- NINDS Squid Research Program Facilities & Materials Support Services Notice of Intent to Sole Source HHS-NIH-NIDA-SSSA-NOI-17-166 INTRODUCTION THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; a proposal is being requested from the sole source vendor and a written solicitation will not be issued. The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute of Neurological Disorders and Stroke (NINDS) intends to negotiate and award a contract without providing for full and open competition (including brand-name) to the Marine Biological Laboratory for squid research program facilities and support services. REGULATORY & STATUTORY AUTHORITY This acquisition is conducted as non-competitive for a commercial item or service under the authority of the FAR Subpart 13.5-Simplified Procedures for Certain Commercial Items and 13.501 Special documentation requirements, and the authority of 41 U.S.C. 1901 and the statutory authority of FAR Subpart 6.302-1. The requirement is expected to exceed the simplified acquisition threshold. Pursuant to FAR Subpart 13.501 (a) (1) (iii) the justification (excluding brand name) will be made available within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95 dated January 19, 2017. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The associated NAICS code for this requirement is 541990 with size standard of $15 Million. CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The non-competitive determination is based upon the market research conducted as prescribed in FAR Part 10--Market Research, which indicates that the Marine Biological Laboratory (MBL) is the only contractor capable of meeting the needs of this requirement to ensure continuity of science. This is a follow on requirement for continuation of loligo pealli squid nervous system research which must take place at a location where the squid may be collected and studied on-site. This species of squid may only be found on the North Atlantic Ocean coast, and only for approximately six months of the year; further, the species of squid cannot be cultured or stored for any length of time. The MBL is the only facility capable of providing freshly caught loligo pealli squid for research purposes at a site which contains the research equipment needed for immediate loligo pealli squid nervous system research purposes. Additionally, as this requirement has been performed at the MBL since the squid research program's inception, all longitudinal research data is based on the equipment provided by MBL. Use of any other research equipment would jeopardize standardization of research data, potentially destroying the usefulness of existing data. Therefore, to ensure continuity of science, only the Marine Biological Laboratory is capable of meeting the needs of this requirement. This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice if it is believed that the requirement may be met competitively. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. DESCRIPTION OF REQUIREMENT Background The NINDS Squid Research Program studies loligo pealeii squid for neurological research purposes. Loligo pealeii squid have a giant nerve cell, almost a thousand times as bigger than human nerve cells, that allows researchers to study nerve cells in greater detail prior to research in human cells. Loligo pealeii squid are found on the north east coast of the Atlantic Ocean in the United States for approximately six months a year. To perform this nerve research in the loligo pealeii squid, laboratory and office space, electron microscope instrumentation and technical support, and access to the species of squid and other materials are required. These services must be provided by a facility where the squid may be collected, delivered, stored in the laboratory until tested as this species cannot be cultured, fed, or transported effectively. This requirement has historically been met by the Marine Biological Laboratory located in Woods Hole, Massachusetts. This is a follow-on requirement. Purpose and Objectives The purpose of this acquisition is to acquire laboratory and office space, electron microscope access, usage, and technical support, and supplies (e.g. Loligo pealeii squid) for Principal Investigators and staff of the NINDS Squid Research Program during the Atlantic Coast annual squid season. Scope of Work The Contractor shall provide the NINDS Squid Research Program with the following services: Facilities Service Requirements •The Contractor shall provide four (4) laboratory rooms of, at least 150 square feet each. Each room must be air-conditioned and equipped with a minimum of Wi-Fi service, laboratory sink, multiple ground electrical outlets, overhead lights, benches with drawers and access to or include a squid tank. Rooms must also have at least two tables that are at least 30 inches wide, run the length of the room with holes for computer cords for investigators to perform seated computer work. Computers are not required. •Adjacent to each laboratory room, the Contractor shall provide one (1) room that houses scientific equipment such as centrifuges, balances, fume hoods, freezers, cold rooms which shall be available for NIH use. Equipment and Associated Technical Support Requirements •Contractor shall provide 210 hours of access to a microscope facility with a Carl Zeiss Microscopy SEM Supra 40 VP Microscope which