Description
This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) 5.2 - Synopses of Proposed Contract Actions. The US Army Corps of Engineers (USACE) Portland District intends to award a sole-source, Firm-Fixed Price contract with Skalski Statistical Services to maintain a large database that consists of multi-million recapture events of juvenile salmonid detections. Skalski Statistical Services will also maintain the website and software they developed as a subcontractor under a Department of Energy (DOE) contract DE-AC05-76RL01830, which enables users to access the database. These studies have been conducted using the Juvenile Salmonid Acoustic Telemetry System (JSATS), which have generated millions of detections used to create survival estimates for specific USACE hydroelectric projects in the Columbia and Snake Rivers. These estimates and associated data are rigorously reviewed by the USACE, the National Marine Fisheries Service (i.e., NOAA), US Fish and Wildlife Services, Washington Department of Fish and Wildlife, Oregon Department of Fish and Wildlife, Idaho Department of Fish and Wildlife, and Tribal partners. In order to maintain transparency, USACE grants these regional stakeholders access to the raw data by providing a publicly accessible website and software. The software used to access and organize the database is freeware available at no cost from the website, which was developed by Skalski Statistical Services. The database is very voluminous and complex, but enables stakeholders to perform their own analysis of the data to provide various juvenile fish dam passage survival and other passage related metrics. They also developed the supporting software (Filtering Acoustic Signal Transmissions, Acoustic-Tag Data Translation Utility, and Active Tag-Life Adjusted-Survival) used to collect and manipulate the data. Total contract period of performance will be from award date to December, 2018. Skalski Statistical Services developed the database and software to query millions of data points collected from various locations in the Columbia and Snake Rivers from the inception of the database. The Government has evaluated the requirement, and determined that an alternate contractor would incur additional costs because they would need to develop infrastructure and familiarize themselves with the current software and website. They would also need to establish the servers to store the Government owned database, which have already been established by Skalski Statistical Services. A new contractor competing in a solicitation would incur the additional transition costs. Considering these factors, there is some risk and additional costs to the Government if it awards a purchase order to a new contractor. For these reasons, it is in the best interest of the Government to award a purchase order to Skalski Statistical Services. The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c) (1) as implemented by FAR 13.106-1(b) for purchases not exceeding the simplified acquisition threshold. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS OR QUOTATIONS, AND A SOLICITATION WILL NOT BE POSTED Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. All responsible sources may submit a capability statement, proposal or quote to the contracting officer before the notice end date. If there are not any affirmative written responses received by 12:00 pm Pacific Daylight Time on 20 January 2017 an award will be made without further notice. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.
