- The United States Environmental Protection Agency (EPA) intends to negotiate on a sole source basis, under the authority of FAR 13.106-1(b)(1), Soliciting from a Single Source, with PANalytical, Inc., for annual Maintenance and Emergency Repair Service of the PANalytical Axios Spectrometer - Serial Number DY1349. EPA has identified PANalytical as the only contractor able to meet the requirements of this procurement. The EPA's Office of Research and Development (ORD), National Risk Management Research Laboratory (NRMRL), 26 West Martin Luther King Drive, Cincinnati, OH 45268 utilizes the PANalytical Axios Spectrometer on a continuous basis for research projects. Fully functional instruments that operate accurately and without interruption of service are vital to NRMRL's mission. PANalytical is the sole manufacturer and distributor of these instrumentation as well as the parts and products to support the equipment. This company possesses the unique capabilities of providing preventative maintenance and repair services. PANalytical, as the manufacturer of the instrumentation, has the capability and accessibility to the engineering and electronic specifications to ensure accurate operation of the products. The contractor shall provide factory trained field engineers with documented expertise on the exact equipment configuration cited in the purchase order and shall supply installation CDs containing software updates as they occur. This procurement will be accomplished under FAR Part 12 Commercial Procedures. It is our intent to award a single fixed price purchase order consisting of one (1) 12-month base period and two (2) 12-month option periods for a potential term of 36 months. Interested firms may identify their interest and capability to respond to the requirement. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETATIVE QUOTATIONS. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Sources wishing to be considered MUST submit documentation to the office identified in this notice. Documentation must be submitted within 5 calendar days of the date of publication of this notice.
