- It is the intent of the National Library of Medicine (NLM) to enter into a sole source procurement with DeLima Associates, 1227 Providence Terrace, Suite L-2, McLean, VA 22101, to acquire rights to use the Consumer Product Information Database (CPID) in accordance with the terms and conditions of a License Agreement. CPID will be used primarily to update the NLM Household Products Database https://householdproducts.nlm.nih.gov/. Award of any contract is contingent upon the availability of funds. This action is under the authority of 41 U.S.C.253 (c) (1), as set forth in FAR 6.302-1 and HHSAR 306.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition will be processed under FAR Part 12 - Acquisition for Commercial Items and will be made pursuant to the authority in FAR Part 13.5, Test Program for Certain Commercial Items. The intended procurement is classified under North American Industry Classification System Code (NAICS) 541511 Custom Computer Programming Services with a business size standard of $15.0 million. The integration of these consumer oriented data with existing health data in SIS databases will be critical. The use of the existing SIS databases, originally designed for the professional community, will be extended to a wider audience, seeking information about chemical exposures from household products. The period of performance is anticipated to be for a period of twelve (12) months beginning approximately February 22, 2017 to February 21, 2018 with (4) one year option. Award of any contract is contingent upon the availability of funds. This solicitation incorporates provision and clauses in effect in the FAC 2005-94, N2005-95 FAR Revision effective January 19, 2017, including all FAR Circulars issued as of the date of this synopsis. NLM anticipates that an award will be made on or about February 22, 2017. This is not a solicitation for competitive quotations, nor is a RFQ available. However, if any other interested party believes that it can meet the requirement it may submit a statement of capabilities. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NLM to determine if the party can meet all of the foregoing requirements. Capability statements and related materials must be received by the closing date and time of this announcement and must reference the solicitation number. Responses must be submitted electronically to Suet Vu, Contract Specialist, at Suet.Vu@nih.gov at 12:00 pm local prevailing time on February 20, 2017. Vendors shall comply with all applicable Federal, State and Local laws, executive orders, rules and regulations applicable to its performance under this order. The following clauses and provisions cited herein are incorporated by reference into this announcement: FAR 52.212-1, Instructions to Offerors-Commercial Items (Jan 2017), FAR 52.212-2, Evaluation-Commercial Items (October 2014). Offerors are advised to provide with their offer a completed copy of the following provisions: FAR 52.212-3, Offeror Representations and Certifications- Commercial Items (Jan 2017)-With DUNS Number Addendum [52.204-6 (Oct 2016)]. The following FAR clauses apply to this acquisition: FAR 52.212-4, Contract Terms and Conditions-Commercial Items (Jan 2017)-With Addenda [Stop Work Order, FAR 52.242-15 (August 1989) and Year 2000 Compliance (July 1997)]; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (Jan 2017), as well as the following clauses cited therein: FAR 52.232-18, Availability of Funds (April 1984); FAR 52.242-15, Stop Work Order (August 1989) with Alternate I (April 1984); FAR 52.242-17, Government Delay of Work (April 1984); and FAR 52.232-33, Payment by Electronic Funds Transfer-System for Award Management (July 2013); FAR 52.232-39, Unenforceability of Unauthorized Obligations (JUN 2013). A determination by the government not to compete this proposed acquisition based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This notice does not commit the Government to award a contract.
