(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number is VA241-17-Q-0212 and the solicitation is issued as a request for quotation (RFQ). (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-95. (iv) This requirement is being issued as a Service Disabled Veteran Owned Small Business set-aside. The associated NAICS code is 561710 Exterminating and Pest Control Services and small business size standard is $11 million. (v) The Government intends to award a firm-fixed price contract for a Contractor to provide Pest Control Services at the VAMC Boston, West Roxbury, Jamaica Plain and Brockton Campuses. Note: Quotes received after the due date and time shall not be considered. (2) Vendors may submit their quotes electronically via email to tammy.davis6@va.gov. (3) Questions shall be submitted to the Contract Specialist in writing via e-mail. Oral questions are not acceptable due to the possibility of misunderstanding or misinterpretation. The cut-off date and time for receipt of questions is 04/13/2017 at 12:00 PM EST. Questions received after this date and time may not be answered. Questions will be answered in a formal amendment to the solicitation so all interested parties can see the answers. (4) Site Visit - A site Visit is scheduled for the following: 04/07/2017 at 1000 a.m. at the Brocton Campus, Meet Bldg. 25, Rm 115;   04/10/2017 at 1000 a.m. at the Jamaica Plain Campus, meet at the Main Building 5th Floor, EMS Suite; 04/11/2017 at 1000 a.m. at the West Roxbury Campus, meet at G-C102 EMS Area. Any potential changes to the performance work statement or questions, noted during the site visit must be submitted in writing by the question due date. The Contracting Officer is the only person that is authorized to change the requirement via an amendment to the RFQ. Evaluation Process: Award will be made to the best value, as determined to be the most beneficial to the Government. Please read each section below carefully for the submittals and information required as part of the evaluation. Failure to provide the requested information below shall be considered non-compliant and your quote could be removed from the evaluation process. Offeror quotes shall be evaluated under FAR Part 13.106-2(b) -- Evaluation of Quotations or Offers. Therefore, the Government is not obligated to determine a competitive range, conduct discussions with all contractors, solicit final revised quotes, and use other techniques associated with FAR Part 15. The contracting techniques associated with FAR Part 15 are not mandatory. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:   1. Price (Follow these instructions): Offeror will complete the Price Schedule, with offerors proposed contract line item prices inserted in appropriate spaces.   2. Technical: The offeror s quote shall be evaluated to determine if the organization has the experience and capabilities to provide the requested services in a timely efficient manner.   Contractor shall demonstrate their corporate experience and approach to meet all requirements stated in the Performance Work Statement. If you are planning to sub-contract some or all of this work, please provide the name and address(s) of all subcontractor(s) (if applicable) and a description of their planned subcontracting effort. Provide applicable state required licenses, certificates, and training of personnel who will be performing on site services. 3. Past Performance: Provide (2) references of work, similar in scope and size with the requirement detailed in the Performance Work Statement. References must include contact information, a brief description of the work completed and contract number (if relevant).   Please utilize Attachment 2 Past Performance Worksheet for your references and please submit as part of your quote submission. References may be checked by the Contracting Officer to ensure your company is capable of performing the Performance Work Statement.   The Government also reserves the right to obtain information for use in the evaluation of past performance from any and all sources including PPIRS. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) 52.212-3 Offeror Representations and Certifications-Commercial Items (JAN 2017). Ensure your representations and certifications are complete in the System for Award Management (SAM)( https://www.sam.gov). Otherwise, you will need to fill out solicitation Clause 52.212-3 "Offeror Representation and Certifications -Commercial Items", and submit with the quote. Federal Acquisition Regulations require that federal contractors register in the SAM database at http://www.sam.gov and enter all mandatory information into the system. Award cannot be made until the contractor has registered. Offerors are encouraged to ensure that they are registered in SAM prior to submitting their quotation. