- Solicitation Description: (i) This is a combined synopsis/solicitation for a commercial item prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This requirement falls under the Foreign Military Financing (FMF) program therefore only U.S. vendors will be considered for award and all items must be manufactured in accordance with the Buy American Balance of Payments Program. (ii) The solicitation number is W912ER-17-T-0004 and the solicitation is issued as a Request for Quote (RFQ). (iii) The full text of the Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulations supplement (DFARs) can be accessed on the Internet at http://www.arnet.gov/far/. (iv) The associated North American Industries Classification System (NAICS) code for this acquisition is 541330 and the small business size standard of $15,000,000,00. (v) Quotes must be broken down and prices shown for each of the following Contract Line Item Numbers (CLIN): CLIN 0001 ABB 3-Pole Contactor Procurement and Inspection. This is a Firm-Fixed-Price (FFP) CLIN. (vi) The Period of Performance one year after contract award with a one year option period. (vii) The provision at 52.212-1, Instructions to Offerors - Commercial Items, applies to this solicitation. (vii) The provision at 52.212-2, Evaluation - Commercial Items, is applicable to this solicitation. It is the Government's intent to award a contract to the lowest price Offeror without discussions however; the Government reserves the right to hold discussions if deemed necessary. All quotes will be evaluated as stated in this clause in the solicitation document. The basis of award for this requirement is lowest price technical acceptable. (ix) The provision at 52.212-3, Offeror Representations and Certifications - Commercial Items, applies to this solicitation. The contractor must return a completed copy of this provision with its proposal or certify that it has current representations and certifications at the www.sam.gov website. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) The clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisition. (xi) The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders applies to this acquisition.
