This announcement constitutes the only solicitation; proposals are being requested, and a written solicitation document will not be issued. This solicitation is a Request for Proposals (RFP). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAR FAC 2005-90, October 25, 2016. The associated North American Industrial Classification System (NAICS) code for this procurement is 621111, with a small business size standard of $11.0. The DHHS/IHS, Albuquerque Area Office, 5300 Homestead Road NE, Albuquerque, NM 87110 is seeking to purchase Urgent Care/Emergency Room Staffing, to recruit physicians into temporary duty assignments at the Acoma-Canoncito-Laguna Service Unit, 80B Veterans Blvd. (P.O. Box 130) San Fidel, New Mexico 87049. All interested companies shall provide proposal(s) for the following: Services STATEMENT OF WORK (SOW) Acoma-Canoncito-Laguna Service Unit Urgent Care/Emergency Room Staffing The following SOW is for proposed Staffing for the Acoma-Canoncito-Laguna Service Unit, Indian Health Service, PO Box 130, San Fidel, New Mexico 87049, and Cibola County. On campus transitory Government housing is available. The contractor is to support the recruitment and replacement of Urgent Care/Emergency Room physicians into temporary duty assignments at the Acoma-Canoncito-Laguna Service Unit 365 days per year, 24 hours per day; 7 days per week. The contractor shall recruit, ensure their employee will get credentialed and provide placement of Urgent Care/Emergency Room physicians for assignments on an ongoing basis. The standards of medical practice and duties of the Contractor through its physicians shall be determined pursuant to ACLSU Executive Committee bylaws, medical staff bylaws, rules, and regulations of the ACLSU, applicable provisions of law including but not limited to Centers for Medicare Medicaid Services (CMS) compliance, rules and regulations of any and all governmental authorities relating to licensure and regulation of physicians and hospitals, and standards and recommendations of the DNV and Joint Commission (JC). Per Executive Order 13488, "Granting Reciprocity on Excepted Service and Federal Contractor Employee Fitness and Reinvestigating Individuals in Positions of Public Trust", any determinations regarding a contractor's status is based on the individual contactor, and not on the contract or the contracting company. Therefore, all contractor's employees must be precleared for suitability before performance commences. The following information must be submitted by all of the contractor's employees to the designated IHS Personnel Security Representative for review and preclearance: • Fingerprints • A current resume (or CV) • OF-306 (if favorable mitigation is necessary, this must be completed along with the fingerprint results) • OF-306 Child care addendum (if covered position) and IHS Provisional Authorization Memo (to be provided by the IHS PSR) All providers under the contract must be a Board Certified MD or DO, Physician Assistants, Nurse Practitioners who have permanent, full, and unrestricted license to practice medicine in a State, District of Columbia, the Commonwealth of Puerto Rico, or a territory of the United States. Providers must also have ACLS, PALS and BLS certification. All Contract physicians will be held to the same Standards of Conduct as federal employees "Standards of Conduct" http://www.fda.gov/AboutFDA/WorkingatFDA/Ethics/ucm071768.htm, Violence in the Workplace memorandum, SGM 95-4 https://www.ihs.gov/ihm/index.cfm?module=dsp_ihm_sgm_main&sgm=ihm_sgm_9504; Courtesy and Respect in the Workplace Policy. Violations of these policies may lead to contract termination. Any negligent behavior or any behavior jeopardizing patient safety will not be tolerated. Professional Review Action may be taken regarding any member of the Medical staff if activity, demeanor or conduct of the member is detrimental to patient care, disruptive to service unit operation, or in violation of the local Bylaws, Medical Staff Rules and Regulation, IHS policy or ethical. Each incident will be evaluated and documented. Documentation will be submitted to the contractor. These incidents may be grounds for immediate removal. Credentialing actions giving rise to a hearing or appeals will be in accordance with the ACLSU Medical Staff By-Laws. No costs for travel, attorney fees, phone, mail, or other expenses associated with the candidates hearing or appeal will be provided by the IHS, or the local service unit. The Contractor physician/provider shall provide immediate medical evaluation, treatment, and/or referral of patients who present for care in the IHS facility emergency services area. The Contractor physician shall provide professional advice to Urgent Care/Emergency Room personnel and ward personnel in emergency situations with regard to professional management of patients being treated and/or hospitalized. Work assignments will be defined by the Clinical Director (or designee) to include shifts within the hours of operation of the facility. Contract physicians will limit consecutive 12-hour shifts to maintain acceptable levels of patient safety. Regular work schedules may include Federal holidays (New Year's Day, Martin Luther King Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day). The work hours/shifts cannot be changed/traded/switched without prior approval from the Clinical Director (or designee). Contract physicians shall generate and maintain proper medical record information on beneficiaries to whom treatment is provided in accordance with Indian Health Service, Joint Commission, and Centers for Medicare Medicaid regulations. The Contractor physician shall prepare all electronic medical record documentation to meet or exceed the established standards of the IHS facility to include but not be limited to: timeliness, legibility, accuracy, content, and signature. Contractor physicians shall complete all third party reimbursement and referral forms. All medical record information and documentation generated in the performance of this contract must be completed at the time of departure and will remain the property of and subject to the exclusive control of the Indian Health Service. The Medical Records Department shall be notified in advance of the contractor provider's last workday. The Clinical Director will not sign off on the contractor provider's timesheet unless the contractor provider is cleared by Medical Records utilizing the Medical Records Clearance Form. Failure to complete medical records before leaving may result in a delay of the processing of all invoices from the contractor. To ensure that contract providers are in compliance with all facility regulations, ACLSU shall provide contract providers an orientation on Cultural Sensitivity, Customer Service, Resource & Patient Management System (RPMS), Purchased and Referred Care (PRC) and Electronic Health Record (EHR) systems. Each contract provider shall be granted access to RPMS and EHR systems for electronic documentation of patient care services. This orientation will be paid at the regular rate. