- Modification #2: Kenya - Gitaru 10 Megawatt Solar Power Plant Feasibility Study (Solicitation Number: 2016-11019A) https://www.fbo.gov/index?s=opportunity&mode=form&id=a9008d79631c75d89ef2e519f169282d&tab=core&_cview=0 Q1: Can you provide clarification on the host country content percentage? Are offeror's able to increase the local (host country) labor to perform Feasibility Study beyond the 20 percent limit indicated in the RFP? A1: No more than 20 percent of the USTDA grant amount (USD $998,000) may be used to pay for services performed by (i) host country subcontractors, and/or (ii) host country nationals who are employees of the contractor (offeror). Refer to the RFP Annex III (USTDA Nationality, Source and Origin Requirements) for the full details. All offers must comply with the USTDA Nationality, Source and Origin Requirements to be eligible for consideration. Q2: If a firm is selected to perform the Feasibility Study for the KenGen Gitaru Solar Project would they be precluded from participation in follow-on development or implementation work for the Project? A2: As long as the completed Feasibility Study is availed to all the other bidders for engineering supervision works ("project implementation"), then the consultant (offeror) selected to perform the USTDA-funded Feasibility Study would not be precluded from participating in the downstream works for the Project. Q3: Will KenGen's 10 MW Gitaru Solar Project be mounted on a roof or on land? Will the Project be implemented as one plant at a single site or as multiple sites/installations? A3: The solar panels would be installed on land and would comprise one power plant sized at 10 MW. Q4: Can you clarify the term "U.S. Subcontractor" especially in relation to the potential participation of a U.S. Federally Funded Research and Development Center (FFRDC) such as a U.S. national laboratory as a subcontractor. Can a U.S. national laboratory be included as a U.S. subcontractor on the team so long as they satisfy all U.S. origin, source, and nationality requirements? A4: Refer to full definitions and requirements in the RFP Annex III (USTDA Nationality, Source and Origin Requirements). As defined in Annex III, for purposes of the USTDA funded activity, a "U.S. firm" is a privately owned firm that is incorporated in the U.S., with its principal place of business in the U.S., and which is either (a) more than 50% owned by U.S. citizens and/or non-U.S. citizens lawfully admitted for permanent residence in the United States, or (b) has been incorporated in the U.S. for more than three (3) years prior to the issuance date of the request for proposals; has performed similar services in the U.S. for that three (3) year period; employs U.S. citizens in more than half of its permanent full-time positions in the U.S.; and has the existing capability in the U.S. to perform the work in question. A partnership that is organized in the U.S., has its principal place of business in the U.S., and is more than 50% owned by U.S. citizens and/or permanent residents, qualifies as a "U.S. firm". A nonprofit organization, such as an educational institution, foundation, or association, also qualifies as a "U.S. firm" if it is incorporated in the U.S. and managed by a governing body, a majority of whose members are U.S. citizens and/or permanent residents.
