PRE-AWARD ETHICAL RESPONSIBILITIES OF PSC (JUN 2011) This solicitation may result in the award of one or more personal services contracts as defined in FAR 2.101. JOB DESCRIPTION: See below BACKGROUND The Bureau of International Narcotics and Law Enforcement Affairs (INL) is responsible for the development, oversight, coordination, and implementation of international criminal justice programs for the U.S. Department of State. INL's Office of Africa and the Middle East Programs (INL/AME) provides policy guidance and develops, executes, and monitors programs to address the full range of criminal justice issues as they relate to rule of law activities at the African Union (AU). INL has previously placed a Rule of Law Advisor at U.S. Mission to the African Union (USAU), in Addis Ababa, Ethiopia to work with relevant African Union Commission (AUC) components, including the AUC's Department of Political Affairs, AUC's Office of Legal Counsel, the African Court on Human and People's Rights, and other AU organs related to rule of law and criminal justice reform. The United States and the AUC formalized their long term working relationship in a February 1, 2013, Memorandum of Understanding (the MOU) between the AUC and the U.S. Department of State. The MOU has four main pillars where the United States and the AUC pledged to increase cooperation. The four pillars are: (1) Peace and Security; (2) Democracy and Governance; (3) Economic Growth, Trade and Development; and (4) Promotion of Opportunity and Development. The proposed Rule of Law Advisor shall work primarily to advance the MOU's second pillar, Democracy and Governance. The AU shall implement the MOU between the AUC and the U.S. Department of State; the AU shall help bring member states into compliance with AU standards of accountable governance, rule of law, constitutionalism, respect for human rights, and democracy by helping governments nationalize treaties and covenants. The AU shall develop metrics to measure member state's compliance. The AU shall improve its capacity to promote best practices, investigate, and fight transnational crime and coordinate those efforts with its own member states, and the international community; The AU shall develop its own capacity to conduct skills training and capacity building workshops for AU staff and, as required, member state representatives. The ROLA shall promote and further Department of State and U.S. government objectives for the AU and the region. The purpose of the INL Senior Rule of Law Advisor (ROLA) at USAU, the substantive focus of the ROLA shall be: (1) to directly support USAU's work with the AU to implement the February 1, 2013, Memorandum of Understanding for Cooperation (the MOU) between the AUC and the U.S. Department of State; (2) to support the AU's efforts to promote rule of law, accountable governance, constitutionalism, and respect for human rights by its member states; (3) to engage partners such as the AUC's Department of Political Affairs, the AUC's Office of Legal Counsel, the African Court on Human and People's Rights, and other relevant bodies to identify ways to strengthen the AU's capacity to address, both legally and through prosecution, transnational crimes such as corruption, terrorism, and human and wildlife trafficking, and to effectively implement human rights instruments (4) to promote and further Department of State and USG objectives for the AU and the region, (5) to serve as a liaison and technical expert for member state's representatives interested in pursuing this work at home; and (6) to work with other key actors in Africa who are engaged in these areas, including relevant United Nations (UN) and European Union (EU) components, to ensure coordination and non-duplication of efforts. To these ends, USAU's ROLA shall work in close cooperation with relevant Department of State components, and coordinate with relevant USG agencies that implement rule of law activities. The ROLA is responsible for assisting the INL/AME Program Officer in monitoring, advising, and collaborating with INL project coordinators and other personnel working for INL's implementers at the AUC, including the Loyola University-Chicago the American Bar Association - Rule of Law Initiative (ABA-ROLI), and others, with the design and implementation of programs designed to improve the institutional capacity and professionalization of AU entities to promote and implement rule of law efforts and programs. The position requires close coordination with multiple AU entities at the executive and mid-level leadership levels and mentoring of AU staff on rule of law matter and best practices. DUTIES AND RESPONSIBILITIES The primary responsibility of the ROLA is to coordinate with USAU, the INL/AME Program Officer, INL/AME Africa team, INL implementing partners, the AUC, and AU entities on the promotion, development, and implementation of rule of law efforts and programs by or at the AU and the AUC. The ROLA also provides mentoring and advisory services on INL supported projects, and works closely with INL implementers and the beneficiaries of the projects to ensure high quality rule of law instruction, mentoring, and technical assistance. Additionally the ROLA shall advise on wide-ranging policy and technical rule of law matters relative