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The contractor's conformance with the technical requirements of this contract will be monitored for the period of performance. This assessment will include observations of the work system, methods and execution. Examples of monitoring methods include, but are not limited to: compliance with the Indian Health Service credentialing and privileging requirements, appropriateness of candidate placement (e.g., number of removals, number of early termination of assignments due to personality conflict, poor work habits, and inadequate skills for the assignment, unprofessional or discourteous behavior). An assessment spreadsheet with these methods will be monitored by the Clinical Directors and the Contracting Officer's Representative (COR). The government will evaluate information based on the following evaluation criteria: (1) problem and approach meeting or exceeding the requirement, (2) past performance and experience, and (3) Management. The primary consideration in evaluating these criteria shall be which the offeror can perform the contract in a manner most advantageous to the Acoma-Canoncito-Laguna Service Unit as determined by the evaluation of offer according to established evaluation criteria. Under best value principles, there is no requirement that a contract be awarded on the basis of lowest proposed cost. Evaluation factors when combined are significantly more important than cost or price. It is very important that each offeror furnish the Indian Health Service with specific information on the three (3) criteria listed below. Offerors should submit their best offer initially as the Indian Health Service reserves the right to make an award without discussion. Evaluation Factors: A. Problem and Approach Evaluation of these criteria will assess the offeror's overall understanding of the complexities and logistical requirements associated with the provision of urgent care/Urgent Care/Emergency Room physician services at the Acoma-Canoncito-Laguna Service Unit (Hospital), in San Fidel, New Mexico and the offeror's ability to successfully staff such project. This criteria will be based upon the offeror adequately addressing each of the following elements and including sufficiently detailed information to allow a complete analysis of the offeror's technical capabilities and responsibility: 1. Understanding of the problems in delivering urgent care/Urgent Care/Emergency Room services at a rural IHS facility. 2. Understanding of the complexity and logistical requirements of the project. 3. Possession of necessary organization, experience, and technical skills to perform the work. 4. A detailed work plan shall be submitted indicating how each aspect of the Statement of Work is to be accomplished. The technical approach should be in as much detail necessary to fully explain the proposal technical approach or methodology. Particular attention should be directed toward the scheduling of manpower and approach to be overcome. 5. Ability to respond to planned and urgent placement requests. 6. Ability to meet IHS credentialing requirements. 7. Ability to provide Acoma-Canoncito-Laguna patient documentation and reporting requirements. B. Past Performance and Experience The Past Performance and Experience evaluation factor will assess the relevance and breadth of the offeror's experience and the quality of the offeror's past performance on contracts consistent in scope and complexity with temporary Urgent Care/Emergency Room physician services at the Acoma-Canoncito-Laguna Service Unit (Hospital), in San Fidel, New Mexico. 1. The technical proposal must include a listing of other Urgent Care/Emergency Room physician services contracts and subcontracts, Government and/or commercial, awarded to the offeror for practice situations serving rural, isolated locations. The contracts should contain the same type of Urgent Care/Emergency Room physician requirements outlined in the Statement of Work. The offeror must include the following information for each contract and subcontract. a) Name of contracting activity b) Contract number c) Contract type d) Total contract value e) Description of contract work f) Contracting officer and telephone number g) Program manager and telephone number h) Government project officer and telephone number i) List of major subcontractors j) Dates of performance The offeror must demonstrate its record of successful performance in past contracts and subcontracts, Government and I or commercial. Each offeror will be evaluated on its performance under existing and prior contracts and subcontracts for similar services. The offeror shall include the following past FIVE (5) years performance information: For each contract: 1. Identify the one contract, which you consider to be the most successful, and the reasons for this determination. 2. Evidence of timely and acceptable contract performance on similar outlines in the Statement of Work. 3. Evidence indicating for cost control and budgetary considerations. 4. Management of a similar project. C. Management The technical proposal at a minimum must include the following information in sufficient detail to allow a complete analysis of the offeror's management capabilities and responsibility. 1. Financial capability to perform the Statement of Work. 2. Capability to meet delivery or performance schedules. 3. Possession of necessary organization, experience and technical skills to perform the work, or the ability to obtain them. FAR 52.216-18 Ordering (OCT 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. FAR 52.216-21 Requirements (OCT 1995) (a) This is a requirements contract for the supplies or services specified and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule. (d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract. (e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source. (f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. FAR 52.217-8 Option to Extend Services (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the Contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days before the contract expires. FAR 52.217-9 Option to Extend the Term of Contract (MAR 2000) A. The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. B. If the Government exercises this option, the extended contract shall be considered to include this option clause. C. The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.
