Description
The Space and Naval Warfare Systems Command (SPAWARSYSCOM), in support of the Program Executive Office for Command, Control, Communications, Computers, and Intelligence (PEO C4I), Communications and GPS Navigation Program Office (PMW/A 170), intends to award a sole source modification to contract N00039-13-C-0001 for the Commercial Broadband Satellite Program (CBSP) Force Level Variant (FLV) (AN/USC 69(V)(2)), under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, Only One Responsible Source, to Harris Corporation, DBA Harris Government Communications Systems Division located at 2400 Palm Bay RD NE, Palm Bay, Florida, 32905-3399. Contract N00039-13-C-0001 was awarded on 05 March 2013 as a sole source contract using the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, Only One Responsible Source. Contract N00039-13-C-0001 is a five (5) year (base year with four (4) one (1) year options), $35M effort and provides for procurement of an estimated total quantity of 15 FLV integrated C and Ku band terminals, provisioning items, training, and engineering support services. The subject modification will provide for procurement of an estimated 5 additional terminals, provisioning items, and training over three additional years, and additional engineering services to support fielded terminals. All terminals, provisioning items and training will be procured on a firm-fixed-price (FFP) basis. Engineering support services will be procured on a cost-plus-fixed-fee (CPFF) basis. The CBSP FLV terminals provide high throughput for commercial SATCOM connectivity capability from networks aboard the Navy's ships to the Navy's shore infrastructure. Harris Corporation, DBA Harris Government Communications Systems Division is the Original Equipment Manufacturer (OEM) of the FLV terminal and is the only responsible source capable of providing the CBSP FLV terminal, engineering services, and provisioning item requirements without incurring unacceptable delays in meeting the Government's ship installation schedule. Harris is the only firm that can provide a CBSP FLV terminal that has successfully passed contractor qualification testing and Government environmental and operational testing to be qualified for shipboard use. The Government estimates the time required for another source to complete contractor qualification testing and Government environmental and operational testing is 35 months. A 35 month delay would result in cancellation of the scheduled FLV installations in Government fiscal years 2018, 2019, 2020. Cancellation of these installations and continued reliance on existing SATCOM systems that are at end-of- service life increases the risk that vital SATCOM capabilities may be unavailable to support Fleet operational requirements. Additionally, the Government anticipates the time to establish the above CBSP FLV engineering services capabilities would take a new contractor a minimum of eighteen (18) months. An eighteen (18) month gap in engineering services would introduce risk to the Government by not having an established contractor with the capability to repair and maintain the FLV systems. Command and Control functions including NIPR, SIPR, and Network Centric Operations at sea would be degraded if an FLV system were to fail in the fleet and engineering services were not available. This would directly impact a ship's capability to deliver mission critical data and imagery to warfighters and theater commanders. The NAICS code for this procurement is 334220.