to U.S., USAU, and INL objectives for the AU and the continent. Assess/Advise: 1. Participate in continual analysis and evaluation of AU rule of law institutions, including assessments of the organizational and operational capacities of the various AU/AUC components. Provide expert advice on rule of law issues at the AU/AUC to USAU, the INL/AME Program Officer, their designee, and INL's Washington, DC program office. Analysis and evaluation shall cover rule of law issues at the member state level. The assessments shall include operational effectiveness, leadership, training, outreach to civil society, mobility, communications, and equipment. The incumbent shall also visit, review, and analyze the capabilities of AU entities, and advise USAU and the INL/AME Program Officer on projects, polices, and events to pursue to increase efficiency and productivity of the provincial academies and training facilities. 2. Provide advice and technical assistance to AU/AUC officials and staff, and member states representatives as requested (and in the case of certain AU member states, per previous consultation with USAU and INL/AME), in improving the promotion, operation, administration, resource management, and overall efforts at expanding rule of law capabilities and modernizing rule of law efforts. 3. In accordance with the MOU's goals, the ROLA shall support the Department of Political Affairs. Through the Department of Political Affairs, the ROLA shall provide technical guidance on: a. the implementation of the AU's African Governance Architecture (AGA) -- a body of best practices and standards related to governance, democracy, human rights and accountability; and help the Department of Political Affairs develop metrics to monitor member state's compliance with the AGA. b. the nationalization of AU treaties and covenants. c. the metrics to evaluate member state's compliance with the AGA. d. As appropriate, encourage the Department of Political Affairs to undertake legislative initiatives to combat transnational crimes (corruption, terrorism, human trafficking, wildlife trafficking, etc.) by helping countries nationalize treaties and covenants, coordinating as appropriate with other USG and international agencies who may also similar or complimentary programmatic efforts; and provide legislative drafting and technical advice to help the Department of Political Affairs in these endeavors. e. Provide technical advice to AU entities on strengthening commissions of inquiry and fighting transnational crimes. f. Provide technical advice that takes into account the differing legal and enforcement structures of AU member states. g. Help, as requested by AU/AUC officials or staff, or AU member state representatives, draft necessary legal and policy instruments to advance these goals. To this end, the ROLA shall focus on and deliver advice, technical assistance, skills training, that shall enhance the AU's ability to implement the AGA's goals of accountability, rule of law, and respect for human rights in member states. 4. The ROLA shall also work with the AUC's Office of Legal Counsel and the African Court on Human and People's Rights in Tanzania. 5. The advisor shall provide technical advice and organize skills trainings for AU/AUC employees. Maintain Political Liaison: 1. Generate support for and actively advance U.S. policy objectives with key AU/AUC officials. 2. The ROLA shall serve as a liaison to and technical expert for AU/AUC officials and staff, and AU member state representatives who are interested in pursuing rule of law work at home. The ROLA shall coordinate with INL and other U.S. agency representatives in the field and in Washington D.C. to respond to these bilateral requests for technical assistance including coordination with the International Law Enforcement Academy (ILEA) in Botswana. 3. The ROLA shall serve as a liaison to other donors operating at the AU/AUC and other relevant regional bodies and shall support or represent USAU at various African Union meetings - including the technical working group implementing the Democracy and Governance pillar of the MOU. The ROLA shall coordinate USG assistance and capacity building with the UN, EU, and other actors to ensure non-duplication of efforts and achievement of coherent approach to rule of assistance among AU components. Program Planning, Development, and Execution: 1. Plan and develop training projects in accordance with the USAU and U.S. Department of State goals and objectives; work with implementers to improve implementation, while monitoring and reporting on significant developments; evaluate project results; and, as necessary make mid-course adjustments, and when complete, aid in monitoring and evaluation as part of project close out procedures. 2. Coordinate closely with INL/AME and other INL offices, INL implementers, USAID, EU, and other international donors to implement regional projects to develop the capacity of the AU's rule of law efforts and organizational infrastructure to support and implement those efforts. Guided by the 2013 U.S.-AUC MOU, the advisor shall recommend additional actions, projects, and efforts to advance objectives in the strategy. 3. Work with USAU and the INL/AME Program Officer to provide technical assistance to INL implementing partners and AU/AUC officials and staff to improve the promotion of rule of law on the continent. 