- This is a Sources Sought Notice and is for informational purposes only. The purpose of this notice is to seek information on technically capable, and otherwise responsible, interested small businesses, including HUBZone, 8(a), Service Disabled Veteran Owned Small Businesses (SDVOSB), or Women Owned Small Business, (WOSB), as well as other than small business firms that would be interested in submitting offers for the anticipated solicitation for Construction Manager as Constructor (CMc) serviced as descried herein. It is the policy of the Government to maximize practicable opportunities in its acquisition for small business. For reference, general descriptions of each small business concern may be found in Federal Acquisition Regulation (FAR) 52.219-8, Utilization of Small Business Concerns. THIS IS NOT A REQUEST FOR PROPOSALS, QUOTATIONS, OR BIDS. Per FAR 15.201(e), responses to this notice are not offers and cannot be accepted by the Government to form a binding contract. Responses do not affect a potential offeror's ability to respond to any future synopsis/solicitation. The Government will not provide reimbursement for any information that may be submitted in response to this notice. Respondents are solely responsible for all expenses associated with responding to this notice. This notice is a market survey being conducted solely to determine whether there are adequate Small Business contractors for the following proposed procurement. The General Services Administration (GSA), Public Building Service (PBS), Region 3 (R3) Acquisition Division, 100 Penn Square East, Philadelphia, PA 19106, has identified a need for a CMc to perform both Design Phase Services and Construction Phase Work for a new United States District Court for the Middle District of Pennsylvania in Harrisburg, PA. The CMc contractor shall provide a new courthouse of approximately 243,000 gross square feet including 19,350 square feet of interior parking plus associated service and circulation spaces. The United States Bankruptcy, District, and Magistrate Courts, United States Court Clerks, United States Probation, United States Marshals Service, United States Attorneys, United States Trustees, Federal Public Defender and the General Services Administration will occupy the facility. The space will include five (5) District Courtrooms, two (2) Magistrate Courtrooms, one (1) Bankruptcy Courtroom and their associated supporting spaces, such as judge's chambers, jury deliberation facilities, jury assembly, grand jury suites, holding cells, etc. Office space will be provided for the other aforementioned tenants. The project will include approximately 42 interior secure parking spaces. It is anticipated that CMc will be issued early notice to proceed ("NTP") for site work prior to completion of design and prior to NTP for building work. In accordance with FAR 36.204, Disclosure of the magnitude of construction projects, the estimated price is more than $10,000,000. The NAICS code applicable to this proposed procurement is 236220 and the small business size standard is $36.5 million. All respondents must be certified to work within this NAICS code. The anticipated contract will be procured utilizing source selection procedures as described in FAR 15.3 to select the firms offering the best value to the Government in terms of price and technical merit and whose performance is expected to best meet stated Government requirements. Accordingly, award will be made using best-value, source-selection procedures incorporating tradeoffs between price-related and non-price related factors. Response Information: The following information is requested in your response: (1) Identification (including name, address, phone number and DUNS number) and verification of the company to be certified by the Small Business Administration as a small business, including verification as a HUBZone, 8(a) or Service Disabled Veteran Owned Small Business, if applicable. (2) Past Experience - provide a list of two (2) Required experience to be considered as a viable source of the contemplated acquisition includes experience in delivering services during both the design and construction phase for projects with a Guaranteed Maximum Price (GMP) contract awarded to your firm as the prime contractor utilizing the CMc delivery method. The work should include managing multiple subcontractors and dealing with sensitive customers and coordinating work involving numerous construction disciplines. Projects of such nature must be valued in the provided order of magnitude, which is over $10,000,000 and must have been completed within the last ten (10) years. Interested firms should submit a Letter of Interest with the above requested information to Ms. Nadya L. Popil, Contracting Officer. The Letter of Interest shall include your firm's experience with "open book accounting," as well as experience with new construction and managing multiple disciplines of subcontractors in the Harrisburg, Pennsylvania market and surrounding vicinity. The response should clearly document how the firm meets these requirements and must provide specific contract information to include, but is not limited to, a contract number, location, agency/owner, dollar value (inclusive of changes), contract type, project delivery method, a description of the work, including how it is similar to the contemplated procurement, and an owner point of contact to include an email address and telephone number. Responses to should be limited to include no more than five (5) completed contracts that meet the aforementioned criteria. (3) Describe your firm's ability to obtain a bid bond of up to 205 of the maximum order of magnitude and performance and payment bonding of 100% of the maximum order of magnitude. (4) Demonstrate your firm's ability to obtain a certification from a Certified Public Accountant (CPA) that your firm's accounting system provides for the following: The accounting system is in accordance with the Generally Accepted Accounting Principles (GAAP), there is proper segregation of direct and indirect costs, there is proper identification and accumulation of direct costs by contract, and there is a labor time distribution system that charges direct and indirect labor appropriately. Also indicate wither the including of the following FAR Cost Accounting Standards (CAS) would affect your firm's decision to submit a proposal for the contemplated acquisition: FAR 52.230-2, Cost Accounting Standards, FAR 52.230-3, Disclosure and Consistency of Cost Accounting Practices, and FAR 52.230-6, Administration of Cost Accounting Standards. (5) Overall, indicate whether your firm would submit a proposal in response to a Request for Proposal (RFP) consistent with these requirement that was set aside for small busies concerns as a general small business set-aside of as one tailored to your firm's particular small business concern type, or on an unrestricted basis (full and open competition).
