- This solicitation is being issued using Simplified Acquisition Procedures in accordance with the policies contained in Part 13.5, Simplified Procedures for Certain Commercial Items. This is a combined synopsis/solicitation for commercial items and services is prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. The solicitation number is VA119-17-Q-0095 and is issued as a Request for Quote (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-95 (Effective 13 JAN 2017). THIS NOTICE IS NOT SET ASIDE FOR A SMALL BUISNESS. The associated North American Industrial Classification System (NAICS) code for this procurement is 339113 with a small business size standard of 750 employees. This award is for a Firm Fixed-Price (FFP) Purchase Order (PO). Each Contract Line Item Number (CLIN) will be priced. The list of contract line item number(s) (CLINs) and items, quantities and units of measure can be found in ATTACHMENT 1 - PRICE COST SCHEDULE. Summary description of requirements for the items to be acquired: The Louis Stokes Cleveland VA Medical Center (VAMC) is in the process of standardizing its current platform of operating room (OR) lights and booms in the facility. The facility currently has a total of 10 operating room suites and 2 additional ORs are being constructed. Three operating suites have already been upgraded with replacement OR lights and booms. This requirement will continue the expansion and continuity throughout the remaining operating room suites. As a result of this acquisition an additional 7 existing operating rooms and 2 hybrid operating rooms under construction will be outfitted. See ATTACHMENT 2- PRODUCT DESCRIPTION for details regarding this requirement. Date(s) and place of delivery and acceptance FOB point: The first two ORs shall be delivered within 60 days after the approved drawings. Delivery of the OR lights and booms shall occur in a phased approach to ensure the facility is provided with adequate to complete all site preparations and make adjustments if needed to each OR based on lessons learned during the delivery and installation. Considering the construction schedule of the 2 hybrid operating rooms this equipment shall be delivered and installed last. The schedule is subject to change based on construction requirements at the facility. Delivery of the OR Lights and Booms shall be to: Louis Stokes, Cleveland VAMC Warehouse, 10701 East Boulevard, Cleveland, Ohio 44106. Acceptance shall be by written approval and acceptance by the Contracting Officer s Representative (COR). See Section 3, EXTENT OF OBLIGATION, ATTACHMENT 2- PRODUCT DESCRIPTION for details regarding Delivery/Performance Time. FOB Point: Destination. The provision at 52.212-1, Instructions to Offerors Commercial Items, is replaced in its entirety by the addendum and the addendum to the provision is attached. See ATTACHMENT 3- 52.212-1 ADDENDA - INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS. The Contracting Officer (CO) will determine best value and the basis on which award will be made is lowest price and past performance having been found technically acceptable. Past Performance will be evaluated as Pass/Fail. The lowest priced quote will be evaluated to ensure that it meets the Salient Characteristics - ATTACHMENT 2- PRODUCT DESCRIPTION for details regarding this requirement. See ATTACHMENT 3 52.212-1 ADDENDA INSTRUCTIONS TO OFFERORS COMMERCIAL ITEMS for details regarding the requirements for Submission of quotes. All respondents are advised that, in the interest of efficiency, the Government reserves the right to conduct the evaluation in the most effective manner. Specifically, the Government may first evaluate the total quoted price of all respondents. Thereafter, the Government will evaluate the quote of the lowest priced respondent only. If the lowest priced respondent s quote is determined to conform to the requirements, the Government may make award to that respondent without further evaluation of the remaining quotes. If the lowest priced respondent s quote does not conform to the requirements, then the Government may evaluate the next lowest priced quote, and so forth and so on, until the Government reaches the lowest priced offer that is determined to conform to the requirements. Quotes shall include a completed copy of the provision at ATTACHMENT 4 - 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS -- COMMERCIAL ITEMS. Only complete paragraph (b) of this provision if the respondent has completed the annual representations and certificates electronically via http://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision. See ATTACHMENT 4 - 52.212-3, OFFEROR REPRESENTATIONS AND CERTIFICATIONS -- COMMERCIAL ITEMS. The clause at 52.212-4, Contract Terms and Conditions -- Commercial Items, applies to this acquisition. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition. The following additional Provisions and Clauses are applicable: FAR 52.233-2 SERVICE OF PROTEST (SEP 2006) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from: U.S. Department of Veterans Affairs Strategic Acquisition Center 10300 Spotsylvania Ave Fredericksburg VA 22408 (b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO. There shall be two quote submissions: 1) Product Samples (Concept Design and Surgical Head Light Presentation); and 2) Technical Description, Past Performance, and Price. Interested contractors must provide both submissions in order to be considered for award. The Concept Design and Surgical Head Light Presentation must be provided onsite at the Louis Stokes Cleveland VAMC April 7, 2017, at: 10701 East Boulevard, Cleveland, Ohio 44106. Technical Description, Past Performance, and Price quotes are required to be submitted no later than April 12, 2017, at 1:00 PM EDT. No late quotes will be accepted. Responses should be emailed to melissa.lera@va.gov. Quotes must be valid for at least 120 days. The date the quote expires should be indicated in the quote. The Technical Description, Past Performance, and Price quotes shall consist of four volumes. The Volumes are I Technical (product literature and samples), II Past Performance, and III Price, and IV - SF1449 or letterhead stationery. The use of hyperlinks in quotes is prohibited. A copy of all questions and their respective answers will be made available to all potential respondents. An amendment to the solicitation will be issued if changes are needed as a result of the questions. If a potential respondent believes that the requirements in these instructions contain an error or omission, the potential respondent shall immediately notify the contracting specialist in writing with supporting rationale. Each RFI will receive a confirmation email; if confirmation is not received within 24 hours of sending the RFI please call 202-277-9536. The Government reserves the right to amend the RFQ prior to the closing time for receipt of quotations by issuance of formal amendment(s) (Standard FORM 30) to this RFQ. If such amendment requires material changes, the closing date may be postponed. In such cases, the amendment will include an announcement of new quotation closing date and time.