shall be available for NINDS investigator research use. 255 hours of preparative microscopy technique services for this equipment shall also be made available. Equipment must be available for NIH use twenty-four hours a day, seven days a week. Support service hours identified earlier in this bullet are to be provided during business hours. •Contractor shall provide technical support services for computing technology such as bringing new scientific equipment and software programs on-line, providing server and network support, and maintaining laboratory Wi-Fi connections all NINDS laboratory rooms and office spaces. The contractor shall not be responsible for providing the new scientific equipment or software programs, only for bringing them on-line. •Contractor shall provide for each laboratory room, at minimum, access to a seawater tank and running seawater, fume hood, cold room, radioactivity room to conduct experiments using approved low energy radioisotopes and a freezer. Access must be either located in or adjacent to each laboratory room. Materials Requirements •The Contractor shall provide materials to the Government in relation to this requirement as described in this Statement of Work. All materials provided to the Government must be approved by the Contracting Officer and authorized by the Contracting Officer's Representative in advance of purchase. Materials shall be provided as approved and authorized up to the following not-to-exceed dollar values. The Contractor shall not provide materials in excess of the not-to-exceed (NTE) dollar value allotted annually. Base Period Materials (NTE): $20,500.00 Option Period 1 Materials (NTE): $21,730.00 Option Period 2 Materials (NTE): $23,034.00 Option Period 3 Materials (NTE): $24,416.00 Option Period 4 Materials (NTE): $25,881.00 •The Contractor shall deliver live loligo pealeii squid to each laboratory's seawater tank twice a week from May 1st through September 30 each year. Deliveries shall be made on any days of the week excluding Sunday. A minimum of 5, maximum of 200 squid will be delivered per week to each seawater tank. •The Contractor shall provide the Government with glass/plastic ware, chemicals, and small instruments/equipment such as petri dishes, syringes, flasks, graduate cylinders, reagent bottles, chlorides and sulfates, forceps, scissors, paper, pens, pencils, rulers, envelopes, files folders, notebooks. •Contractor shall provide Government access to on-site ordering, shipping and delivery services for materials requirements identified in this Statement of Work. Government Responsibilities The Government, represented by Government scientists working at the Contractor site, will provide Contractor personnel with reasonable access to Government equipment located on the Contractor site as necessary for full performance of required Contractor efforts. Reporting Requirements The Contractor shall provide a monthly supply report that details all supplies provided by the Contractor to the Government in that month. This list shall be submitted via email in MS Excel format. The report shall include the following information: Item Name, Item Description, Manufacturer, Manufacturer Item No., Quantity, List Price, Discount Price, Ordered Price, Order Date, Received Date. A signed delivery receipt for each item ordered shall be submitted with the monthly supply report. Travel No travel is authorized or required for this need. Small Business Subcontracting Plan Requirements If the proposed contract exceeds a total estimated cost of $700,000 for the entire period of performance, including option periods, the offeror shall be required to submit an acceptable subcontracting plan in accordance with the terms of the clause entitled "Small Business Subcontracting Plan," FAR Clause No. 52.219-9, incorporated herein. Information Systems Security The Contractor shall not have access to NIH Information Systems, however the contractor will provide internet access through which the Government shall use its equipment and information systems. Accordingly, FAR Clause 52.204-21, Basic Safeguarding of Covered Contractor Information Systems (June 2016) applies to this acquisition. Please also see the attached Appendix A: Applicable Information Systems Security Clauses. Data Rights The NINDS shall have unlimited rights to and ownership of all deliverables provided under this procurement including reports, analyses, recommendations, briefings, work plans, created SOPs and all other deliverables. In addition, it includes any additional deliverables required by contract change. The definition of "unlimited rights" is contained in Federal Acquisition Regulation (FAR) 27.401, "Definitions." FAR clause 52.227-14, "Rights in Data-General," is hereby incorporated by reference and shall be made a part of any resulting contract/order. Period of Performance The period of performance for this requirement shall be May 1, 2017 through April 30, 2018 plus four (4) subsequent one-year option periods. Place of Performance The place of performance shall be the Contractor site located at Woods Hole, MA 02543. Contract Type One (1) Firm Fixed Price contract with Options to Extend the Term of the contract is anticipated. RESPONSE INSTRUCTIONS Responses to this solicitation must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. Offerors must provide both 1) a technical response and 2) a separate price quotation. