- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, FAR Part 13, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The request for quotation solicitation number is FA8656-17-RAC-0003. This requirement is for 70 Shipping Containers for Standoff Precision Guided Munition (SOPGM). The shipping will be done via a Government Bill of Laden, FOB Origin. Delivery shall be 60 days ARO. The will not pay performance oriented packaging testing (POP) testing, however it shall be certified IAW 49 CFR 178. To request a copy of the shipping container specs, please contact POCs below no later than 21 November 2016. The North American Industry Classification System (NAICS) code for this acquisition is 336419 with a size standard of 1,000 employees. This notice of contract action is not a request for competitive proposals; however, all responses received within fifteen (15) days of the issuance of this notice will be considered by the Government. Interested responsible sources may identify their interest and submit a capability statement in response to this notice. In your response, indicate your business size (large, small, small disadvantaged, 8(a), women-owned, HUBZone, veteran-owned, service-disabled veteran-owned) and specify whether the firm is U.S. or foreign-owned. The Government will not be responsible for any costs incurred preparing proposals in response to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. The following factors shall be used to evaluate offers:  Factor 1- Technical • The subfactor within the technical factor will receive one of the ratings described below based on the criteria listed below. Individual subfactor ratings will be used to determine the overall technical acceptability of each offeror. To be determined technically acceptable at the factor level, the Offeror must be rated acceptable in each subfactor. A final unacceptable subfactor assessment will determine an overall technical unacceptable rating. Rating Description Acceptable Proposal clearly meets the minimum requirements for the solicitation. Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation. • Subfactor 1: Special Qualifications • The Government will assess the Offeror's proposed Special Qualifications. The subfactor minimum is met when the Offeror's proposal thoroughly substantiates all the following essential components with little potential for disruption of schedule, increased cost or degradation of performance: o 70 munition shipping containers IAW specifications.  Factor 2- Cost/Price: • The Government shall evaluate the Total Evaluated Price (TEP) of all technically acceptable Offerors. • (b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. • AFFARS 5352.201-9101, Ombudsman (C): (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (d) The ombudsman has no authority to render a decision that binds the agency. (End of Clause); • 53AFFARS 5352.223-9000, Elimination of Use of Class I Ozone Depleting Substances (C);N/A Incorporated by full text: • DFARS 252.204-7004 Alt A, System for Award Management (52.204-7) Alt A: (a) Definitions. As used in this provision- "System for Award Management (SAM) database" means the primary Government repository for contractor information required for the conduct of business with the Government. "Commercial and Government Entity (CAGE) code" means- (1) A code assigned by the Defense Logistics Information Service (DLIS) to identify a commercial or Government entity; or (2) A code assigned by a member of the North Atlantic Treaty Organization that DLIS records and maintains in the CAGE master file. The Contractor will be required to provide consent for TIN validation to the Government as part of the SAM registration process; and (4) The Government has marked the record "Active." • DFARS 252.209-7999, Representation by Corporations Regarding an Unpaid Delinquent Tax Liability or a Felony Conviction under any Federal Law (DEVIATION 2012-O0004) (a) In accordance with sections 8124 and 8125 of Division A of the Consolidated Appropriations Act, 2012, (Pub. L. 112-74) none of the funds made available by that Act may be used to enter into a contract with any corporation that- (1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has Considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government. (2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
