This announcement constitutes the only solicitation for proposals and a written solicitation will not be issued. General Information: The contractor shall provide a non-personal services contract to provide Solid Waste Disposal, and related waste stream management for Fort Buchanan U.S. Army Reserve Installation in Puerto Rico. Fort Buchanan is a U.S. Army Reserve installation in Puerto Rico located in the Municipalities of Guaynabo and Bayamon, within the San Juan metropolitan area. It serves under direct control of the Installation Management Command, Atlantic Region. Its mission is to synchronize, integrate, and deliver installation services and facilities in support of Senior Commanders in order to enable a ready and resilient Army. Scope of Requirement: The Performance Work Statement (PWS) provided represents a "master" PWS, to include all work to be performed under this requirement once it is awarded. For evaluation purposes, Contractor must include an amount for ALL Contract Line Item Numbers (CLINs) - See Bid Schedule. 2. The period of performance is: Two Month Phase-In: 1 May 2017 to 30 June 2017 Base Year: 1 July 2017 to 30 April 2018 Option Year 1: 1 May 2018 to 30 April 2019 Option Year 2: 1 May 2019 to 30 April 2020 Option Year 3: 1 May 2020 to 30 April 2021 3. Background: The offer shall contain the Contractor's best terms from a price and technical standpoint. The Government reserves the right to make clarifications or request a revised response if later determined by the Contracting Officer to be necessary. The Government may reject any response if such action is in the public interest and/or waive informalities and minor irregularities in the submitted offer. The Government reserves the right to cancel this Solicitation and make no award. The submission of the documentation specified will constitute the Contractor's acceptance of the terms and conditions of the RFP and contract type. By responding to this Solicitation and submitting a proposal in response to this Solicitation, the Contractor understands that the Government shall not be liable for any costs incurred by the Contractor in response to this Solicitation. 4. General Instructions: (a) To ensure timely and equitable evaluation of the proposal, the Contractor must follow the instructions contained herein. The offer will be evaluated using the criteria under ADDENDUM TO FAR 52.212-2 Evaluation - Commercial Items (Jan 1999). Noncompliance with the Solicitation requirements may hamper the Government's ability to properly evaluate the proposal and may result in elimination of the proposal from further consideration for contract award. The Contractor is required to meet all Solicitation requirements including terms and conditions. Failure to meet a requirement may result in the offer being ineligible for award. The Contractor must clearly identify any exception to the Solicitation terms and conditions and provide complete accompanying rationale. The Contractor is required to submit a proposal with, as a minimum, the items specified below. A proposal without the specified minimum content will be unacceptable. Pricing data will not be included in the Technical and Management Section of the proposal. The proposal shall contain the following sections, in an electronic copy as separate attachments: Volume I - Solicitation & Bid Schedule. This section shall contain Unit and Extended Prices. All pricing information shall be addressed ONLY in this section. Volume II - Technical and Management. This section shall contain staffing (prime and sub-Contractors), proposed policies and procedures, personnel qualifications/certifications/licenses as required for labor categories, quality control plan, hazmat disposal plan and safety plan. Volume III - Past Performance. Past Performance will be evaluated based on information obtained using internal systems. Contractor is not required to submit Past Performance information. The Government will use information obtained using other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems. (b) Each section of the Contractor proposal shall be provided in the number of original and sanitized copies as shown below. Sanitized copies shall exclude any information that would identify them or their company (i.e. name, address, telephone numbers, employees' names, photos, etc.). The sanitized pages shall contain the Contractor's Commercial and Government Entity (CAGE) Code on the top right corner of each page of the sanitized technical proposal. All pages of each proposal shall be appropriately numbered, and be identified with the RFP number (W9124J-17-R-FBPR-2). A table of contents identifying the major areas by title as well as page number shall be provided with the proposal. (c) The Contractor shall submit all sections separately. The Contractor's proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of state claims in accordance with this Solicitation. The proposal shall not simply rephrase or restate the Government's requirements, but rather shall provide convincing rational to address how the Contractor intends to meet the Government's