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; and maintenance availability. PLEASE ENSURE THAT ALL EVALUATION CRITERIA ARE SPECIFICALLY ADDRESSED IN ANY RESPONSE(S) SUBMITTED. EVALUATION CRITERIA FAR clause 52.212-2, Evaluation - Commercial Items (October 2014) applies to this acquisition and the specific evaluation criteria to be included in paragraph (a) of that provision are as follows: The Government will award a contract resulting from this requirement on the basis of best value, technical factors and price considered. Technical factors together shall be considered more important than price and all technical evaluation factors are detailed in order of importance below. Factor 1: Technical Approach The Contractor shall detail in the technical proposal how it shall meet each of the project requirements. This shall include detailed specifications of the laboratory and office space to be provided, equipment availability, and technical support services to be provided. The technical approach shall also include plans for provision of materials, especially squid suitable for research purposes. The technical approach shall be evaluated for the ways in which the proposed equipment and supplies meet or exceed the equipment specification requirements. Exceeding requirements shall be considered favorable. Factor 2: Past Performance The Contractor shall provide a list of two contracts or purchase orders completed during the past five (5) years, similar in size and scope to the requirements outlined in the Statement of Work. Experience shall include the following information for each contract or purchase order listed: a)Name of Contracting Organization b)Total Contract Value c)Description of Requirement d)Contract Period of Performance e)Contracting Organization Point of Contact f)Contract Organization Telephone Number Past performance shall be evaluated for relevance to the current requirement and for customer satisfaction. EVALUATION METHOD Technical proposals will be evaluated using a summary adjectival rating in accordance with the following scale: Excellent The proposal has exceptional merit and reflects an excellent approach which will clearly result in the superior attainment of all requirements and objectives. This clearly achievable approach includes several advantageous characteristics of substance, and very few disadvantages, which can be expected to result in outstanding performance. The risk of unsuccessful performance is very low as the proposal provides solutions which are unquestionably feasible and practical. These solutions are further considered very low risk in that they are exceptionally clear and precise, fully supported, and demonstrate a clear understanding of the requirements. Risk Level: Very Low Good The proposal demonstrates a sound approach which is expected to meet all requirements and objectives. This sound approach includes advantageous characteristics of substance, and few relatively minor disadvantages, which collectively can be expected to result in satisfactory performance. The risk of unsuccessful performance is low as the proposal contains solutions which are considered feasible and practical. These solutions are further considered to reflect low risk in that they are clear and precise, supported, and demonstrate an understanding of the requirements. Risk Level: Low Acceptable The proposal demonstrates an approach which is capable of meeting all requirements and objectives. The approach includes both advantageous and disadvantageous characteristics of substance, where the advantages are not outweighed by the disadvantages. Collectively, the advantages and disadvantages are likely to result in acceptable performance. The risk of unsuccessful performance is moderate, as the proposal solutions are generally feasible and practical. These solutions may also be considered to reflect moderate risk in that they may be somewhat clear and precise, partially supported, and/or demonstrate a general understanding of the requirements. Risk Level: Neutral Marginal The proposal demonstrates an approach which may not be capable of meeting all requirements and objectives. The approach has disadvantages of substance and advantages, which if they exist, are outweighed by the disadvantages. Collectively, the advantages and disadvantages present a low or questionable likelihood of resulting in satisfactory performance. The risk of unsuccessful performance is high as the proposal contains solutions which may not be feasible and practical. These solutions may also be considered to reflect high risk in that they lack clarity and precision, are generally unsupported, and/or do not demonstrate a complete understanding of the requirements. Risk Level: High Unacceptable The proposal demonstrates an approach which, based on a very high risk, will very likely not be capable of meeting all requirements and objectives. This approach has several disadvantages of substance, and advantages which, if they exist, are outweighed by disadvantages. Collectively, the advantages and disadvantages are unlikely to result in satisfactory performance. The risk of unsuccessful performance is very high as the proposal contains solutions which are not feasible and practical. The solutions may also be considered to reflect very high risk in that they lack any clarity or precision.
