Description
Pursuant to the Federal Acquisitions Regulation (FAR) Subparts 13.106-1 (b) (2) and 13.501 and the Bureau of Prisons Acquisition Policy (BPAP) Subpart 6.304(b), the Federal Bureau of Prisons has determined that a sole source is justified for this procurement action. The following is supporting documentation in accordance with FAR Subpart 6.303-2. 1. Contracting Agency - U.S. Department of Justice, Federal Bureau of Prisons (Bureau), Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section. 2. Nature and/or Description of Action being Approved - This action is for a sole source, firm fixed price acquisition for the annual maintenance and support for the equipment proprietary to National Security Resources (NSR). 3. A description of the supplies or services required to meet the agency's needs including estimated value- The Bureau, Office of Information System (OIS) has an annual requirement for maintenance and support of the 125 Bureau's Facial Recognition Access Control Systems (FRACS). The FRACS are manufactured by NSR and are the only system used to secure the server rooms in accordance with OMB Circular A-123-Management's Responsibility for Internal Control. This OMB circular provide guidance to government agencies on agency internal controls, specifically, Information Security Controls. This acquisition will be for maintenance and support services for the equipment propriety to NSR. 4. An identification of the statutory authority permitting other than full and open competition - The statutory authority permitting other than full and open competition is 41 U.S.C. 1901. It was determined that the use of this authority is appropriate pursuant to FAR Subpart 13.501, that the circumstances of this action deem only a single source is reasonably available. 5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited- NSR owns the proprietary rights for these products and the related services. The FRACS are manufactured by NSR and are the only approve systems used to secure government facilities based on the testing by the US Army of numerous biometric systems for Force Protection Systems (FPS). Due to the proprietary and highly technical nature of the FRACS, only NSR certified authorized service providers are eligible to provide the services required for annual maintenance. NSR is the manufacturer of the FRACS and has its own trained technicians and personnel with knowledge, skill and resources to perform repairs, re-certifications, and other services covered annual maintenance contracts. 6. A description if efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2- Pursuant to FAR 6.305 (d) (1) and 13.501(a)(1)(iii), notice of intent to issue a sole source award for this requirement will be published to the Government Point of Entry(GPE) FedBizOpps.gov. 7. Contracting Officer's Determination that the Cost to the Government Will be Fair and Reasonable - The Contracting Officer examined historical data on the Producer Price Index on bls.gov of similar purchases of this type, as well as the Independent Government Estimate. Based on the information stated above, Contracting Officer anticipates the price for the renewal of annual maintenance and support services for FRACS to be fair and reasonable.
