- PLEASE READ THIS ENTIRE NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED This is a combined synopsis and solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Request for Quotation (RFQ) number is N66604-17-Q-1471. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95. NUWC Division Newport intends to purchase the following items on a firm fixed price basis from Wind River Systems, Alameda, CA on a sole source basis: Wind River General Purpose Platform - VxWorks Edition 6.9, Time Based, Subscription Node Locked - Product Codes 535-185062 and 500-185061; four (4) each. Period of Performance is 8 July 2017 through 7 July 2018, F.O.B. Destination Naval Station Newport; Newport, RI. The basis for the sole source is that Wind River Systems is the only known source for these items. VxWorks is proprietary to Wind River and maintenance and licenses can only be obtained and renewed through them. VxWorks software is currently being used and it is necessary for 100% compatibility with the existing software system. The North American Industry Classification System (NAICS) Code for this acquisition is 511210. The Small Business Size Standard is $38.5M. FAR 52.212-1 Instructions to Offerors-Commercial Items applies. FAR 52.212-4-Contract Terms and Conditions-Commercial Items, 52.212-5-Contract Terms and Conditions Required to Implement Statues or Executive Orders-Commercial Items, and 52.209-11, Representation by Corporations Regarding Delinquent Tax also apply to this solicitation. The following addenda or additional terms and conditions apply: Defense Priorities and Allocations System (DPAS) rating of DO-C9. This solicitation requires registration with the System for Award Management (SAM) prior to award, pursuant to applicable regulations and guidelines. Registration information can be found at www.sam.gov. This notice of intent is not a request for competitive proposals. All responsible sources may submit a capability statement which will be considered by the Government. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct competitive procurement.
