- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition Utility Electric for Lease V674R-25 Contracting Activity: Department of Veterans Affairs, SAO-W, VISN 17, 2002 Scott BLVD, Temple, Texas 76504 Nature and/or Description of the Action Being Processed: Utilities for Palestine CBOC V674R-24 / FY17. Constellation Newenergy, Inc. / 750 E Pratt Street Baltimore Maryland 21202-3142 / Duns: 879723468 Description of Supplies/Services Required to Meet the Agency s Needs: Provide electric services for Palestine CBOC, 2000 S. Loop 256, Suite 124 Palestine, TX 75801. Combine dollar cost is $105,825.00. Meter Number: 093871999LG ESI ID # 10443720008538957. Statutory Authority Permitting Other than Full and Open Competition: (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1(b)(3); When acquiring utility services (see 41.101), circumstances may dictate that only one supplier can furnish the service (see 41.202); or when the contemplated contract is for construction of a part of a utility system and the utility company itself is the only source available to work on the system. Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): IAW FAR 41.201 & 41.205, these sources of supply for acquiring utility services are most advantageous to the Government in terms of economy, efficiency, reliability, or service. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: IAW FAR 41.202(b), In performing a market survey (see 7.101), the contracting officer shall consider, in addition to alternative competitive sources, use of the following: GSA Area wide Public Utility Contract Listing: Zero (0) identified using GSA site search. Separate contracts: Zero (0) identified through FPDS. Interagency agreements: Zero (0) identified through FPDS. SBA Dynamic Small Business: Zero (0) potential offerors utilizing SBA dynamic web search. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: It is anticipated that the cost is to be fair and reasonable as the contract has firm fixed pricing and has been in place since February 17, 2003. Pricing is regulated by the Texas Energy Commission. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: See Section VI above. Any Other Facts Supporting the Use of Other than Full and Open Competition: Competition is restricted due to the utility being a regulated service by the Texas Energy Commission. IAW with FAR 41.201(b), This acquisitions is below the simplified acquisition threshold, agencies are not required to acquire utility services by a bilateral written contract. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: See Section VI above. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The agency is not able to affect the States (Texas) authority to regulate utility services.
