- RFQ Attachment 2 - Applicable Provisions & Clauses SOW Attachment 1 - Chemical List RFQ Attachment 1 - Statement of Work This is a combined synopsis/solicitation (RFQ) under the authority of FAR Part 13 for multiple chemicals, their certificates of purity, and material safety data sheets (MSDS) meeting the requirements identified in the attached Statement of Work (SOW) and its attached Chemicals List. The RFQ reference number for this request is SB1341-17-RQ-0016. This RFQ contains provisions and clauses in effect through Federal Acquisition Circular 2005-91, effective September 30, 2016. This acquisition is being solicited as a Total Small Business Set Aside. The associated North American Industrial Classification System (NAICS) code for this procurement is 325199 with a small business size standard of 1,250 employees. NIST intends to award one purchase order as a result of this RFQ. REQUIRED SUBMISSIONS To be considered for award, please submit a quotation by 1:00 p.m. EST November 8, 2016, to d ennis.bailey@nist.gov. A quotation shall be considered received when it is received in the electronic inbox of Dennis Bailey by the specified due date and time. Quotes, shall, at a minimum, include the following: 1. A technical quotation containing sufficient information to demonstrate the contractor's understanding and ability to meet the Government's requirement, providing concise and detailed discussion as necessary of its intended approach for fulfilling the requirements defined in the SOW. The contractor may include any other information that it deems necessary. 2. A firm fixed-price FOB Destination quotation for the chemicals set forth in SOW Attachment 1 - Chemicals inclusive of the associated price of certificates of purity, MSDS, and shipping. To facilitate Government evaluation of quotes, CONTRACTOR'S SHALL POPULATE THE "UNIT PRICE" AND THE "TOTAL PRICE" COLUMNS OF THE SOW ATTACHMENT "CHEMICAL LIST" for the quotation to be considered responsive. 3. If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" [The contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in its quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the contractor's acceptance of the Government's terms and conditions for inclusion into the resultant purchase order. 4. The DUNS number for the contractor's active System for Award Management (SAM) registration. Contractors must have an active registration at www.sam.gov to receive an award unless an exception applies. If the contractor's annual representations and certifications do not reflect the NAICS code governing this solicitation, the contractor must submit documentation representing to the Government that it is a small business under the NAICS code governing this solicitation. 5. A completed version of all required solicitation provisions (see attached provisions/clauses document - required submissions highlighted in blue). The clauses within that attachment will be incorporated into the award document. All questions regarding this notice must be submitted via e-mail to dennis.bailey@nist.gov by 1:00 p.m. EST November 2, 2016. Questions submitted after this date may not be addressed by the Government prior to the quotation submission deadline. If the contractor identifies any required chemical that is not commercially available in the requested quantities (or at all, i.e., manufacturing has discontinued), contractors are encouraged to notify the Government of this limitation of availability when submitting questions in response to this solicitation so that the Government may amend the solicitation. Note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If a contractor submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the contractor's FSS or GWAC contract, and the statement required above shall be included in the quotation. EVALUATION CRITERIA AND BASIS FOR AWARD NIST will award a purchase order to the contractor who submits the lowest priced, technically acceptable quote that is responsive to all aspects of this RFQ. "Technically Acceptable" means that the quote meets the following evaluation criteria: 1) Technical Capability at the level of "Meeting or Exceeding the Requirement," and 2) Price. Each evaluation factor is defined as follows: Technical Capability: Evaluation of Technical Capability will be based on the information submitted in the quotation. NIST will evaluate whether the contractor has demonstrated that the offered product(s) meet or exceed the requirements of the Statement of Work and its Chemicals List attachment. Contractors do not need to provide a quotation for 100% of the chemicals on the Chemicals List. To be considered technically acceptable, the contractor must provide a quotation for at least 85% of the listed chemicals. Price: The evaluated price will be the total overall price, inclusive ONLY of the chemicals quoted by ALL contractors responding to at least 85% of the required chemicals (recalling that such price shall include the costs associated with certificates of purity, MSDS, and shipping). In other words, amongst technically acceptable (i.e., > 85% fulfillment) quotations compliant with the solicitation requirements, only the quoted chemicals listed that all other technically acceptable quotations have in common will be used as a basis for price evaluation. However, the awarded price will be the total price of all chemicals (not just those in common) quoted by the contractor whose quotation is determined to be the lowest priced, technically acceptable solution.
