Description
Brand Name Justification for SAS Licenses and Maintenance Notice of Intent: The United States Department of Energy, Advanced Research Projects Agency - Energy (ARPA- E), Washington D.C. 20585 intends to award a sole source Purchase Order to Executive Information Systems (EIS) SAS licenses and maintenance. The Government intends to solicit and negotiate with only one source under the authority of FAR 6.302-1(a)(2)(ii)(B) - Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This synopsis is being published for informational purposes only. This proposed action is for SAS software is propriety and is not sold by resellers; it is accessible only through the SAS Institute, Inc. and its certified partners. EIS is a certified SAS partner that also qualifies as a small business. EIA has a requirement mandated by Congress to process energy information surveys (annually, quarterly, monthly and weekly). Many of these processing systems are or will be based on SAS software for their timely and effective operation. For example, to improve performance at the least cost, many of EIA's oil and gas survey processing systems are being converted to a general-purpose survey-processing tool called STEPS (Standard Energy Processing System), a SAS-based system developed by the US Bureau of the Census. It is currently being used to process 19 oil and gas surveys. EIA must purchase and maintain the necessary SAS tools and solutions (i.e., source code, documentation, maintenance and support) that allow STEPS to function. These tools and solutions are available only from the SAS Institute, Inc. and its certified partners. Inquiries using the Internet and Data Pro aimed at finding other sources were not successful. Another example is the use of the Federal Statistical auditing software for disclosure avoidance. The applicable North American Industry Classification System Code (NAICS) for this requirement is 423430 -Computer and Computer Peripheral Equipment and Software Merchant Wholesalers 250; Business size standard for NAICS 423430 is 250 The statutory authority for permitting other than full and open competition for this requirement is pursuant to 41 U.S.C. 3304(a)(1) and FAR Part 6 for the aforementioned requirement based on the application of FAR 6.302-1(a)(2)(ii)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies, or services are unique, or highly specialized. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice of intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement in response to DOE's intent to purchase on a sole source basis. Any capability statements shall be considered by the Government if received by 10:00 am Local (Washington D.C.) Time, Wednesday, February 8, 2017. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government to change the acquisition strategy for the proposed requirement, based upon responses to this notice, is solely within the discretion of the Government.
