Description
Justification for an Exception to Fair Opportunity Control Number: JA17097 1.Contracting Activity: U.S. Army Medical Research Acquisition Activity (USAMRAA) 820 Chandler Street Fort Detrick, MD 21702 Contracting Officer: Christine Helman Contract Specialist: Barton Vint Requiring Activity: Defense Health Agency (DHA) Infrastructure and Operations Division (I&O) Document Identification: Justification for an Exception to Fair Opportunity (JEFO) 2.Nature or Description of the Action: Approval is being requested to authorize a bridge contract for W81XWH-08-D-0034-0014, which was the bridge contract for competitive Task Order W81XWH-08-D-0034-0009. Due to multiple GAO Protests (B-413665.1, B-413665.2 and B-413665.3) the competitive Task Order, W81XWH-08-D-0043-0006 is currently under a Stop Work Order. This new bridge contract will allow for GAO to resolve the protest and allow USAMRAA to adjust accordingly with GAO guidance. This 6-month (with a 2-month Base Period and four (4) 1-month Option Periods) bridge contract will be with Interactive Technology Solutions, LLC. (ITS) under their TRICARE, Evaluation, Analysis, and Management Support (TEAMS) IDIQ. Fiscal Year 2017 (1-year) Operations and Maintenance (O&M) funds will be utilized for this requirement. The new Period Of Performance (POP) is listed below: Period of PerformancePOP Start DatePOP End Date Base Extension Period (2-months)01 March 201730 April 2017 Option Period One (1-month)01 May 201731 May 2017 Option Period Two (1-month)01 June 201730 June 2017 Option Period Three (1-month)01 July 201731 July 2017 Option Period Four (1-month)01 August 201731 August 2017 3.Description of Supplies/Services: This action provides for Program Management and Technical Management (PMTM) support services and Information Technology (IT) technical expertise for I&O's evolving mission requirements and rapidly changing healthcare IT environment. The requirement provides program management and technical support, operational planning, engineering expertise and execution oversight to DHA I&O for the requirements that are within the responsibility of the I&O mission. The requirement also assists the Government in monitoring, engineering and validating designs, and operational activities performed by IT organizations supporting the I&O. This support to the evolving I&O mission includes the planning, designing, testing, troubleshooting, and assessment of communications and computing infrastructure (C&CI), and contract consultation work. The scope of this work may involve "end to end" performance analysis, including Local Area Networks (LANs), client workstations/End User Devices (EUDs), Wide Area Networks (WANs), servers and network protection/security devices. The current Task Order, W81XWH-08-D-0034-0014, will expire on 28 February 2017. The new period of performance will be 01 March 2017 through 31 August 2017. The total estimated cost for the six (6) month extension is $10,421,762.54 4.Authority Cited and Supporting Rationale: Pursuant to 10 U.S.C. 2304(C) as implemented by FAR 16.505(b)(2) and substantiated by the following: 0 16.505(b)(2)(i)(A): The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays. 1 16.505(b)(2)(i)(B): Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 0 16.505(b)(2)(i)(C): The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. 0 16.505(b) (2) (i)(D): It is necessary to place an order to satisfy a minimum guarantee. 0 16.505(b) (2)(i)(E): For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source. 0 16.505(b)(2)(i)(F): In accordance with section 1331 of Public Law 111-240 (15 U.S.C. 644(r)), contracting officers may, at their discretion, set aside orders for any of the small business concerns identified in 19.000(a)(3). When setting aside orders for small business concerns, the specific small business program eligibility requirements identified in part 19 apply. In accordance with FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the services required at the level or quality required due to GAO protest of the competitive follow-on Task Order W81XWH-08-D-0043-0006 with Technology, Automated, & Management, Inc. (TeAM). Bridge Task Order W81XWH-08-D-0034-0014 was put in place to provide the Government with critical continued services allowing time for USAMRAA to award the competitive Task Order W81XWH-08-D-0043-0006. On September 1, 2016 the Government Accountability Office (GAO) notified USAMRAA that a Protest (B-413665) was filed by ITS. A Stop Work Order was put in place on that contract IAW FAR 52.242-15, and Task Order W81XWH-08-D-0034-0014 was extended using the authority of FAR 52.217-8. USAMRAA took corrective action on the protest and on November 14, 2016, the Stop Work Order was lifted. Task Order W81XWH-08-D-0043-0006 resumed work, effective date November 15, 2016. On November 28, 2016 the Government Accountability Office (GAO) notified USAMRAA a second Protest (B-413665.2) was filed by ITS. A Stop Work Order was put in place on contract W81XWH-08-D-0043-0006, IAW FAR 52.242-15. On 23 December 2016, ITS filed a third GAO protest (B-413665.3), which did not affect the Stop Work Order or the 100 day time limit that GAO has to reach a decision. ITS currently possesses the operational infrastructure, knowledge, and experience required to perform the tasks under the performance work statement. Awarding to another contractor at this time would require additional training and lead time that would result in an interruption of necessary services. ITS has proven successful in providing the services required at the level of quality required. Engaging a new contractor is not authorized while under protest. Failure to award this extension by 01 March 2017 will result in degraded services that will impact the I&O's ability to provide efficient support to all of DHA including worldwide Medical Treatment Facilities (MTF)'s and critical support programs such as Pacific Northwest Consolidation and the Electronic Health Record. I&O's Program Management Office's (PMOs) would not be able to support the 25 program lines and products without the continued support of the services being requested under this bridge requirement. Any discontinuance of these services will lead to: 1) delays in schedule; 2) disruption to critical Information Technology Service Management (ITSM) framework, Information Technology Infrastructure Library (ITIL) framework, DOD Systems Engineering Lifecycle (SELC) systems; 3) delays in planning, designing, testing, troubleshooting, and assessment of Communications and Computing Infrastructure (C&CI), and; 4) the ability to comply with DHA leadership mandates. 5.A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The labor category and rates are from the TEAM Contract vehicle has been audited twice by Defense Contract Audit Agency (DCAA) and the labor rate ceiling prices have been found to be fair and reasonable. This award will be negotiated IAW FAR 15 to assure that the cost to the Government is both fair and reasonable. 6.Any other facts supporting the justification: The competitive follow-on for this critical requirement is currently under GAO protest. A break in service would cause far reaching effects to soldiers, veterans and their families on a global scale. The POP of this bridge contract will be a Base Period of 2-months with four 1-month Option Periods in order to allow for the GAO decision and either a Transition Out period, or an adequate time to take corrective action as suggested by GAO if needed. 7.A statement of the action, if any, the agency took to remove or overcome any barriers that lead to the restricted consideration before any subsequent acquisition for the supplies or services is made: The competitive follow-on contract was the action taken to assure that competition was not restricted; however that contract has been protested and resulted in mandatory Stop Work Orders.
