Description
The proposed acquisition requires the use of the cited statutory authority because the Apache Main Rotor Head is a Critical Safety Item (CSI). Technical data, to include Depot Maintenance Work Requirements (DMWR) 1- 1615-312 Change #1, Revision Dated 09 July 2010 and all applicable Maintenance Engineering Orders (MEOs) are available for this overhaul/repair. The Main Rotor Head is critical to ensure the fully mission capability of the aircraft and requires extremely close overhaul tolerance and quality assurance provisions, overhaul/repair can only be performed by an approved source although extensive technical data packages have been developed to foster competition. Pursuant to the provision of Public Law No. 108- 136, National Defense Authorization Act Fiscal Year 2004, Section 802, Quality Control in Procurement of Aviation Critical Safety Items and Related Services, as implemented for acquisition by Department of Defense Acquisition Regulation Supplement 209.270, contracts for modification, overhaul or repair of CSI items can only be awarded to a source approved by the head of the design control activity. Currently there are only two sources approved by the AED to perform the overhaul/repair effort. The approved sources are, The Boeing Company, (CAGE code 8V613, large business) 5000 East McDowell Rd., Mesa, AZ 85215-9707 and PCX Aerostructures, LLC (CAGE code 82001, small business) 300 Fenn Rd., Newington, CT 06111. There are currently no pending source approval requests (SAR) for this item. Both a Product Verification Audit (PVA) and M&O CSI Quality Systems requirement (QE-STD- 2) are required for this overhaul/repair. The contractor is required to submit the Frozen Plan for approval 30 days after contract award, and a PVA must be performed within 90 days after Frozen Plan approval. The overhaul/repair shall be accomplished in accordance with the contractor approved Frozen Plan. The required delivery is 10 each per month, 150 days after receipt of order (ARO). The Frozen Plan and the PVA requirements must be approved prior to acceptance of deliveries by the government.