requirements. No material may be incorporated by reference. (d) Failure to furnish a complete proposal, at the time of proposal submission, may result in the proposal being rejected from consideration for award. The Government will not accept any changes to the Contractor's proposal after the closing date and time. (e) It is the Government's intention to award without discussions. Contractor is encouraged to present its best technical proposal and prices in its initial proposal submission. However, in accordance with (IAW) FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold discussions. (f) The proposal submission shall be formatted to print on either letter (8.5" by 11") or legal (8.5" by 14") sized paper only and text using 11 pitch, Times New Roman Font. Elaborate formats, bindings or color presentations are not desired or required. Contractor shall provide its response with a cover sheet that contains the company's name, address and telephone number. The offer shall be valid for a period of 90 days and shall include the original date of submittal. The Contractor shall provide the email response to the Contract Specialist, Israel Gutierrez, at israel.gutierrez1.civ@mail.mil and the Contracting Officer, Maria Cachola, at maria.d.cachola.civ@mil.com, and is encouraged to follow-up for receipt with the Contract Specialist. 5. Proposal Format. (a) All pages of each offer must be appropriately numbered and identified with Solicitation Number: W9124J-17-R-FBPR-2 in the header and/or footer of each page. If RFP page limits are exceeded, the pages in excess of the limit will be removed and not evaluated. (b) All sections, shall be submitted in Microsoft Word 2013 or Microsoft Excel 2013 or earlier format, and should not be read only or password protected in the number of copies listed above. Contractors shall perform a virus check prior to proposal submittal. (c) Contractor's must identify the RFP number in the Subject Line of the email and should include "# of #" if multiple emails are required for submission of entire proposal. Contractors are advised to submit electronic documents early and confirm successful transmission/receipt. Contractors also may want to consider sending more than one email to ensure size limitations will not hinder transmission. The Government POC will provide a return response signifying receipt of the transmissions. (d) Section copy requirement are as set forth below: Volume I - Solicitation & Bid Schedule. Number of copies: one original; page limit: no limit. Volume II - Technical & Management. Number of copies: one original and one sanitized; page limit: 50. Volume III - Past Performance. Contractor is not required to submit Past Performance information. (e) Page Limit Includes: All Appendices, Charts, Graphs, Diagrams, Tables, Photographs, Drawings, etc. (f) Page Limit Does Not Include: Title Page, Table of Contents, Lists of tables and drawings and/or Cross Reference Matrix's, Glossary of Terms/Abbreviations and Acronyms, Indices, section dividers and/or job qualifications. Cross-references should be utilized to preclude unnecessary duplication of data between sections. (g) Electronic Copies: The Government will not perform a word-by-word check of the electronic volumes. However, if discrepancies are identified in the electronic attachments, the Government may or may not seek clarification. Sound or video (e.g. MPEG) files should not be embedded into the proposal files. Electronic file names shall not include periods except right before the extension of the program name. For example, "file.xls" is acceptable, but "fi.le.xls" is not acceptable. Additionally, file names may not include slashes or special characters. For example, "file/1!@#.xls" is not acceptable. (h) Glossary of Abbreviations and Acronyms. Each volume will contain a glossary of all abbreviations and acronyms used, with an explanation for each. Volume I - Solicitation & Bid Schedule: a. Failure to follow the below contract proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government. The Contractor shall provide pricing in the Bid Schedule (actual CLIN numbers may change at the time of award) and TE-7. The Contractor shall include all information and supporting documentation relating to the price, in Volume I. The Contractor must ensure that no pricing information is displayed in the Technical Section; however, this restriction does not preclude the Contractor from describing staffing levels relevant to the Contractor's proposal. The Contractor shall submit an offer, rounded to the nearest dollar, on all CLINs, including option year CLINs. The total proposed amount of each offer will be the sum of the Contractor's proposed prices for all CLINs for the base year and the option years. Furthermore, when filling out the bid schedule, under the CLIN labeled Special Events, please provide individual prices for each of the special events listed in the description; then the cumulative price should be listed in the columns to the right. CLINS 0004, 0005, 1003, 1004, 2003, 2004, 3003, and 3004 will not be evaluated. These CLINs are added to