- INTRODUCTION PURSUANT TO FAR Subpart 5.2-Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF A PROPOSED CONTRACT TO ACTION. THIS IS A PRE-SOLICITATION NON-COMPETITIVE NOTICE OF INTENT TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Station Support Contracts and Simplified Acquisitions Branch (SS/SA) on behalf of the National Institute on Drug Abuse, Intramural Research Program (NIDA-IRP) intends to negotiate and award a contract for a sole source maintenance and repair service agreement for a FEI Technai12BT Electron Transmission Microscope without providing for full or open competition. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $20.5 million. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses of the Federal Acquisition Regulation (FAR) in effect through the Federal Acquisition Circular (FAC) 2005-95. STATUTORY AUTHORITY This acquisition is conducted as non-competitive under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302-1 - only one responsible source and no other supplies or services will satisfy agency requirements. DESCRIPTION OF REQUIREMENT Project Description The National Institute on Drug Abuse (NIDA) Electron Microscopy (EM) Core serves NIDA Intramural Research Program (IRP) researchers by providing access to existing and emerging techniques for neuronal ultrastructural analysis. The NIDA EM Core offers the following services: (1) EM services that are tailored to the needs of individual IRP researchers. Services include sectioning, immunostaining and counterstaining, and EM imaging; and (2) training and access to an ultrathin microtome and a transmission electron microscope, and data interpretation. Purpose and Objectives For the success of the Electron Microscopy Core, the Tecnai12BT Transmission Electron Microscope must be serviced throughout the year. As such, the purpose of this requirement is to provide the NIDA-IRP with a preventative maintenance and service agreement for the Technai12BT Transmission Electron Microscope. Project Requirements All maintenance services shall be provided by an authorized service provider and reseller of genuine FEI Company (OEM) brand parts. A qualified engineer shall service the FEI Technai12BT Electron Transmission Microscope including: •instrument software revisions •preventative maintenance inspections, incl. one (1) planned PM / year. •technical telephone consulting available during normal business hours •unlimited on-site service visits when requested •48-Hour targeted response time Period of Performance: April 14, 2017 - April 13, 2018 CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION As the original equipment manufacturer (OEM) of the existing FEI Technai12BT Electron Transmission Microscope at the Electron Microscopy Core, FEI Company is the sole manufacturer of the genuine parts needed to maintain the equipment. FEI Company is the only authorized service provider that can provide the proprietary diagnostic software and other tools needed to properly maintain this specialized medical equipment. As well, FEI Company is the only source that can provide FEI software updates and upgrades for this equipment. In accordance with FAR part 10, extensive market research was conducted to reach this determination. Specifically, a sources sought notice was posted to FedBizOpps referencing the above detailed requirements and no responses were received from authorized service providers of the FEI Technai12BT Electron Transmission Microscope. Additionally, contacts with knowledgeable individuals both in industry and Government, as well as reviews of available product literature, revealed no other sources. Finally, a review of the GSA Advantage, Dynamic Small Business Search, and previous government acquisitions returned no results that meet all of the requirements. Therefore, only FEI Compnay is capable of meeting the needs of this requirement. The intended source is: FEI Company 5350 NE Dawson Creek Dr. Hillsboro, OR 97124 CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice must include sufficient information to establish the interested parties' bona-fide capabilities of providing the product or service. The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision. Such factors may include: past performance; special features required for effective program performance; trade-in considerations; probable life of the item selected as compared with that of a comparable item; warranty considerations; maintenance availability; and environmental and energy efficiency considerations. In addition the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov." A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by April 7, 2017, 12:00 p.m. Eastern Time and must reference number HHS-NIH-NIDA-SSSA-NOI-2017-280.
