This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. The contractor shall provide all resources necessary to accomplish the deliverables as described. Part 1. GENERAL INFORMATION 1.1. Scope of Work: A subscription web-based portal is needed to access credit and criminal background reports to determine if a particular person is qualified as a fiduciary for a VA beneficiary. The contractor shall provide all resources necessary to accomplish the deliverable described in the statement of work (SOW), except as otherwise specified. The purpose of the SOW is to acquire a subscription to a web-based browser to obtain address verification, criminal history, credit inquiries, consumer identifying information, demographics, fraud summary, credit score summary, profile summary, public records and trades. In addition, the contractor shall provide batch alerts on adverse changes noted on a fiduciary s credit and or criminal background. Batch alerts shall continuously check for updates on the list of people or companies submitted and alert to new or changed records associated with those topics. Batch alerts shall be incorporated within the web-based portal for monthly review. The contractor shall provide utilization to both credit and criminal background checks electronically as well as in paper format. The contractor shall allow access to credit and criminal information at VACO Central Office located at 1800 G Street NW, Washington, DC 2006 as well as the fiduciary hub locations listed below: Indianapolis, Indiana Fiduciary Hub Milwaukee, Wisconsin Fiduciary Hub Lincoln, Nebraska Fiduciary Hub Columbia, South Carolina Fiduciary Hub Salt Lake City, Utah Fiduciary Hub Louisville, Kentucky Fiduciary Hub The web-based application shall be accessible by authorized VA employees 24/7 as dictated by regular working schedules, workload, and overtime availability. All credit and criminal background checks are conducted via an internet portal and require no additional software added to the system. 1.2. Background: VA has a statutory requirement to qualify and oversee the fiduciaries it appoints. Fiduciary hubs need access to credit and criminal background reports to determine if a particular person is qualified to be a fiduciary for a VA beneficiary. 38 U.S.C 5507 enacted on December 10, 2004, provides authority for the VA to obtain credit reports from perspective fiduciaries. VA conducts oversight to ensure the well-being of beneficiaries and the appropriate use of VA benefits by fiduciaries. Oversight includes visits with the beneficiary and fiduciary, audits of a fiduciary s annual accounting supporting financial documentation, onsite reviews, verification of surety bonds, investigation of misuse allegations, and proper qualification of each VA-appointed fiduciary. The intent of the fiduciary program is to protect VA-derived income and funds under management of beneficiaries. One component Pension and Fiduciary (P&F) Service uses to accomplish this goal is a credible system which eliminates the appointment of unqualified fiduciaries based on comprehensive criminal and credit background checks. 1.3. Type of Contract: Firm-Fixed-Price Part 2. CONTRACT AWARD MEETING 2.1 The contractor shall not commence performance on the tasks in this SOW until the CO has conducted a kick off meeting or has advised the contractor that a kick off meeting waived. Part 3. GENERAL REQUIREMENTS 3.1. All written deliverables will be phrased in layperson language. Statistical and other technical terminology will not be used without providing a glossary of terms. 3.2. All deliverables are reviewed by the VBA within ten (10) work days from date of receipt. 3.3. The contractor shall provide, via email, minutes of all government/contractor meetings within three (3) calendar days after completing the meeting. Part 4. SPECIFIC MANDATORY TASKS AND ASSOCIATED DELIVERABLES 4.1 Description of Task and Associated Deliverables: The contractor shall provide the specific deliverables described below within the performance period stated. Task 1: Web-Based Portal Subscription Service Through a subscription service, the contractor shall provide access for no more than 300 VBA employees to a secure web-based database containing the following information listed below. This information shall be searchable by name, SSN, and date of birth. Access to the web-based database shall be available 24 hours a day, seven days a week, excluding routine scheduled back-ups and upgrades, which shall require advanced notification to the VBA. This information shall be available to all users and provide access to printable reports for all users. Through a web-based portal, the contractor shall provide access to a secure web-based database to include: Current Addresses Social Security Numbers Dates of Birth Email Addresses Telephone Numbers Criminal Background History Criminal and court records Criminal offense description-case disposition Infractions UCC filings Law enforcement records Credit summary, including the following account information: Revolving (payments, balances, additional information), Installments (payments, balances, additional information). Real estate (payments, balances, additional information). Credit summary for bankruptcies, defaults, judgments, and past due information. Credit