cover unscheduled events in accordance with PWS paragraph 5.3.3. For these CLINS, please fill out Technical Exhibit 7. These will be the pre-established prices for these services. No service will be provided under these CLINs unless notified in writing by the Contracting Officer. b. Volume I will be organized as follows and contain the identified information: i. TAB A: Executive Summary - Provide an executive summary describing the significant attributes of the proposal and introducing the Contractor's team. ii. TAB B: Contact Information - The Contractor should include a contact list (with phone numbers, fax numbers, mailing addresses, e-mail addresses, etc.) of all key personnel to include personnel authorized to negotiate on the company's behalf. iii. TAB C: Representation, Certifications, and Other Statements of Contractor - IAW with provisions FAR 52.212-3 Alt I and DFARS 252.212-7000, Contractor Representations and Certifications -- Commercial Items, the Contractor will ensure that Representation, Certifications, and Other Statements are submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely. If Contractor has completed Representations, Certifications, and Other Statements of CONTRACTOR via the System for Award Management (SAM) (www.sam.gov.), please indicate date registered and date of expiration. iv. TAB D: Responsibility Statement - In accordance with FAR 9.104-1. The following shall be submitted and will be used in the Government's determination of responsibility for the Contractor: An overview of their company's history, organization, and general experience, to include the company's tax identification number. A narrative must also demonstrate the Contractor has financial health and has adequate financial resources. c. Complete all blanks for unit and total prices in the Bid Schedule. A detailed breakdown by CLIN is required, showing labor category/title, to include skill level, assigned to each CLIN. The breakdown of equipment shall also be by appropriate CLIN. That breakdown shall also include vehicle operation, expendables and other direct costs. Daily rates may be used during periods when incremental funding is anticipated. d. Contract Pricing (Itemized Breakdown): All information relating to the proposed price will be included in the electronic form. Electronic versions of the Price proposal will be submitted in MS Office Excel format (2013 or earlier) ONLY. The one exception is for strictly narrative cost/price language, such as in the Price Narrative Section, which may be submitted in Word or PDF format. All formulas, lookup tables, and links should be intact, and no links Specialist should exist to files not included with the submission. Spreadsheets will not contain hidden worksheets. Failure to comply with these formatting requirements may result in rejection of your proposal. Offerors are encouraged to submit a very detailed price narrative to explain how the pricing was established to facilitate price evaluations. i. LABOR RATES (Prime and Sub-Contractor): The proposal shall show base labor rates associated with each labor category. Base rates are the hourly rates the employees will actually be paid for performance under the contract. Explain the basis for the proposed labor rates. Some common basis for proposed rates is the actual rate the employee is currently being paid, Bureau of Labor Statistics, Pay scale, etc. The method used to escalate rates for additional periods will need to be explained, to include the basis for the escalation factors used and the date that pay increases are effective. If your company has a current Forward Pricing Rate Agreement (FPRA), provide a copy with your proposal. ii. INDIRECT RATES (Prime and Sub-Contractor): Common indirect rates are Labor Overhead, Fringe Benefits, General and Administrative (G&A), etc. In the proposal, show each individual rate and describe the allocation base. The allocation base is the cost category the rate is multiplied by to calculate the indirect dollars. An example is a labor overhead rate applied to direct labor dollars; the latter being the allocation base. If your company does not have a current FPRA, then provide the base and pool information for each indirect rate, including the base and pool information for each indirect fate for the past couple of years. iii. PROFIT/FEE: Must be separately identified. e. As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the Contractor's final option period price to the Contractor's total price. Contractors are required only to price the base and option periods. Contractors shall not submit a price for the potential six month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance period. Volume II - Technical and Management: Contractor's proposal must acknowledge that contractor is ready to start the phase-in period beginning 1 May 2017, with full performance on this requirement to start on 1 July 2017. Information the Contractor deems appropriate should be included in the proposal. Proposal paragraphs shall correspond to the pertinent PWS paragraph (where referenced). To facilitate evaluation, the