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 10 days of contract expiration. (End of Clause) 52.217-9 -- Option to Extend the Term of the Contract (Mar 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 Years and 6 Months. (End of Clause) 52.252-2 Clauses Incorporated by Reference (FEB 1998) This contract incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Also, the full text of a clause may be accessed electronically at this/these address(es): http://www.acquisition.gov/far/index.html (FAR) and http://www.va.gov/oal/library/vaar/index.asp (VAAR) 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (DEC 2009) (a) Definition. For the Department of Veterans Affairs, Service-disabled veteran-owned small business concern : (1) Means a small business concern: (i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans (or eligible surviving spouses); (ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran; (iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document; and (iv) The business has been verified for ownership and control and is so listed in the Vendor Information Pages database, (http://www.VetBiz.gov). (2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16). (b) General. (1) Offers are solicited only from service-disabled veteran-owned small business concerns. Offers received from concerns that are not service-disabled veteran-owned small business concerns shall not be considered. (2) Any award resulting from this solicitation shall be made to a service-disabled veteran-owned small business concern. (c) Agreement. A service-disabled veteranowned small business concern agrees that in the performance of the contract, in the case of a contract for: (1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other eligible service-disabled veteran-owned small business concerns; (2) Supplies (other than acquisition from a nonmanufacturer of the supplies), at least 50 percent of the cost of manufacturing, excluding the cost of materials, will be performed by the concern or other eligible service-disabled veteran-owned small business concerns; (3) General construction, at least 15 percent of the cost of the contract performance incurred for personnel will be spent on the concern s employees or the employees of other eligible service-disabled veteran-owned small business concerns; or (4) Construction by special trade contractors, at least 25 percent of the cost of the contract performance incurred for personnel will be spent on the concern s employees or the employees of other eligible service-disabled veteran-owned small business concerns. (4) The joint venture meets the requirements of 13 CFR 125.15(b). (e) Any service-disabled veteran-owned small business concern (non-manufacturer) must meet the requirements in 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program. (End of Clause) LIMITATIONS ON SUBCONTRACTING-- MONITORING AND COMPLIANCE (JUN 2011) This solicitation includes VAAR 852.219-10. Accordingly, any contract resulting from this solicitation will include this clause. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement. 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012) (a) Definitions. As used in this clause- (1) Contract financing payment has the meaning given in FAR 32.001. (2) Designated agency office has the meaning given in 5 CFR 1315.2(m). (3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests. (4) Invoice payment has the meaning given in FAR 32.001. (5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract. (b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required. (c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following: (1) VA s Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.) (2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats. (d) Invoice requirements. Invoices shall comply with FAR 32.905. (e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for: (1) Awards made to foreign vendors for work performed outside the United States; (2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information; (3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies; (4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or (5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above. (End of clause) 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984) The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/ she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of [ ]. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from. PERFORMANCE WORK STATEMENT Pest Control Services, Boston VAMC 1. GENERAL: This is a non-personnel services contract to provide Pest Control Services to the Boston Veterans Affairs Medical Center Campuses. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. 1.1 Description of Services/Introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform onsite pest control services at the Brockton, West Roxbury and Jamaica Plain Campuses. The contractor shall perform to the standards in this contract. 1.2. Place of Performance: The work to be performed under this contract will be performed at the following locations (see attached Campus Maps). VA Medical Center Approximately 1, 200,000  SF     Jamaica Plain Campus 150 S. Huntington Ave Boston, MA 02130 VA Medical Center Approximately 545, 320 SF 1400 VFW Parkway West Roxbury, MA 02132 VA Medical Center Approximately 1.4 million sq. feet 940 Belmont St. Brockton, MA 02301 On an as needed basis- (Emergency Service Calls) VAOPC 251 Causeway St Boston, MA 02114 VAOPC 130 Marshall RD Lowell, MA 01852 VA Halfway House Woodside Ave Jamaica Plain, MA 02130 1.3 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government. 