- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION. The National Heart, Lung, and Blood Institute (NHLBI), Office of Acquisitions (OA), intends to negotiate and award a purchase order on a noncompetitive sole source basis to University of Maryland Medical System, 22 S Greene Street, Baltimore, MD, 21201-1544, to provide lymphocyte collection services for patients in support of an NHLBI clinical protocol. BACKGROUND Researchers within the Division of Intramural Research (DIR) of the National Heart Lung and Blood Institute (NHLBI) are engaged in the study of allogeneic stem cell transplantation and tumor immunology in the treatment of various blood diseases and cancers. The DIR is the sponsor of a clinical protocol employing a novel approach to bone marrow transplantation to reduce the incidence of chronic graft-versus-host disease (cGVHD) (referred to herein as the "Protocol"). The University of Maryland Baltimore, a public university that is part of the University System of Maryland, a public corporation and an instrumentality of the State of Maryland ("UMB"), and the University of Maryland Medical Center LLC ("UMMC") are the sole outside participants in the Protocol. Recognized as a National Cancer Institute-designated comprehensive cancer center, UMB is a valuable partner of the DIR and contributor to its protocols. UMMC and UMB operate a state-of-the-art Blood and Marrow Transplant (BMT) unit conveniently located within 40 miles of the National Institutes of Health Clinical Center. Recently, NHLBI, UMMC and UMB created a joint-BMT program to facilitate on-going collaborations on transplant protocols including the Protocol. PURPOSE The DIR-sponsored protocol requires UMMC to collect lymphocytes from transplant patients. The collection of lymphocytes from transplant patients is a service unique to this protocol and is not considered a "standard of care" at UMMC. As such, UMMC is unable to offer this service without additional resources from the NHLBI. The NHLBI, therefore, must reimburse UMMC for costs incurred from this service. JUSTIFICATION The sole source determination is based on the fact that UMMC is the only outside organization involved in NHLBI's protocol. As such, it is the only outside organization authorized by NIH's Internal Review Board to engage in the activities referenced in the Statement of Work. Any attempt to obtain these services from another organization would violate Federal Law governing experimental bio-medical research. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulations (FAR) Subpart 13.106-1(b), soliciting from a single source (for purchases not exceeding the simplified acquisition threshold) and only one responsible source and no other supplies or services will satisfy agency requirements. ADDITIONAL INFORMATION Industry Classification (NAICS) Code is 622110, General Medical and Surgical Hospitals, and the Small Business Size Standard is $38.5 million. The acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, therefore the requirements of FAR Part 6, Competitive Requirements, are not applicable (FAR Part 6.001). The resultant award will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 05-89 (November 1, 2016). This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by November 18, 2016 at 9:00AM EST and must reference synopsis number NHLBI-CSB-HL-2017-027-KMA.
