GS-09B-01366 VAN NUYS, CA 1. Identification and Description of Action Being Approved: This justification for other than full and open competition (FAR Subpart 6.3) is for use by General Services Administration (GSA) contracting activities in the acquisition of support and administrative workspace The current lease expires on April 30, 2017. leases 19,200 rentable square feet (rsf) of space Los Angeles CA. under lease number GS-09B-01366 The current lease is due to expire on April 30, 2017. Approval is requested to negotiate a twenty-four (24) month extension with the incumbent lessor for continued occupancy at this lease location without full and open competition., with estimated occupancy date of May 1, 2019. 3. Identification of Statutory Authority: 41 U.S.C § 3304 (a)(1) permits contracting without full and open competition. The property needed by the agency is available from only one responsible source and no other type of property will satisfy the needs of the agency. 4. Demonstration that the Acquisition Requires use of the Authority Cited: It is in the best interest of the Government and GSA's intent to meet the agency's needs where practical and most cost efficient. In this instance, it would be practical and cost efficient for the Government to negotiate a short-term extension at the existing location to protect the Government's occupancy while a new long-term lease is secured. GSA Public Buildings Service Page 2 of 4 GSAM 570.402-5 (b) allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition. If other space was leased through the competitive process, the agency would incur a double move, first to temporary lease space, then to their permanent space. A double move would create administrative hardship and interrupt the agency's operations. Furthermore, the Government would incur additional costs for duplicating the agency's tenant improvements. It would be economically unsound to incur these costs for such a short period of time. 6. Description of Efforts to Solicit as Many Offers as Practicable: GSAM 570.106 (d) indicates that the contracting officer need not publicize the proposed acquisition of a leasehold interest in real property, including expansion requests within the scope of the lease, lease extensions under the conditions defined in 570.405, and building alterations within the scope of a lease. Page 3 of 4 10. List of Sources that Expressed an Interest in the Acquisition: The current lessor has agreed to the extension and provided a quote for the extension term. 11. Statement of Actions to Overcome Barriers to Competition: Not Applicable. 12. Contracting Officer Certification By signature on this Justification for Other than Full and Open Competition, the Lease Contracting Officer certifies that the award of a lease extension of 19,200 rsf is in the Government's best interest and that this Justification is accurate and complete to the best of the Lease Contracting Officer's knowledge and belief.