information contained in this section shall be specific, detailed, and clearly demonstrate that the Contractor has a thorough understanding of the requirement for the accomplishment of this effort; it includes but is not limited to staffing (prime and sub-Contractors), proposed policies and procedures, personnel qualifications/certifications/licenses, quality control plan, hazmat disposal plan and safety plan. i. Sub-Factor 1 - Service Approach: This sub-factor will evaluate the Offeror's approach and ability to perform the required work successfully with Government personnel. Documented evidence of the Contractor's ability to provide personnel who meet all qualifications requirements. Provide your plan to acquire and retain qualified personnel throughout the life of the contract. Discuss how proposed personnel meet all minimum qualification requirements specified in the RFP for the duties/positions they are proposed to perform. Contractor shall identify Key Personnel (per PWS a total of three (03) Key Personnel will need to be in place) by name and provide an accompanying resume for each. Proposed staffing in the Technical volume must be consistent with the staffing addressed in the Price volume. • Confirmation of capability to meet the customer's historical collection requirements per PWS. • Offeror must validate they have access to a Puerto Rican approved landfill site. • Provide evidence of all required Federal, State, and Local licenses and certificates. ii. Sub-Factor 2 - Staffing Plan/Qualifications of Key Personnel. This sub-factor will evaluate the proposed staffing approach and key personnel qualifications that support successful performance. • The Offeror shall provide a Syllabus narrative outlining the staffing approach which will be evaluated to ensure it supports successful performance. • The Offeror must provide a proposed Staffing Plan (e.g. personnel experience or qualifications and their personnel availability) to include resumes and certifications for all key personnel. iii. Sub-Factor 3 - Quality Control Approach: To be acceptable, the Offeror's quality control approach shall address each of the following elements: • How the Offeror will monitor the performance of the contract tasks; • Offeror's internal quality inspection process of deliverables prior to submission to COR to ensure correctness and timeliness; • How the Offeror will correct any deficiencies identified by internal reviews by the COR. iv. Shall, at a minimum, be prepared in a form consistent with the PWS and the evaluation criteria for award set forth in this Solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the Contractor's technical competence and ability to comply with the contract task requirements specified in the PWS. The Contractor shall address as specifically as possible the actual methodology you would use for accomplishing the PWS tasks. The section shall be organized according to the following general outline: TAB A: Table of Contents TAB B: Glossary of Abbreviations and Acronyms TAB C: List of Table and Drawings and/or Cross Reference Matrix (if applicable) TAB D: Technical Capability Volume III - Past Performance: Past Performance will be evaluated based on information obtained using internal systems. Contractor is not required to submit Past Performance information. The Government will use information obtained using other sources, such as the Past Performance Information Retrieval System (PPIRS) or similar systems. Additional Information: a. The Contractor shall apply all appropriate markings to the proposal including those prescribed in FAR 3.104-4, Disclosure, Protection, and Marking of Contractor Bid or Proposal Information and Source Selection Information. b. In accordance with FAR 19.702, a subcontracting plan is required from all other than small business concerns submitting a proposal. This only applies to other than small business. (END OF ADDENDUM TO FAR 52.212-1 - PROPOSAL SUBMISSION INSTRUCTIONS)   ADDENDUM TO FAR 52.212-2 Evaluation - Commercial Items (Jan 1999) 1. BASIS FOR AWARD a. The Government intends to award a single contract to the Contractor whose proposal, conforming to the PWS will provide the best value to the Government utilizing a Lowest Price Technically Acceptable approach. Proposals are evaluated to determine whether they meet the acceptability levels for the Technical evaluation factor and sub factors. Tradeoffs are not permitted and additional credit is not given for exceeding minimum acceptability. b. The contracting officer, in accordance with DFARS 215.203-70 will utilize the tiered evaluation of Offerors, and therefore will; (1) Solicit and receive offers from both small and other than small business concerns in order to maximize participation by both small and other than small business and provide notice to all available concerns; (2) Establish at the solicitation level a tiered or cascading order of precedence for evaluating Offerors whereas only those Offerors who are small business concerns will be considered in the first tier of evaluations; (3) if no award can be made to any small business