2. Specific Tasks: 2.1 SERVICE/MAINTENANCE/INSPECTION. The Contractor shall perform pest control maintenance and inspection to ensure the following tasks are accomplished. Based on historical data, it is estimated that the contractor will provide services for approximately 3 hours per day per campus. 2.1.1 Inspections of areas to determine which pest management measures are appropriate and required. 2.1.2 Provide recommendation of environmental sanitation practices that restrict or eliminate food, water or harborage for pests. 2.1.3 Selection and utilization of non-chemical control methods that will eliminate exclude or repel pests (including, but not limited to insect electrocution devices, traps, caulking, air screens). 2.1.4 Selection and use of the most environmentally sound pesticide(s) to affect control when chemical control methods are necessary. 2.1.5 Control (eliminate or prevent the flourishing or spread) of general arthropod pests (including, but not limited to cockroaches, ants, carpet beetles, spiders, carpenter ants, carpenter bees, centipedes, millipedes). 2.1.6 Control of flying insect pests (including, but not limited to house flies, stable flies, blow flies). 2.1.7 Control of predatory pests/disease vectors (including, but not limited to lice, bedbugs, fleas, mites, ticks, bees, wasps, mosquitoes). 2.1.8 Control of stored product pests (including, but not limited to saw tooth grain beetles, red/confused flour beetles, trogoderma beetles, grain moths). 2.1.9 Control of mice and rats (including, but not limited to house mice, field mice, roof rats, Norway rats). 2.1.10 Control of other vertebrate pests (including, but not limited to, subterranean termites, dry wood termites, fungi, and wood boring beetles). Treatment may be required as a separate service in a contract negotiated by the medical facility at the time of need. 2.1.11 Removal of squirrels, raccoons, opossums, skunks, rabbits, bats, gophers, moles, birds such as pigeons and starlings, retiles such as snakes and similar unwanted pests as needed. 2.2 SPECIAL PESTICIDE APPLICATION PROVISIONS: The following provisions shall be adhered to by the Contractor in performing pesticide applications of the areas specified below: 2.2.1 Food Handling Areas: Treatment is limited to times when food is not being held, processed, prepared, or served; and while not occupied by facility employees. The Contractor (in the possession of pesticides or application equipment) shall at no time enter facility elevators which are occupied by food service equipment. 2.2.2 Patient Occupied Areas: The Contractor shall utilize order free pesticides that does not expose patients or staff above permissible exposure levels (PEL) and use a low volatility as possible, in accordance with the established guidelines. 2.2.3 Critical Areas: The Contractor shall submit a list of pesticides for intended use in areas listed below for approval by the COR, prior to any application. When space treatment is required in these areas, the Ultra Low Volume (ULV) method of pesticide application shall be utilized with approved equipment capable of delivering a particle size range of 0.5 to 15 microns. The planned use of pesticides in these areas requires recognition of the attendant hazards to occupants, supplies, equipment and surfaces. No substitution shall be made at any time without approval in advance from the COR. Pharmacy Research Facilities Operating Room Intensive Care Units Respiratory Care Areas SPD 2.3. STORAGE OF PEST CONTROL MATERIALS: No pest control materials or equipment shall be stored or kept at the Medical Center when the contractor is not working on site unless authorized first by the COTR. 2.4. DISPOSAL OF HAZARDOUS WASTES: The Contractor shall not dispose of any excess pesticide containers or any other materials contaminated by pesticides at any location on the Medical Center premises. 2.5. PERSONNEL QUALIFICATIONS AND REQUIREMENTS: Certification shall mean a current Certificate of Competency in pest management in any and all categories as identified by the State of Massachusetts. 2.5.1 The Contractor shall provide a detailed list (at time of submission of quote) of all certified professional staff to be utilized in the performance of this contract, including copies of state certifications and categories of training. 2.5.2 Non-certified employees may assist the supervisor in performance of the work as long as they are in immediate contact with and visible to the supervisor. The supervisor willassume all responsibility for their work. 2.5.3 The Contractor shall comply with applicable federal, state and local regulations and guidelines and licensing of pest control operators, performance of pest control and use of approved pest control chemicals and equipment set forth by the EPA and National Pest Control Association. It is the contractor s responsibility to keep abreast and comply with changes in these regulations and codes applicable to the contract so that compliance with all current regulations and codes is maintained. 