history, derogatory summary and credit score. Scoring mechanism to assign risk if appointed to manage financial assets Quantifiable scale of the level of risk to manage financial assets based on the elements identified below: Low-risk and identifying factors that contributed to risk Medium-risk and identifying factors that contributed to risk High- risk and identifying factors that contributed to risk Monitored Inappropriate use of web-based portal by internal employees Deliverable 1: VBA employee access to a secure web-based database for 300 users and reporting capabilities. Task 2: Training and Instruction Materials The contractor shall provide initial training, new employee training and annual training to all VBA employees upon the request of VBA. Also, training shall be provided to all users prior to any updates and or changes made to the web-based portal if necessary. The contractor shall provide training in person, virtually or any other methods that prove as an advantage to users. The contractor shall provide detailed narrative instructions and reference materials, to include computer screen captures, web links, computer system/application navigation and job aides. The contractor should also provide recorded training that can be posted on the web-based platform or VBA s Knowledge Management (KM) system for users. The contractor shall prepare and assist in the distribution of communications to all affected employees, supervisors, and union representatives to explain the purpose of the web-based portal. The contractor will develop briefings and presentations with VBA for delivery to field personnel to support the web-based portal. Specific responsibilities of the contractors include: Development and distribution of any materials and agendas to be used in meetings. Preparation, scheduling, and coordination of meetings. Facilitation of meetings. Preparation and publication of all meeting minutes. Deliverable 2a: Provide training with electronic/ hardcopy instruction materials and quick reference guide, whichever is appropriate. Deliverable 2b: Communications including handouts and presentations to be distributed to affected employees, supervisors, and union representatives. Task 3: Web-based Portal Support and Performance The contractor shall provide telephone and/or email service to users to assist with the use of the web-based platform, password resets, and technical issues. The contractor shall designate a point of contact which includes the name, email address, and phone number to the COR and any other personal in VBA the COR deems necessary. The Contractor shall provide monthly Project Status Reports (PSR) to include status updates on deliverables and issues that arise during the performance period. These are due to the COR no later than the fifth (5th) workday of each calendar month throughout the project or upon request by the COR. The report shall detail work accomplishments, problems encountered with the web-based portal and corrective actions taken. This report will also identify any problems that have arisen but have not been completely resolved with an explanation. Deliverable 3a: Provide user service support via telephone and email. Deliverable 3b: Monthly Project Status Reports throughout the performance period. Task 4: Reporting Capability The contractor shall provide reporting capability through a web-based portal for VBA. The contractor will ensure VBA Administrators have access to reports containing information entered by users. The contractor shall have capability or an ad-hoc report for VBA to track the number and name of searched persons by users. In addition, the contractor shall email VBA administrators a monthly report of each fiduciary hub s search reports listed by users and a list of any inappropriate use of the web-based portal by internal employees. The contractor shall email monthly user reports to VBA administrators no later than the fifth (5th) workday of every month. The contractor will schedule an initial meeting with VBA for a demonstration and discussion of monthly reports. Based on these discussions, the contractor may be required to make revisions prior to acceptance. Deliverable 4a: Web-based Reports. Deliverable 4b: Monthly fiduciary hub user reports Task 5: Batch Reporting The contractor shall provide ongoing monitoring by the web-based portal to alert VBA administration of adverse changes noted on a fiduciary s credit and or criminal background. Batch alerts shall work as an ongoing monitoring of an individual as opposed to a one-time search. Batch alerts shall continuously check for updates on the list of people or companies submitted and alert to new or changed records associated with those topics. Batch alerts shall be presented monthly in an output file or via email to a document viewer within the web-based portal no later than the fifth (5th) workday of every month. Alertable content includes: Address change Phone number change Lawsuits Bankruptcies Sanctions Arrest records Real estate transactions Death records Divorce records Carry concealed weapons licenses Liens and Judgments Real property pre-foreclosure records Deliverable 5: Monthly Batch Reporting Part 5. SCHEDULE FOR DELIVERABLES 5.1. All Contractor-provided work products are to be furnished within the specified delivery dates. 