- SYNOPSES OF PROPOSED CONTRACT ACTION - Notice of Intent to Sole-Source procurement for Sonatype Nexus Software Licenses with Installation and Configuration, inclusive The US Army Corps of Engineering - Huntsville Center (USACE-HNC) is issuing this synopsis in order to publicize its intentions to execute one (1) sole-source, firm-fixed priced purchase order to Carahsoft Technologies for Sonatype Nexus Software in accordance with (IAW) FAR 5.203(a)(1) - "Publicizing and response time," which states, "A notice must be published at least 15 days before issuance of a solicitation, or a proposed contract action that the Government intends to solicit and negotiate with only one source under the authority of 6.302, except that, for acquisitions of commercial items, the contracting officer may establish a shorter period for issuance of the solicitation." The Office of Deputy Assistant Secretary of Defense (Systems Engineering) ((OASD(SE)) Joint Federated Assurance Center (JFAC) requires software tools to support systems security engineering processes in acquisition and engineering development of software generated or used in DoD systems, including weapons systems. These tools are needed to detect and help remediate vulnerabilities, weaknesses, and defects during the software development life cycle, in sustainment, and in operations. The Contractor shall provide the software titles listed in the attached Bill of Materials (BOM). The Justifications and Approval (J&A) for this effort is in the process of being routed for signature, which will authorize this requirement to be procured sole-source. Sonatype Nexus Software tools are the only solution that meets the requirements of the DoD in order to operate in a classified environment and provide the most assurance of security for affected software projects. A Request for Information (RFI) was published to FedBizOpps (FBO) on 19 January 2017 seeking sources to provide Sonatype Nexus, or an equivalent. Carahsoft Technologies provided the only response as the sole provider for Sonatype Nexus. No other known software publishers are capable of providing an equivalent product with essential features required for operation in a secure environment disassociated from the Internet, which could prevent them from being used on the Secure Internet Protocol Network (SIPR Net). While many Sonatype software products are available from other resellers, Carahsoft Technologies is the only company that can provide the Sonatype Secure Environment Software tools that allow OASD(SE) to operate its DoD systems on a secure network, IAW FAR 6.302-1 - "Only one responsible source and no other supplies or services will satisfy agency requirements." This notice of intent is not a REQUEST FOR PROPOSALS, nor does it restrict the Government as to the ultimate acquisition approach. Additionally, this announcement does not obligate the Government to award a contract. This notice of intent is not a request for competitive quotations; however, all responses received via email to Teresa Mueller at teresa.a.mueller@usace.army.mil within the closing date for this notice will be considered by the government. A determination by the government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The most applicable North American Industrial Classification System (NAICS) code is 511210, Software Publishers. The business size standard for this NAICS code is $385M.
