- N00164-17-R-JN55 - SOLE SOURCE - SUB MACHINE GUNS, SUPPRESSORS AND RELATED ANCILLARY EQUIPMENT SMALL ARMS AMMUNITION - FSC 1005 - NAICS 332994 Anticipated Issue Date: 04 APR 2017 - Anticipated Closing Date: 21 APR 2017 - Time 2:00 PM EDST The Government intends to enter into a Firm-Fixed Price (FFP) contract with Heckler & Koch Defense Incorporated, 19980 Highland Vista Drive, Ashburn, VA 20147. This effort will be conducted on a sole-source basis in accordance with the statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. The basis for restricting competition is the lack of Intellectual Property, duplicate cost to the Government that is not expected to be recovered through competition, and the unacceptable delays in fulfilling the agency requirement through another source. This proposed procurement is for the 55 EA MP5SD7 Submachine guns; 55 EA MP5E2A3 Submachine guns; 55 EA MPSD Suppressors; 60 EA MP5/K Silencers and ancillary equipment. A commercial item solicitation will be issued for an anticipated Firm-Fixed Priced (FFP) contract. Delivery terms are 210 days after effective date of contract with F.O.B at destination. Inspection and acceptance are at destination. This will be a commercial acquisition in accordance with FAR Part 13. The proposed contract action is for supplies for which the Government intends to solicit and negotiate with only one responsible source under the statutory authority 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1. The basis for restricting competition is that the Government does not own the rights to the technical data package, duplicate cost to the Government that is not expected to be recovered through competition, and the unacceptable delays in fulfilling the agency requirement through another source. Since this is a sole source procurement, a solicitation will not be posted to the internet. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
