- Urgent non-competitive award to furnish and place rock to reduce further erosion of riverbank adjacent to Hoh road, Olympic National Park, Washington; emergency stabilization supported by the following justification (original signed document on file). Awarded as P17PX00008. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for SIMPLIFIED ACQUISITIONS OVER $3,500 ($2,000/$2,500 for Construction/Services) AND UP TO $150,000 (See FAR 13.106-1) Date: 10/15/16 PR Number: 0040306110 1. Nature and/or description of the item/service being procured and its intended use (include the anticipated cost): This purchase order (PO) is for heavy equipment and trucking with operator/drivers to perform emergency bank stabilization on the Hoh Road within Olympic National Park. In the late afternoon of 10/13/16, pictures were sent out by NPS law enforcement employees of a ~100-foot section of bank at Milepost 5.5, showing that the river had eroded and would soon be into the road bench. Given the forecast of continuing heavy rains, some kind of stabilization was needed within 24 hours or the road could potentially be completely lost. The performance period of this contract will be longer than that required to make the initial emergency repairs, so that if the temporary fix is subsequently eroded, we have the ability to quickly remobilize the contractor to perform additional emergency repairs. The PO may require the contractor to purchase fill material (gravel and/or rock) and truck it to the site. The equipment/operator prices will have its own firm fixed price per hour (which includes equipment, fuel, and operator). The PO will be awarded with a firm obligation of $33,000, representing our estimate of the value of planned work during the initial emergency repairs. Funds may be added if the temporary fix is subsequently eroded or if the circumstances require additional rock beyond the original estimated quantities and values. NPS will evaluate each situation to determine if we can make the repairs with our own equipment and operators. 2. Sole Source Justification rationale (Check one and explain below): ______ Only one responsible source. __X__ Urgent and compelling circumstances exist. Include critical delivery or performance dates, and when you became aware of the requirement. Provide a specific statement of the impact on Government operations, financial or otherwise, if the required delivery or performance dates are not met. ______ Other: Explain: A major storm was forecasted to move into the area beginning 10/13/16 and becoming stronger throughout the weekend. An evaluation of the Hoh Road on the afternoon of 10/13/16 showed that if some sort of stabilization didn¿t happen the next morning, the entire road was at risk to be lost, with a chance that it could over the night. Filling with a sole source was the only option, as finding a vendor that had the availability, resources and ability to mobilize and perform the work in less than 24 hours was urgent. 3. Market Research. Please explain the results or why one was not performed. State whether any other offers were received or anyone expressed interest: Brief market research was performed, which indicated that there is only one firm nearby that can mobilize quickly and perform the work required with minimal advance notice; other firms¿ equipment was already hired out for similar storm-related work. A local construction contractor, Bruch & Bruch Construction, is currently working on NPS construction contracts and has performed several previous construction contracts, including on the Hoh Road. They are familiar with the special conditions of the road, including narrow widths, tight turns, and steep drop-offs. Hourly prices for the heavy equipment are comparable to current prices on similar POs issued for work in Olympic National Park. 4. If this is a determination for sole source, the Contracting Officer certifies: a. Only one source is available, or urgent and compelling circumstances exist. b. The anticipated price will be determined fair and reasonable using the price analysis techniques described in FAR Part 13.106-3(a).
