Description
ARC Hardware Maintenance 2 of 3 JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY 1. Contracting Activity: Department of Veterans Affairs (VA) Office of Acquisition Operations Technology Acquisition Center 23 Christopher Way Eatontown, New Jersey 07724 2. Description of Action: The proposed action is for a firm-fixed-price delivery order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Governmentwide Acquisition Contract (GWAC) for Hewlett Packard (HP) brand name maintenance support for existing HP infrastructure components (hardware, software, and firmware) located at the VA Allocation Resource Center (ARC) in Braintree, Massachusetts. 3. Description of the Supplies or Services: The proposed action is to procure HP brand name maintenance support for existing HP infrastructure components (hardware, software, and firmware) located at the VA Allocation Resource Center (ARC) in Braintree, Massachusetts. Maintenance support includes repair services, technical manuals, knowledge documents, and specialized software to provide initial troubleshooting assistance to determine if issues are firmware/driver-based, component-based (power supplies, controller cards, riser cards, etc.), or equipment-based. Further, support shall include technical support access 24 hours a day, 7 days a week, 365 days a year with a maximum four-hour response time and replacement of failed components or complete equipment replacement for equipment that is not modular. Maintenance support will also include HP education services to provide training on any new features that become available as a result of firmware and software upgrades. The period of performance for this action is 12 months. The total estimated price of the proposed action is $ 4. Statutory Authority: The statutory authority permitting an exception to fair opportunity is 41 U.S.C. 4106(c)(2) as implemented by Federal Acquisition Regulation (FAR) 16.505(b)(2)(i)(B) entitled, Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. 5. Rationale Supporting Use of Authority Cited Above: Only HP certified maintenance services provided by HP or its authorized maintenance resellers will fulfill the Government s requirements due to the proprietary nature of the hardware, software, and firmware that is specific to existing HP equipment systems at the VA ARC. A non-HP service provider would be unable to provide the appropriate firmware necessary for maintenance support. Additionally, replacement parts may be required to complete system repairs. HP brand name certified parts are required to ensure the required performance of the existing systems is maintained. HP replacement parts are required to ensure compatibility, consistency, reliability, quality control, and manageability of the entire VA ARC computing platform. HP or an authorized HP reseller must ensure that these replacement parts do not void the ability to obtain future support or require the system to be recertified by HP. Further, only HP or HP authorized resellers will be able to acquire and implement specific software upgrades, patches, bug fixes, and revision upgrades on existing hardware due to the proprietary nature of all HP components currently integrated in the exiting ARC infrastructure. Any attempt to use non-authorized service providers for the required maintenance support could result in the need to get the equipment re-certified by HP, should the Government require future maintenance and support services. Replacement of the existing HP components supporting the ARC infrastructure compared to renewal of maintenance support is cost prohibitive. 6. Efforts to Obtain Competition: Market research was conducted, details of which are in the market research section of this document. In accordance with FAR 5.301 and 16.505(b)(2)(ii)(D) the resulting contract award will be announced on the Federal Business Opportunities Page and this Justification for an Exception to Fair Opportunity will be made publicly available. In addition, this Justification for an Exception to Fair Opportunity will be posted on the NASA SEWP V website with the solicitation. 7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new products or maintenance services available that will enable future requirements to be competed. 8. Market Research: Market research was conducted by ARC technical experts in December 2016 by reviewing websites of vendors that provide similar maintenance services. International Business Machines, Dell, and Sun/Oracle were identified to have similar service offerings however, only HP or its authorized resellers could satisfy the Government s requirements due to the proprietary nature of the hardware, software, and firmware. Based on this market research the Government s technical experts have determined that only brand name HP maintenance support can meet all of the Government s requirements. Replacement of the HP hardware currently integrated in the ARC s computing platform infrastructure compared to renewal of hardware maintenance is cost prohibitive. Based on this market research the Government s technical experts have determined that only brand name HP maintenance support can meet all of the Government s requirements. Additional market research was conducted in February 2017 by the Contract Specialist by utilizing the Provider Lookup tool on the NASA SEWP V GWAC website which identified numerous resellers of the required HP hardware maintenance support including 25 prospective Service-Disabled Veteran-Owned Small Business (SDVOSB) GWAC holders. Therefore, competition is anticipated on NASA SEWP V among authorized resellers of the required brand name maintenance support. 9. Other Facts: None.