4. Provide feedback to USAU and the INL/AME Program Officer to improve training and technical assistance projects. Program Development and Implementation, and Budget Planning: 1. Provide strategic planning and process development guidance to USAU and the INL/AME Program Officer on all phases of project execution from development though implementation, including planning, scheduling, budgeting, monitoring, and coordination. 2. Promote expert practitioner exchanges, seminars, and/or training on: (1) nationalizing international treaties and covenants; (2) combatting transnational crimes (corruption, terrorism, human/wildlife trafficking, etc.); and (3) ensuring accountability for human rights violations, including through commissions of inquiry. 3. Obtain Government Technical Monitor (GTM) certification within six months of beginning work at post. Certification of Department of State GTM shall be achieved by either resident or online training with the Foreign Service Institute (FSI). 4. Identify logistical support requirements; provide advice and assistance in preparation of documentation for procurement of technical services, training, and commodities, and the monitoring of procurement actions, including drafting source-origin waivers, bid solicitations, scopes of work, and delivery of items procured to support INL projects. 5. Under the direction of USAU and the INL/AME Program Officer, review and advise on budget plans for the INL projects at the AU, ensuring that projects match the policies and objectives of the INL and USAU strategies. Integration of Complementary Programs: 1. Promote efforts to develop the capacity to receive, evaluate, and respond to requests for mutual legal cooperation (i.e. assistance in gathering evidence, making arrests, or extraditing charged terrorists) from AU entities including the African Court on Human and People's Rights. On request from member state's representatives the ROLA shall work with bilateral courts on these requests as well, although all bilateral efforts require consultation with the INL Program Officer to ensure they do not conflict with existing INL bilateral programs with that country. 2. Serve as a liaison to and technical expert for AU member state representatives who are interested in pursuing this work at home, and inform INL/AME of such conversations in order to link with existing bilateral programmatic efforts. 3. Coordinate with INL and other U.S. agency representatives in the field and in Washington D.C. to respond to these bilateral requests for technical assistance including coordination with the International Law Enforcement Academy (ILEA) in Botswana. 4. Serve as a liaison to other donors operating at the AU, the Inter-Governmental Authority on Development (IGAD), and other relevant regional bodies and shall support or represent USAU at various AU/AUC meetings - including the technical working group implementing the Democracy and Governance pillar of the MOU. 5. Join an existing coordination mechanism or, if needed, establish a donor coordination working group with U.S., international, NGO, and African institutions and agencies to ensure the full coordination, non-duplication of efforts, and facilitation of the promotion of best practices to foster improved rule of law on the continent. End Use Monitoring: 1. Ensure U.S. Government-provided commodities are effectively utilized and actively prevent fraud, corruption, waste, or mismanagement of projects though continuous oversight, and end use monitoring at all sites. Briefing and Reporting: 1. Prepare, coordinate, and ensure the timely issuance of one-time and periodic reports on INL-supported projects to include the impact of legislation and the political environment on state and local force development. Prepare periodic status reports, budget reports, and program reviews. Track progress of training in achieving larger INL AU goals. 2. Assist in escorting and arranging appropriate itineraries for official travelers. 3. Brief Department, Congressional, Staff Delegations, and other selected international dignitaries on U.S. and AU/AUC rule of law projects as they pertain to INL AU efforts. Attend relevant U.S. Mission meetings as requested and rule of law-related meetings, brief the INL/AME Program Officer and appropriate Embassy members, and report on major issues involving AU components, including but not limited to, the status of the entity, capacity-building efforts, inter-component relations, current progress and outcomes of AU and INL efforts/projects, and other rule of law efforts. 4. Provide a monthly progress report on activities to USAU and INL Program Officer, the latter of whom shall share with relevant USG agencies to ensure synergies and avoid duplication. 5. As necessary, draft front-channel cable reporting as required on pertinent rule of law issues at the AU. Security of Training Teams and Personnel: 1. Advise the INL/AME Program Officer and the RSO on matters related to personnel and physical security at all project locations and personnel operating in support of INL AU projects. Coordinate with other embassy units and host country agencies to assess threat levels at project sites, develop threat reduction measures, and implement appropriate security plans to project personnel and equipment. 