Task/Delivery Order Number: N/A RFQ # DJO-OJJDP-17-Q-0062 LIMITED-SOURCES JUSTIFICATION FOR FEDERAL SUPPLY SCHEDULE PROGRAM Upon the basis of the following justification, I, Joy Garrett-Bey, as Contracting Officer, hereby approve the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3 pursuant to the authority of 41 U.S.C. 251 as implemented by FAR 8.405-6(a)(1)(i)(A). This acquisition is conducted under the authority of the Multiple- Award Schedule Program (FAR 8.401). 1. Identification of the agency and the contracting activity. Department of Justice, Office of Justice Programs, Office of Juvenile Justice and Delinquency Prevention (OJJDP), located at 810 7th St., NW, Washington, DC 20531. Contracting Activity: U.S. Department of Justice (DOJ), Office of Administration (OA), Acquisition Management Division (AMD), 810 7th Street NW Washington DC 20531. 2. Nature and/or description of the action being approved. A bridge contract for a period of six-months with the option of up to additional three-months (total of nine-months) to extend the period of performance from March 30, 2017 through December 29, 2017. This action is awarded to ICF International for the continued operation of the Office of Juvenile Justice and Delinquency Prevention's (OJJDP) National Training and Technical Assistance Center (NTTAC). The continued operation of NTTAC is critical to supporting the mission of OJJDP in the provision of training. The bridge contract will support only the essential functions of NTTAC while OJJDP works with Office of the Chief Information Officer (OCIO) to develop an in-house TTA request case management database and transfer the content from the NTTAC website and TTA resource archive to the new OJJDP website. The Office of Justice Program (OJP) will issue a new competitive procurement during the third quarter of FY 2017 to fulfill OJJDP's requirements to support the operation of NTTAC. 3. A complete description of the supplies and/or services required to meet the agency's needs. OJJDP is a component of OJP within the U.S. Department of Justice. Established in 1974 through the passage of the Juvenile Justice and Delinquency Prevention Act (JJDPA) and charged by Congress to support states, local communities, tribal jurisdictions, public and private agencies in their efforts to develop and implement effective programs for youth at risk of delinquency and victimization. Under the leadership of its Administrator and through its components, OJJDP sponsors programs, research, and training and technical assistance initiatives; develops priorities and goals and sets policies to guide federal juvenile justice issues; disseminates information about juvenile justice issues; and awards funds to support state, local, and tribal juvenile justice programming. The period of performance for this six (6) month bridge period with a three month option period will be March 30, 2017 through December 29, 2017. The estimated value of the six (6) month bridge period with a three month option period will be $_______________. 4. An identification of the LSJ rationale, and if applicable, a demonstration of the contractor's unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(i)(A) - applies to this limited source justification. Pursuant to the authority cited in FAR 8.405-6(a)(1)(i)(A), an urgent and compelling need exists, and following the procedures would result in unacceptable delays. The original Task Order was placed in accordance with the applicable FSS ordering procedures, and was competitively awarded. Under the task order, ICF International will maintain OJJDP's NTTAC to support the Office's efforts to coordinate and leverage the delivery and provision of training and technical assistance (TTA) to OJJDP constituents. NTTAC is a central source for the public to access OJJDP-funded TTA. NTTAC operates a website; maintains an archive of OJJDP TTA resources (the OJJDP Online University); and administers a TTA request and tracking case management database (TTA360) used by OJJDP's 60+ TTA providers. The OCIO has strongly recommended that for future contracts all Office of Justice Programs (OJP) funded technology products (i.e. websites, databases, etc.) be developed and operated within the OJP/OCIO platform and/or be created and maintained by OCIO. OJJDP and OCIO have consulted and agree that the best course of action is to transfer the NTTAC website and resource archive (Online University) to OJJDP/OCIO to be incorporated into the OJJDP website. However upon reviewing the TTA360 system and software, OCIO has determined the TTA360 case management database uses software that OCIO is unable to support in the long term. Consequently, OCIO recommends the database be developed in-house by OCIO vendors. This bridge contract will ensure continuity of operations for NTTAC so that there is sufficient time to bring NTTAC's Information Technology (IT) products into OJP/OCIO's internal platform and build an internal TTA case management request and tracking database. Benefits realized by the government will include improved security, cost savings, and service delivery. The continuity of this requirement is urgent because of ICF's experience and expertise operating the NTTAC-particularly their ongoing maintenance and administration of the TTA360 case management database. Awarding to an entity other than the incumbent will result in a loss of services during a transition period on mission critical work under OJJDP's current NTTAC and would duplicate work and substantially increase costs to the Government that would not be recovered through competition. Approval of this LSJ and continuance of the NTTAC operations is vital; any delay or interruption will directly impair the NTTAC services to juveniles across the nation who are currently receiving support, mentorship and direction. 5. A determination by the ordering activity Contracting Officer that the order represents the best value consistent with FAR 8.404(d). The General Services Administration (GSA) and the CO has determined the price to be fair and reasonable at the time of contract award. GSA has already determined the rates for services offered on the schedule priced either at hourly rates, or at a fixed price for performance of a specific task to be fair and reasonable. 6. A description of the market research conducted among schedule holders, and the results of the research, or a statement why market research was not conducted. A statement must be made that the supplies and services are available from the FSS. Market research was completed at the pre-award level for the initial award. Additional market research was not conducted for the Bridge agreement because identifying and pursuing new sources would not have been the most cost effective approach at this time. 7. Any other facts supporting the limited source justification. ICF International is currently providing support under GSA Task Order #2011TO11123 and is performing successfully. The bridge contract is required to ensure the short-term (six-months with the option of up to three additional months) operation of OJJDP's NTTAC. Procuring another contractor through a competitive process would not be possible in the time allowed, as time for a transition of services would need to occur for what is a mission-critical component of the OJJDP NTTAC. As noted previously, this bridge contract will allow for continuity of NTTAC operations while ensuring that there is sufficient time to bring NTTAC's Information Technology (IT) products into OJP/OCIO's internal platform and build an internal TTA case management request and tracking database. Benefits realized by the government will include improved security, cost savings, and service delivery. The operation of the NTTAC is an integral part of OJJDP's mission to support and connect OJJDP TTA providers with those OJJDP grantees and other practitioners in the field seeking assistance, creating communities of practice focused on sharing juvenile justice knowledge; as well as enhancing OJJDP's efforts to lead and facilitate national juvenile justice reform efforts. 8. A statement of the actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made. It is anticipated that OJP will issue a new competitive procurement during the third quarter of FY 2017 to fulfill OJJDP's requirements to support the operation of the National Technical Training Center (NTTAC). 9. The ordering activity Contracting Officer's certification that the justification is accurate and complete to the best of the Contracting Officer's knowledge and belief and evidence that the supporting data that form a basis for the justification have been certified as complete and accurate by technical/program personnel. Both the technical and requirements personnel are required to certify each justification as to its accuracy and completeness. By signing the justification the Contracting Officer certifies that the facts and statements made are accurate and complete.
