Description
Letter of Intent INTRODUCTION This is a pre-solicitation non-competitive (notice of intent) synopsis to award a contract without providing for full or open competition (including brand-name). THIS IS A NOTICE OF INTENT, NOT A REQUEST FOR PROPOSAL. A SOLICITATION WILL NOT BE ISSUED AND PROPOSALS WILL NOT BE REQUESTED. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under North American Industry Classification System Code (NAICS) 511210 with a business size standard of $38.5 million. REGULATORY AUTHORITY This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This solicitation incorporates provision and clauses in effect in the FAC 2005-91 FAR Revision effective September 30, 2016, including all FAR Circulars issued as of the date of this synopsis. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.5, Test Program for Certain Commercial Items. DESCRIPTION OF REQUIREMENT Purpose and Objectives It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with NextMove Software Ltd., Innovation Centre, Unit 23, Cambridge Science Park, Milton Road, Cambridge UK CB4 0EY, for the purpose of enhancing the NCBI PubChem database. This requirement includes: 1) PubBio: Biopolymer Database Search System; 2) Enhanced Oligosaccharide depiction in Sugar & Splice support and maintenance. The provided services are proprietary and commercial as defined in FAR Part 2. NextMove Software Ltd. is the only known source capable of providing the required supplies and services. NextMove Software will enhance the NCBI PubChem database to support chemically modified biomolecules including peptides, nucleic acids, oligosaccharides, glycoproteins, and non-standard peptide analogues and drug-antibody conjugates. The procurement of the Software will include support of both the LeadMine/CaffeineFix as well as Sugar and Splice which enables PubChem to support data input and output in standard formats used by the US FDA and by IUPAC. PubChem supports more than one million unique users per month and provides millions of web hits a day. This software will help PubChem improve integration chemical biology and to better support so-called ‘biologics'. Approximately one million of these biologics in PubChem. Seven of the top-10 grossing drugs worldwide are biologics. Many biologics are chemically modified biopolymers and are an intense area of research. This package will enhance PubChem with the ability to better display, search, inter-relate (by neighboring and similarity), and interpret biologics. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other services will satisfy agency requirements. Delivery/Period of Performance The period of performance is anticipated to be for a period of twelve (12) months beginning approximately November 1, 2016. Award of any contract is contingent upon the availability of funds. Responses All responses must be received by the closing date and time set forth in this notice and is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Capability statements and related materials must be received by the closing date and time of this announcement and must reference the solicitation number. Responses must be submitted electronically to Greg Benedict, Contract Specialist, at gregory.benedict@nih.gov at 12:00 pm local prevailing time on October 28, 2016. CLOSING STATEMENT This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NLM to determine if the party can meet all of the foregoing requirements. Quotations must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the vendor is capable of successfully performing the requirement. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. NextMove Software Ltd. is the only known source to NLM that can meet the above requirements for enhancing the NCBI PubChem database, due to the proprietary software previously purchased. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.212-1, Instructions to Offerors-Commercial Items (October 2015), FAR 52.212-2, Evaluation-Commercial Items (October 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications- Commercial Items (July 2016)-With DUNS Number Addendum [52.204-6 (July 2013)]. The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (May 2015)-With Addenda [Stop Work Order, FAR 52.242-15 (August 1989) and Year 2000 Compliance (July 1997)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (Sept 2016), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (April 1984); FAR 52.242-15, Stop Work Order (August 1989) with Alternate I (April 1984); FAR 52.242-17, Government Delay of Work (April 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (July 2013); FAR 52.232-39, Unenforceability of Unauthorized Obligations (June 2013).