2.5.4 All of the contractor s personnel assigned to performance of this contract shall be clearly distinguishable from VA employees and must have visible on their uniforms, the name of the company and employee s name so they are easily recognizable at all times. 2.5.5 Pest Controller must comply with the Children s Protection Act, G.L. c. 132B, 6C to 6J(Chapter 85 of the Acts of 2000), effective November 1, 2000, requiring schools, day care centers, and school age programs to implement pest management strategies that minimize the risks to children from exposure to pesticides in school settings. 2.5.5.1 Contractor will also work with day care centers within the Boston Healthcare System to insure compliance. References as follows: Jamaica Plain- Bldg # 9, Small World Day Care Center West Roxbury- Trailer Bldg #89 Day Care Center Brockton- Bldg # 4, Tyke Site 2.6 SCHEDULE/HOURS OF OPERATION: 2.6.1 Pest management tasks shall be pre-scheduled and performed on scheduled days. The Contractor shall not work outside regular agreed upon working hours without prior approval of the COR. 2.6.2 In the event climate or weather conditions become unsuitable for work or may induce an environmental hazard, then the entire work shall be re-scheduled to a date and time satisfactory to the Contractor and the COR. Postponement will not reflect any penalties assessed to the Contractor, nor would there be any additional cost to the Government. 2.6.3 Normal business hours are 8:00 a.m. to 4:30 p.m., Monday through Friday, excluding federal holidays. A list of Federal holidays may be found at www.opm.gov. New Year s Day Labor Day Martin Luther King Jr. s Birthday Columbus Day President s Day Veteran s Day Memorial Day Thanksgiving Day Independence Day Christmas Day 2.6.4 Some contract tasks may require work to be performed after normal business hours. 2.6.5 The Contractor shall allow VA personnel to interrupt the pest control application process at anytime due to events that interfere with normal functioning of the facility and require immediate attention including utility services, fire protection systems, and transporting patients, personnel, equipment and carts. 2.7. SERVICE CALLS: These services shall be performed by certified, trained and licensed pest control operators in any or all categories as required by the State of Massachusetts. 2.7.1 Routine: The Contractor shall, within 12 hours after receipt of notification by the Contracting Officer or COR, and at no additional charge to the Government, re-treat areas where contract specifications of performance have not been met. 2.7.2 Emergency: The Contractor shall respond within 2 hours after receipt of notification by the COR, to provide emergency integrated pest management services. If the emergency call is to correct a contractor deficiency, the service call shall be at no additional charge to the Government. 2.8. REPORTS: 2.8.1 All logs and reports shall be catalogued by the Contractor. The Contractor shall sign in at the beginning of their scheduled work shift and out at the end of their work shift. This will be done at the COR s office at each facility which will be designated once the contract has been awarded 2.8.2 The Contractor shall complete and submit to the COR the medical facility provided Integrated Pest Management Maintenance Record. All Integrated Pest Management Maintenance Services performed during the work shift will be documented after each treatment visit prior to the Contractor leaving the facility and reviewed by the COR. 2.8.3 The Contractor shall be responsible for supplying, completing and submitting all reports required or requested by Federal, State or local ordinances which pertain to any duties contained in the contract. 2.8.4 The Contractor shall be required to furnish the VA, prior to initial application of pesticides, a list of the trade names and the chemicals used; labels showing the contents, the use strength of the chemical as applied, the antidote, and Material Safety Data Sheets. This information is required for emergency treatment in the event of ingestion of and/or contact with the materials. The Contractor shall furnish the same information each time he changes chemicals or products used in the performance of this contract. 2.8.5 The Contractor shall furnish an annual report to the COR containing the amount of pesticides used during the fiscal year to include the amounts of insecticides, herbicides, and rodenticides as well as the total amount of funds spent on the contract during the fiscal year. This report is due within 1 month of the end of the fiscal year (September 30). 3. APPLICABLE PUBLICATIONS (CURRENT EDITIONS) 3.1. The Contractor must abide by all applicable regulations, publications, manuals, and local policies and procedures. All work shall be performed in accordance with the guidelines established by Federal, State (www.epa.gov) and local ordinances. 6. PERFORMANCE REQUIREMENT SUMMARY: The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success. Performance Objective Standard Performance Threshold Method of Surveillance PRS # 1. The contractor shall provide pest control services with certified, trained and licensed pest control operators.