concern at the first tier, then and only then will the contracting officer evaluate other than small business Offerors at the next level tier. c. The Government intends to evaluate proposals and award a contract without discussions with Contractors. Therefore, the Contractor's initial proposal should contain its best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions and request final revised proposals if determined by the Contacting Officer to be necessary. The Government may reject any or all proposals if such action is in the best interest of the Government. d. For a proposal to be determined "Technically Acceptable" and receive consideration for award, the proposal must receive a rating of "Acceptable" for all technical sub factors. A consensus or overall rating of either "Acceptable" or "Unacceptable" determines whether the proposal may be considered for award. Acceptable: Proposal provides sufficient details that the Government can determine that the proposal satisfactorily meets the specified minimum performance or capability requirements of the PWS and Solicitation through adequately addressing all the requirements. Proposal clearly shows that the Contractor fully understands and can perform the requirements as delineated in its proposal for the proposed price indicated in its proposal. There is a satisfactory probability of meeting requirements with little or no technical risk. Unacceptable: Proposal does not meet the specified minimum performance or capability requirements necessary for acceptable contract performance. Proposal has been presented with major omissions or misunderstandings or has inadequate detail to assure the evaluator of an understanding of the proposal. Proposal clearly shows that the Contractor does not fully understand and cannot perform the requirements as delineated in its proposal for the total proposed price indicated in its proposal. There is little or no probability of meeting the requirements with a high technical risk. The proposal cannot meet the requirements without major revisions. 2. EVALUATION CRITERIA. Evaluation criteria consist of three (3) evaluation factors and elements. Additionally, Contractor's proposal must acknowledge that contractor is ready to start the phase-in period beginning 1 May 2017, with full performance on this requirement to start on 1 July 2017. The proposals will be evaluated under the following evaluation factors: Factor 1: Technical Capability Sub-Factor 1 - Service Approach Sub-Factor 2 - Staffing Plan/Qualifications of Key Personnel Sub-Factor 3 - Quality Control Approach Factor 2: Price Factor 3: Past Performance Factor 1 - Technical Capability Evaluation The evaluation process will consider the following in determining offers Technically Acceptable or Unacceptable. Evaluation of options shall not obligate the Government to exercise the option(s). CLINS 0004, 0005, 1003, 1004, 2003, 2004, 3003, and 3004 will not be evaluated. Past Performance will be rated either acceptable or unacceptable, with no past performance equaling acceptable. 3. EVALUATION FACTORS Factor 1 - Technical Capability The Technical Capability evaluation provides an assessment of the Contractor's capability to satisfy the Government's requirements. Factor 2 - Price The Price Submission will not be scored or rated. The techniques and procedures described under FAR Part 15.404-1(b) will be the primary means of assessing Price analysis for commercial items to determine price reasonableness. To be viable for award, a Contractor's price must be determined fair and reasonable. The Contractor's total proposed price will be utilized to evaluate if the proposal represents a fair and reasonable price. The total evaluated price includes the price of the base period, all option periods (to include the option to extend services in accordance with FAR 52.217-8). CLINS 0004, 0005, 1003, 1004, 2003, 2004, 3003, and 3004 will not be evaluated. These CLINs are added to cover unscheduled events in accordance with PWS paragraph 5.3.3. For these CLINS, please fill out Technical Exhibit 7. These will be the pre-established prices for these services. No service will be provided under these CLINs unless notified in writing by the Contracting Officer. (a) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the Contractor's final option period prices to the Contractor's total price. Thus, the Contractor's total price for the purpose of evaluation will include the phase in and base period, 1st option, 2nd option, 3rd option, and 1/2 of the 3rd option. Contractors are not required to enter a price for the six-month extension of services option period. (b) Unbalanced Pricing: Unbalanced pricing will be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk which could result in unreasonably high prices. Definitions. Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business. Completeness/Accuracy. The Contractor's proposal is in compliance with the Price Volume instructions in the Solicitation. Factor 3 - Past Performance. Past Performance will be evaluated based on information obtained using internal systems.