5.2. Any changes to delivery dates must be discussed with the Contracting Officer Representative (COR) and requested in writing to the CO. 5.3. If for any reason the scheduled time for a deliverable cannot be met, the contractor is required to explain why (include the original deliverable due date) in writing to the CO, including a firm commitment of when the work shall be completed. This notice to the CO shall cite the reasons for the delays, and the impact on the overall project. The CO will then review the facts and issue a response in accordance with applicable regulations. Part 6. PERSONNEL AND GENERAL REQUIREMENTS 6.1. Contractor staff shall be fully qualified and have the level of experience necessary to accomplish the requirements of this SOW. In addition, Contractor personnel shall be acceptable to the Government in terms of personal and professional conduct, and in technical knowledge. Furthermore, Contractor personnel are expected to be proficient using office automation equipment and software and have sufficient written and verbal communication skills to support VA. The work accomplished in this Contract shall not use offshore labor unless specifically agreed to by the contracting office. Should any Contractor personnel be determined to be unacceptable in terms of technical competency or unacceptable personal conduct while working on contract activities, the Contractor shall immediately remove and replace the unacceptable personnel at no additional cost to the Government. Contractor personnel are to serve in a support role; final decisions regarding VA business will always be made by Government personnel. 6.2. The Contractor shall be responsible for managing and overseeing the activities of all Contractor personnel, as well as subcontractor efforts used in performance of this effort. Contractor management responsibilities shall include all activities necessary to ensure the accomplishment of timely and effective support, performed in accordance with the requirements contained in the PWS. Part 7. CONFIDENTIALITY AND NONDISCLOSURE 7.1 It is agreed that: a. The preliminary and final deliverables and all associated working papers, application source code, and other material deemed relevant by the VA which has been generated by the contractor in the performance of this task order are the exclusive property of the U.S. Government and shall be submitted to the COR at the conclusion of the task order. b. The CO will be the sole authorized official to release verbally or in writing, any data, the draft deliverables, the final deliverables, or any other written or printed materials pertaining to this task order. No information shall be released by the contractor. Any request for information relating to this task order presented to the contractor shall be submitted to the CO for response. c. Press releases, marketing material or any other printed or electronic documentation related to this project, shall not be publicized without the written approval of the CO. Performance Period: The period of performance is May 1, 2017, to April 30, 2018 (base year) with four one-year options. Place of Performance: Primary place of performance will be at the contractor s facility. FAR 52.212-1, Instructions to Offerors Commercial Items (Oct 2016), applies to this solicitation. Offers shall be submitted electronically to Heather.Hampton@va.gov. The email subject line must contain the following: Quote in Response to VA101V-17-Q-0150, Web Portal Access. Offers shall be based on the requirements of the solicitation, and must contain the following: Company name, address, DUNS Number, tax identification number (TIN), and point of contact with phone number, and e-mail address. A completed price schedule in the format as provided in v ; a written statement limited to five (5) pages or less as to how the offeror intends to comply with the technical specifications and deliverables as required in the statement of work; and a detailed Project Management Plan (as detailed in section ix ). For SDVOSBS/VOSBs: In order to receive evaluation credit under 852.215-70, an Offeror shall submit a statement of compliance that it qualifies as a SDVOSB or VOSB in accordance with VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors. Offerors are cautioned that they must be registered and verified in Vendor Information Pages (VIP) database (http://www.VetBiz.gov). Solicitation Questions: Questions of a technical nature shall be submitted to the Contracting Officer in writing via e-mail. Oral questions of a technical nature are not acceptable due to the possibility of misunderstanding or misinterpretation. The cut-off date and time for receipt of questions is April 10, 2017. Questions received after this date and time may not be answered. Questions will be answered in a formal amendment to the solicitation so all interested parties can see the answers. Amendments: Amendments to this solicitation will be posted at http://www.fedbizopps.gov(FBO). Paper copies of the amendments will NOT be individually mailed. By registering to receive notifications on FBO, offerors will be notified by email of any new amendments that have been issued. No other notification of amendments will be provided. Potential Offerors are advised that they are responsible for obtaining