- Notice of Intent to Award a Sole Source Contract for a replacement x-ray tube for the PANalytical Epsilon 5 X-Ray instrument. The Food and Drug Administration intends to make a sole source award for a replacement x-ray tube for the PANalytical Epsilon 5 X-Ray instrument in the amount of $25,750. The award will be made to: PANalytical, Inc. 117 Flanders Road Westborough, MA 01581 In accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. X-ray fluorescence (XRF) spectrometry is used to analyze samples of color additives (synthetic dyes) that are used in foods, drugs, cosmetics and medical devices for elements with limiting specifications listed in 21 CFR Part 74. XRF is the primary means of analysis used to determine levels of these materials in the range of 1 – 1000 ppm. XRF is also used for official sample analyses when elemental composition is being determined. Reliable and timely maintenance and repair of this instrument is critical to the mission of the Color Certification Branch which is to certify color additives for use in foods, drugs, cosmetics and medical devices. The lab uses the PANalytical Epsilon 5 X-Ray instrument to fulfill this mandate. Alternative parts are not acceptable as the x-ray tube required is proprietary to the PANalytical equipment in use and other parts would void the manufacturer’s warranty. The NAICS code for this action is 334516. This procurement is made under the authority of FAR 6.302- Only one responsible source and no other supplies or services will satisfy agency requirements. This is a notice of intent to issue an award on a sole source basis. This notice of intent is not a solicitation for competitive proposals.