2. In coordination with the RSO, prepare and update security instructions, and operational plans and procedures for incoming trainers. Conduct site surveys and develop site emergency evacuation plans based on threat assessments for training areas and ensure all official personnel in the area of training are aware of such instructions plans and procedures. TRAININGS & DISTANCE LEARNING COURSES 1. Completes the Contracting Officer Representative (PA296) distance-learning (DL) course through the Foreign Service Institute (FSI) within 120 days of arriving at Post. 1. Completes the Introduction to Working in an Embassy (PN113) distance-learning (DL) course through the Foreign Service Institute (FSI) within the first six (6) months of arriving at Post. 2. If applicable - Completes the mandatory Foreign Affairs Counter-Threat (FACT) Course (OT610) prior to deployment to Post. RELATIONSHIPS The Rule of Law Advisor shall report directly to USAU Deputy Chief of Mission and receive guidance from the INL/AME Program Officer. The Contracting Officer's Representative (COR) is delegated the authority to act for the Contracting Officer in matters concerning technical clarification, inspection and, after concurrence by the Contracting Officer, acceptance of Contractor performance under the contract, including preparation of receiving reports, and the authorization of progress payments when appropriate. The COR will coordinate all work with the Contractor and review Contractor's performance at significant stages of its development. In no instance, however, shall the COR be authorized to alter or modify the specifications or the contract terms and the conditions or waive the government's requirement, price, delivery, or other terms and conditions. Such changes must be authorized, in writing, to the Contracting Officer. CONTRACT DELIVERABLES The Advisor shall provide a monthly progress report on activities to USAU and the INL/AME Program Officer, the latter of whom shall share with relevant USG agencies to ensure synergies and avoid duplication. The Advisor shall also schedule a biweekly call with the INL Program Officer to discuss various programming and related issues. Per FAR Part 4, the above referenced documents shall be incorporated and copies stored in the PSC's hard file under Section V.; Tab E - Receiving Reports. The Contractor shall prepare and submit two copies of each technical report required by the schedule of this contract (e.g., progress reports, final reports, etc.), to the Embassy INL Section and to the Program Officer, Bureau of International Narcotics and Law Enforcement Affairs (INL), Department of State Washington, DC. The title page of all reports forwarded pursuant to this paragraph shall include a descriptive title, the author's name(s), contract number, project number, and title, contractor's name, name of the State Department project office, and the publication or issuance date of the report. When preparing reports, the Contractor shall refrain from using elaborate artwork, multicolor printing, and expensive paper/binding, unless it is specifically authorized in the Contract Schedule. Wherever possible, pages should be printed on both sides using single spaced type. COMPLEXITY This position involves planning, organizing and completing financial and organizational analysis of enormous complexity. Due to the high visibility and political sensitivity of the issues in which INL is involved, there is extreme difficulty in identifying the nature of the issues and planning, organizing and determining the scope and depth of studies/audits to be undertaken. The PSC is expected to address difficult scenarios by separating the substantive nature of the programs or issues into their components and determining the nature and magnitude of programs or issues, as well as in discerning the intent of the legislation and policy statements and determining how to translate the intent into program actions. SCOPE AND EFFECTIVENESS The PSC performs broad and extensive assignments related to a complex administrative/financial program spanning the full-range of citizen safety, law enforcement, rule of law, and counternarcotics programs in Addis Ababa, Ethiopia, which is of significant interest to the public and to Congress. MINIMUM QUALIFICATIONS 1. U.S. citizenship; able to obtain/maintain Department of State Secret and Medical Clearances, and ethics, if applicable 2. Bachelor's degree or higher, or equivalent from an accredited U.S. institution in a related field 3. Fluent in the English language (spoken and written). Basic word processing skills and ability to use Microsoft Office products. 4. A minimum of ten (10) years of professional level work experience in the area of law and/or justice. Career path shall have included jobs with increasing scope and responsibilities, and some experience at the executive or managerial level. 5. A minimum of two (2) years of experience working overseas in the promotion of justice and/or rule of law program involved in development and capacity building of a country's justice sector, including ensuring sustainability of projects through provision of appropriate training, technical assistance, and mentoring, and a displayed ability to integrate competing needs. 