Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>$150K) Acquisition Plan Action ID: VA248-16-AP-11613 1.Contracting Activity: Department of Veterans Affairs, VISN 08, James A. Haley Veterans Hospital (JAHVH) Tampa, Florida. 2237 #: 673-16-4-7311-0683 2.Nature and/or Description of the Action Being Processed: This is a sole source justification to procure a new CellInsight CX7 cellular imaging high content analysis (HCA) lab imaging and analysis system from Government Scientific Source, Inc. (GSS, Inc.) a Veteran Owned Small Business (VOSB). A firm-fixed price purchase order will be issued. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The CX7 system includes orbiter instruments, software informatics and service warranty. This fast, automated cellular imaging and analysis platform manufactured by Thermo Scientific will be used by laboratory staff for biological research and drug discovery. The platform features fluorescent microscopy, stable reliable light source, automated cell calculations, phenotyping image processing algorithms and informatics tools, that will increase data quality output and reduce the amount of hours needed for staff to make decisions about treatments. The total estimated value is $277,055.00 ($238,892.00 equipment and $38,163.00 service warranty) and the delivery lead time is 3 - 4 weeks. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 (X) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7; 5.Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with (IAW) 38 U.S.C. 8127(c) Public Law (PL) 109-461 and in support of Veterans First the CO initially searched for Service Disabled Veteran Owned Small Business (SDVOSB) authorized distributors, and then VOSB authorized distributors. Was able to locate only one VOSB authorized reseller. 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Surveyed the marketplace via GSA Advantage under SIN 66 107 Electrophoresis devices and systems, and in the open market under NAICS code 334516 Analytical Laboratory Instrument by phone calls and emails to SDVOSB and VOSB. Was unable to locate vendors willing to quote on this requirement. Thermo Scientific confirmed that the only authorized distributor is a VOSB and there are no other small business distributors (documentation on file). 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: GSS, Inc. discounted open market price of $238,892.00 for equipment is $24,686.84 less than GSA listed price of $263,578.84 which has already been determined fair and reasonable by GSA. The equipment service warranty open market price of $38,163.00 is fair and reasonable when compared to current price list $67,764.00. GSS. Inc. total estimated cost of $277,055.00 is $1,245.00 less than Independent Government Estimate $278,300.00 and is deemed fair and reasonable per FAR 13.106-3(a)(2). 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: As mentioned in paragraph 6, market research thru phone calls to Thermo Scientific, inquiries to vendors, query searches in the following databases: FedBizOpps, GSA ebuy, Federal Procurement Data System, Dynamic Small Business and eCMS were done to identify VOSB's. Results of market research found GSS, Inc. (DUNS 785807611) a verified VOSB in VETBIZ and SAM. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: IAW VAAR 819.7008 the contracting officer (CO) may award contracts to responsible SDVOSB/VOSB on a sole source basis provided the price can be determined fair and reasonable. 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The justification will be posted within 14 days of award on FedBizOpps (FBO) for 30 days in accordance with FAR 6.305 allowing interested sources an opportunity to respond. Future requirements will employ competitive procedures. 12.Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
