Description
Department of Justice Federal Bureau of Prisons Justification for Brand Name Items This procurement is being conducted in accordance with the ordering procedures at Federal Acquisition Regulation (FAR) Subpart 16.5 - Indefinite-Delivery Contracts. Under FAR 16.505 Ordering, Contracting Officers are required to document the circumstances when soliciting brand name items. Therefore, in accordance with FAR 16.505 (a)(4)(ii)"Requirements for use of items peculiar to one manufacturer shall be justified and approved using the format(s) and requirements from paragraphs (b)(2)(ii)(A),(B), and (C) of this section, modified to show the brand-name justification". 1. Identification of the agency and the contracting activity - U.S. Department of Justice, Federal Bureau of Prisons(Bureau), Central Office, Administration Division,Acquisitions Branch, National Acquisitions Section.2. Nature and/or description of the action being approved-This action will be a 1 year delivery order issued pursuant to the terms and conditions of the National Aeronautics and Space Administration Solutions forEnterprise-Wide Procurement V (NASA-SEWP V) Government-Wide Acquisition Contract (GWAC). The acquisition is for Virtual Imaging SecurePASS contraband detection systems extended maintenance and support. 3. A description of the supplies or services required to meet the agency 's needs including estimated value- The Bureau has a requirement for maintenance and support of the contraband detection systems. These systems prevent weapons or other contraband from entering the institutions, which could compromise the safety and security of these facilities. A delay in maintenance and support could cause a life or safety hazard. The Bureau has already procured 81 contraband detection systems. The Bureau currently deploys a number of electronic devices used to detect contraband on the person such as metal detectors, electronic drug and alcohol detection devices, low dose backscatter x-ray body scan devices, etc. However, none of these devices are capable of detecting plastic, wood, and other non-metallic (organic) contraband inside the human body. Only medical x-rays can do that and medical x-rays are not normally used for routine inspection of inmates. The Bureau needs a device that capable of screening high volumes of inmates during receiving and discharging and emits low dose radiation and that has been approved by the Federal Drug Administration (FDA). These devices are be used, in a continuing effort, to reduce the movement of illegal contraband, specifically, metal and non-metallic contraband that has been swallowed and/or concealed in body cavities, by inmates. Institutions are reporting an increase in the amount of contraband being secreted in body cavities by inmates including non-metallic contraband weapons being used to assault both inmates and staff. Office of Security Technology (OST) has been following the development of contraband detection technologies for many years including technologies currently being tested by the TSA such as low dose backscatter x-ray, millimeter wave, thermal imaging, and low does transmission x-ray devices such as the SecurPASS. This acquisition is for maintenance and support of the existing SecurPass x ray machines. The estimated cost for the maintenance and support is $303,928.00. 4. Identification of exemption to fair opportunity - In accordance with FAR 16.505(b)(2)(i)(B) the contracting officer must justify restricting consideration to an item peculiar to one manufacturer. The Bureau has a requirement for a contraband detection system capable of identifying items that have been swallowed or concealed in body cavities of inmates. To date, the SecurPASS is the only agency authorized technology that provides acceptable imaging and has the necessary Prison Rape Elimination Act (PREA) required filters needed for our correctional environments in detection of swallowed contraband and/or contraband concealed in bodily cavities, and is safe and effective at meeting ANSI/HPS N43.17-2009 "Radiation Safety for Personnel Security Screening Systems Using X-Ray or Gamma Radiation" standards. 5. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable - The NASA-SEWP V Contracting Officer has already determined the price to be fair and reasonable pursuant to FAR 15.305(a)(1) and FAR 15.403-1 (c)(1)(i)(B). The Bureau contracting officer anticipates that the price will be fair and reasonable after reviewing the Product Price Index Industry Data at bls.gov(Bureau of Labor Statistics website).
