, 2016 to September 30, 2017 is $29,973.60. Part 2 - Program Office Justification & Approval 4. Identification of Statutory Authority. Authority for Contracting Without Competition Over $150,000 For this requirement over $150,000, under FAR part 6, the basis for contracting without providing for full and open competition is: ☐ There is only one responsible source and no other supplies or services will satisfy OIG requirements. 41 U.S.C. § 6101(b)(2)(C); FAR 6.302-1. ☐ OIG's minimum needs can only be satisfied by contractor's unique capabilities or products. FAR 6.302-1(b)(1). ☐ Source controls copyrights, patents, raw materials, or secret processes cannot be acquired otherwise, or similar circumstances. FAR 6.302-1(b)(2). ☐ OIG's needs can only be satisfied by a brand-name product or item which is essential to the Government's requirement. FAR 6.302-1(c). ☐ Other exception identified in FAR 6.302-1 ☐ There is such unusual & compelling urgency that the Government would be seriously injured if competition is not limited. 41 U.S.C. § 6101(b)(2)(B); FAR 6.302-2. Option years are not permitted. ☐ Source is expressly authorized or required by statute (e.g., AbilityOne, UNICOR, GPO, GSA Public Buildings Service, Appropriations Act, etc.) per 41 U.S.C. § 6101(b)(1) and FAR 6.302-5: ☐ Other basis authorized in 41 U.S.C. § 6101(b) or FAR part 6.302: Authority for Contracting Without Competition Up to $150,000 For this requirement up to $150,000, using simplified acquisition procedures under FAR part 13, the basis for contracting without providing for full and open competition is: ☒ Only one responsible source is reasonably available to meet OIG requirements. 41 U.S.C. § 6101(b); FAR 13.106-1 ☐ Product or service is reasonably available from only one source. ☒ OIG's needs can only be satisfied by a brand-name product ☐ Source controls copyrights, patents or other exclusive licensing arrangements. ☐ Urgent circumstances; only one source can reasonably deliver by required date. Option years are not permitted. ☐ Source is expressly authorized or required by statute: Authority for GSA Schedule Order or GWAC Order For this GSA schedule order or GWAC order under FAR part 8, the basis for not competing among GSA schedule-holders and/or specifying a brand name product or item is: ☐ An urgent and compelling need exists, and following the procedures would result in unacceptable delays. FAR 8.405-6(a)(1)(i)(A). ☐ Only one source is capable of fulfilling the requirement at the level of quality required because the supplies or services are unique or highly specialized. FAR 8.405-6(a)(1)(i)(B). ☐ In the interest of economy and efficiency, the new work is a logical follow-on to an original order that was placed competitively among GSA schedule-holders (i.e., the original order was not sole-source or limited-source.) FAR 8.405-6(a)(1)(i)(C). ☐ An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. FAR 8.405-6(b). Authority for Order Under Multiple Award Indefinite-Delivery Contract For this order under FAR subpart 16.5, the basis for contracting without providing for full and open competition is: ☐ OIG's minimum needs can only be satisfied by a brand-name product or item which is essential to the Government's requirement. 41 U.S.C. § 6101(b)(2)(B) and FAR 16.505(a)(4)(i). ☐ The need is so urgent fair opportunity would result in unacceptable delays. 41 U.S.C. § 6101(b)(2)(C) and FAR 16.505(b)(2)(i)(A). ☐ OIG's minimum needs can only be satisfied by contractor's unique capabilities or products. 41 U.S.C. § 6101(b)(1) and FAR 16.505(b)(2)(i)(B). ☐ A logical follow-on order in the interest of economy and efficiency. 41 U.S.C. § 6101(b)(1) and FAR 16.505(b)(2)(C). ☐ To satisfy a minimum guarantee. 41 U.S.C. § 6101(b)(1) and FAR 16.505(b)(2)(D). ☐ Authorized or required by statute. 41 U.S.C. § 6101(b)(1) and FAR 16.505(b)(2)(E). 5. Demonstration of Contractor's Unique Qualifications. West Publishing Corporation, doing business as West, A Thompson Reuters Business is the software owner. There are no substitutes or additional sources available for these requested parts and supplies. The software owner and distributer, West Publishing Corporation, has been deemed the only one responsible source that can provide the requested service for the period of performance October 1, 2016 to September 30, 2017. The Clear investigative is an online service currently utilized by JI staff that provides access to the most up-to-date public records and data. This tool is utilized on an ongoing basis and has been used in conjunction with federal prosecuted cased to locate suspects and witnesses. Features include the comprehensive data on cell phones, internet calling (VOIP) and utilities. The ease and speed of the single intuitive search provides precision through relevant scoring, de-duplication, filtering and results listed by source. The Clear search tool provides link charts and maps to show connections and locations related to data recovered during an inquiry. The data provided by this tool is vast and has proved invaluable for the investigations office. The Office of Inspector General currently has 85 authorized accounts that are provided unlimited and simultaneous usage access. 6. Description of Efforts to Ensure Other Potential Sources Were Sought. If other potential source(s) emerge, JI, will assess whether competition for future requirements is feasible. The circumstances surrounding the need to obtain the required supplies/services without providing full and open competition will be reviewed annually by the Contracting Officer. 7. Listing of Interested Sources. The following sources expressed interest in this award: N/A 9. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted. A market research was not conducted because this contractor is successfully providing supplies/services and it has implemented a functional system for JI. The data provided by this tool is vast and has proven invaluable for the investigations office. Also, West, a Thomson Reuters Business has a contract with GSA Schedule 76 Publication Media GS-02F-026DA and the prices awarded including CLEAR software are already deemed to be fair and reasonable at the time of the contract award. Furthermore, the Contracting Officer has determined that the prices for this contracting action are fair and reasonable based on comparison of the prices to the historical prices paid by the Government (FAR 15.404-1(b)(2)(ii)). 10. Determination of Fair and Reasonable Cost. As explained in detail below, I have determined that the prices for this contracting action are fair and reasonable based on comparison of the prices to the following (see FAR 15.404-1(b)(2)(i)): ☐ Proposed prices received in response to the solicitation. Contracting Officer Determination of Responsibility ☒ Checked System for Award Management I have determined that this contractor is responsible because: West Publishing Corporation DBA WEST, A Thomson Reuters Business has a valid SAM registration that expires on March 25, 2017. 12. Any Other Supporting Facts. None 13. Determination of Best Value I have determined that this action represents the best value to the Government because: CLEAR software is the only product that can meet the OIG's unique need. Furthermore West, a Thomson Reuters business allows government and law enforcement investigators and analysts to easily access of public records and related information. No other online investigative tool provides the following combination of data, features, and capabilities, as found on CLEAR software. West, Thomson Reuters is the only distributor of its software and there are no re-sellers. Pricing was found to be fair and reasonable in accordance with FAR 15.404-1 (b) (2) (ii), comparison of proposed prices to historical prices paid by the Government or other Federal Agencies, for the same software. In accordance with the above, a sole source award to West, a Thomson Reuters business is found to be the best value to the Government. 14. Technical and Requirements Certification.
