- SPECIFICATIONS PLANS AND DRAWINGS SOLICITATION Phase 1 of the project will consist of construction of an artificial oyster reef (Reef #2) in the Piankatank River, up to 25.2 acres in size, using an estimated 20,500 to 29,000 tons of Class A1 (VDOT Spec) quarry stone riprap in the lower Piankatank River, Mathews and Middlesex Counties, Virginia. The material shall be placed using a barge-mounted excavator and will extend between 12 and 18 inches above the natural river bottom. The estimated value of the project is approximately $1,000,000 to $5,000,000. The base bid will be 18.6 acres of reef creation. Option 1 is for an additional 3.8 acres and Option 2 is for an additional 2.8 acres of reef construction. Therefore, the maximum reef constructed could be 25.2 acres in size. It is expected that construction Phase 1 will begin in the spring of FY17. The Contractor shall comply with the provisions of EM 385-1-1. If the Contractor is a currently accepted participant in the Dredging Contractors of America (DCA)/United States Army Corps of Engineers (USACE) Dredging Safety Management Program (DSMP), as determined by the DCA/USACE Joint Committee, and holds a current valid Certificate of Compliance for both the Contractor Program and the Dredge(s) to be used to perform the work under this contract, the Contractor may, in lieu of the submission of an Accident Prevention Plan (APP), (1) make available for review, upon request, the Contractor's current Safety Management System (SMS) documentation, (2) submit to the Contracting Officer the current valid Company Certificate of Compliance for its SMS, (3) Submit the current dredge(s) Certificate of Compliance based on third party audit, and submit for review and acceptance, site-specific addenda to the SMS as specified in the solicitation. RESTRICTIONS The work is to be performed in the vicinity of the Piankatank River. The Contractor shall perform the scheduled reef habitat construction and all other associated work in accordance with all requirements as indicated and as specified herein. The Contractor is advised that any deviations from the construction methods and procedures indicated and as specified herein that are not prior-approved in writing by the Contracting Officer shall be cause for the Contracting Officer issuing a stop work order. Any stop work orders issued for such cause will not be subject to time extensions or cost recovery by the Contractor. Any non-compliance with or violation of the laws or regulations governing the work operations for the project may result in criminal and civil penalties against the Contractor. a. Security and Public Safety of Work Areas The work areas are accessible in a limited manner to the general boating public; however, the Contractor is informed that the Government will not undertake to exclude the public or restrict public access to the work areas during the work. The Contractor shall be solely responsible for protection of the public at all times for the duration of the contract and fully comply with the provisions of OSHA safe working practices and the Safety and Accident Prevention requirements of these specifications. b. Noise Control and Abatement The Contractor shall employ the use of properly installed and maintained mufflers, silencers, and manufacturer's recommended sound suppressors on all plant, machinery, and equipment used on this work. The use of sound signals such as whistles, horns, or bells shall not be used if two-way radio communication can accomplish the required function. c. Coordination with Other Contractors During the period of this contract, other contracts may be in force for the construction of other features of work on or adjacent to the site of work being accomplished under this contract. The Contractor shall arrange his plant, and shall schedule and perform this work, so as to effectively cooperate with all other contractors and Government agencies. It shall be the responsibility of the Contractor on this contract to be fully informed of the extent of the limits of work to be performed by other contractors. Should there be any conflict between these limits, the Contractor shall immediately notify the Contracting Officer of the conflict, and the Contracting Officer's decision shall be final. 3. CONSTRUCTION TIME In accordance with solicitation provision 52.211-10, the contractor must complete all work under the contract, inclusive of options, within 120 days of the issuance of the notice to proceed. The contractor must commence in-water construction no later than __45__ days after issuance of the notice to proceed. The contractor shall provide _7___ days notice before any in-water construction begins. Measurement and payment for mobilization and demobilization are defined at Section 01 22 00 of the technical specifications; bidders are instructed that the awarded contract will not provide for reimbursement of costs associated with a remobilization of the contractor's plant and equipment. Offeror, whose proposal conforms to the solicitation and is fair and reasonable. In addition, the awardee must be found responsible in accordance with FAR 9.1. The magnitude of construction is between $1,000,000.00 and $5,000,000.00. The NAICS code applicable to this requirement is 237990, with a small business size standard of $36.5 million. The proposed procurement listed herein is 100% set-aside for Small Business. Proposals shall include sufficient detailed information to allow complete evaluation. The Government reserves the right to reject any and all offers. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proof of acceptability rests with the Offeror. The solicitation will be available in electronic format only. Paper copies of this solicitation will not be available. Other methods of requesting a package will not be honored.