and acknowledging any amendments to the solicitation. Failure to acknowledge an amendment may result in your offer being considered unacceptable. FAR 52.212-2, Evaluation Commercial Items, is applicable to this solicitation. (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other non-price factors considered. The following factors shall be used to evaluate quotes: Price (Complete the following) : Price schedule as provided in the solicitation, section v., with quote/offerors proposed contract line item prices inserted in appropriate spaces. NOTE - Veterans Preference Factor (per 852.215-70) - The Government will assign evaluation credit for an Offeror (prime contractor) which is a Service-Disabled Veteran-Owned (SDVOSB) or a Veteran-Owned Small Business (VOSB). Non-SDVOSB/VOSB Offerors proposing to use SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation Factor. For SDVOSBS/VOSBs: In order to receive credit under this Factor, an Offeror shall submit a statement of compliance that it qualifies as a SDVOSB or VOSB in accordance with VAAR 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors. Offerors are cautioned that they must be registered and verified in Vendor Information Pages (VIP) database (http://www.VetBiz.gov). Verified SDVOSBs will receive a 10% price credit (e.g. if a SDVOSB submits an offer of $100.00, it will be evaluated as if it submitted an offer of $90.00). Verified VOSBs will received a 5% price credit (e.g. if a VOSB submits an offer of $100.00, it will be evaluated as if it submitted an offer of $95.00). For Non-SDVOSBs/VOSBs: To receive some consideration under this Factor, an Offeror must state in its proposal the names of SDVOSB(s) and/or VOSB(s) with whom it intends to subcontract, and provide a brief description and the approximate dollar values of the proposed subcontracts. Additionally, proposed SDVOSB/VOSB Subcontractors must be registered and verified in VIP database (http://www.VetBiz.gov) in order to receive some consideration under the Veteran s Involvement Factor. If a vendor submits a subcontracting plan where it will be using a SDVOSB, it will receive a 3.5% price credit (e.g. if this vendor submits an offer of $100.00, it will be evaluated as if it submitted an offer of $95.00). If a vendor submits a subcontracting plan where it will be using a VOSB, it will receive a 2.5% price credit (e.g. if this vendor submits an offer of $100.00, it will be evaluated as if it submitted an offer of $97.50). Past Performance: Provide at least three (3) references (but no more than 5 references) of work similar in size and scope performed in the past three (3) years with current contact information to include an active contact s name, e-mail, phone number, address, and organization to include a brief description of the work completed, and a contract # (if applicable).   References will be checked to ensure your company is capable of performing in accordance with the Statement of Work. The Government reserves the right to obtain past performance data from other sources than those identified by the Offeror in evaluating past performance. This includes, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and other designated Technical Representatives. Offerors are reminded that both independent data and data provided by Offerors in their quotes may be used by the Government to evaluate past performance. The Contracting Officer may also evaluate past performance based on direct knowledge of the Contractor s performance on current or recent contracts. Technical: Provide a written statement limited to five (5) pages as to how your company intends to comply with the technical specifications, tasks, and deliverables as required in the statement of work. Provide a detailed Project Management Plan, which presents the contractor s plan for completing the contract. The contractor s plan shall be responsive to this SOW and describe the approach used for each required aspects of the contract. The Project Management Plan must also include information pertaining to the security of the web-based portal site, and the routine monitoring of the site for corruption. Award and Selection: Following receipt of quotes, the government will perform an evaluation using a comparative analysis of the products/services quoted, in an impartial manner. The government intends to compare what has been quoted to one another to select the product/service that is best suited to fulfill the requirement. The evaluation factors outlined in this request for quote will determine suitability. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other non-price factors considered. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options (to include Optional TASKS) to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). The Government anticipates that the optional task will be exercised at the time of award. (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The offeror has completed the annual representations and certifications electronically via the SAM website access through http://www.acquisition.gov. Accordingly, any contract resulting from this solicitation will include these clauses. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) to assist in assessing contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b).