6. A minimum of one (1) year experience working within a civil law context. The ROLA shall utilize this experience and knowledge about the civil law system towards analysis and program evaluation in all areas of national, provincial, and municipal law enforcement and criminal justice. 7. A minimum of one (1) experience working in Africa or on African matters or programs. 8. Experience in writing training plans, statements of work, standard operating procedures, and detailed instructions. Must be comfortable speaking publicly and shall prepare and provide briefings in English and French. PREFERRED QUALIFICATIONS 1. Master's degree or higher, or equivalent, in Criminal Justice, Law, or related field. 2. Arabic, French, or Portuguese language capability at or above a level equivalent to a recognized foreign language proficiency measurement framework, such as the Foreign Service Institute's defined 3/3 level or Common European Framework for Reference for Language's B2 or C1 level, Berlitz, or other. Demonstration or proof of language capability required, unless the individual is a native Arabic, French, Portuguese, or Swahili speaker. Note: Arabic, English, French, and Portuguese are the official working languages of the African Union. 3. Experience with conducting training overseas or working with national governments to promote best practices for justice. 4. Experience working with international and foreign assistance entities, assistance missions, programs, and implementers. TRAVEL Occasional travel within Africa, Europe, and the United States may be required. Such travel shall be approved by the USAU and INL, and arranged through Department of State mechanisms (E2). Travel is approved on international airlines for economy class. PRE-DEPLOYMENT SUPPORT The Advisor shall attend briefings/orientation at the Department of State in Washington, D.C. for a period of up to two weeks prior to deployment. The INL Program Officer or his superior may request consultations with the ROLA. Upon notification, the ROLA shall make the necessary travel arrangements to Washington, D.C. During such consultations, the ROLA, should dress in traditional business attire. GOVERNMENT FURNISHED EQUIPMENT The PSC shall be able to use a furnished with office space, a computer, office telephone, and other supplies needed for job requirements. This property will be owned and maintained by the Department of State DoS. EVALUATION CRITERIA Factor 1 Program Management Experience 25 points A minimum of 2 year experience in working overseas in a promotion of justice and/or rule of law program that develops and builds the capacity of a country's justice sector, including ensuring sustainability of projects through provision of appropriate training, technical assistance, and mentoring, and a displayed ability to integrate competing needs. Experience in writing training plans, statements of work, standard operating procedures, and detailed instructions. Preferred experience working with international and foreign assistance entities, assistance missions, programs, and implementers. Factor 2 Program Experience 25 points Minimum of ten years of professional level work experience in the area of law or justice. Career path will have included jobs with increasing scope and responsibilities, and some experience at the executive or managerial level. A minimum of one (1) year experience working within a civil law context. At least one year of work experience in Africa or African matters, preferably in the field(s) of law and/justice law enforcement field and with an international partner, NGO or the U.S. Government. A minimum of one (1) year working in a civil law context. Factor 3 International Experience 15 points A minimum of one year of experience working overseas, preferably in Africa, with experience in engaging and coordinating with international and/or U.S. government agencies, host government officials, civil legal and/or justice entities, international organizations and/or private sector entities working toward a common goal. Demonstrated superior negotiation, communication, and interpersonal skills, especially in culturally sensitive situations. Factor 4 Knowledge and Abilities 25 points Demonstrate excellent knowledge of Africa and African matters. Demonstrate excellent knowledge of civil and common law institutions and procedures. Knowledge of the role and operations of legal, justice, and law enforcement institutions within a civil law system. Ability to engage in public speaking. It is preferred that the candidate demonstrate language fluency in Arabic, French, or Portuguese at the Foreign Service Institute's defined 3/3 level or Common European Framework for Reference for Languages's B2 or C1 level, or similar measurement system. Factor 5: Past Performance 10 points Past performance evaluation of applicant's ability to perform under the contract. In conducting the evaluation, the U.S. government reserves the right to utilize all evaluation information available at the time of evaluation, whether provided by the applicant or obtained from other sources. COMPENSATION (BASE PAY) For award, INL will negotiate for this contract based on the market value as outlined above and overall experience relevant to the solicitation requirements.
