Description
The U.S. Army Medical Research Acquisition Activity (USAMRAA) intends to award a sole-source contract in the amount of $20,257.46 to Philips Healthcare, a Division of Penac, for the purchase of four medical equipment parts listed below in the support of U.S. Army Medical Materiel Agency (USAMMA) from the Original Equipment Manufacturer (OEM), Philips Healthcare, a Division of Penac, 22100 Bothell Everett HWY, Bothell, WA 98021, as prescribed in FAR 13.106-1(b)(1)(i). The government will purchase the following items, which are needed to repair Computerized Tomography Equipment manufactured by Philips Healthcare, a Division of Penac: 1. Part No. 453580498986, APS SMART-UPS 1500 1S- replacement battery, 1 Each 2. Part No. 451213316702, CASSETTE TRAY SENS 1S, 2 Each 3. Part No. 451213348831, ASSEMBLY BUF CTRL 1S, 2 Each 4. Part No. 451213122081, ROLLER ASSY BUCKY 1S, 4 Each The North American Industry Classification System (NAICS) for this requirement is 339112 and the size standard is 1,000 employees. These products are needed at the USAMMA depot at Tracy, CA which repairs and replaces Medical equipment used by deployed forces in theater when the repair issue exceeds the deployed unit's maintenance capability. Medical equipment repair parts are available only from the manufacturer of the equipment or from a firm that has been licensed by the manufacturer to produce authorized parts. This conclusion is based on Army as well as Food and Drug Administration (FDA) regulations and market research. Army Regulation (AR) 40-61, Medical Logistics Policies, prohibits modifications or alterations of Army medical equipment without the manufacturer's consent. Section 6-17 provides that even "minor alterations without the manufacturer's consent may negate any further manufacturer product liability." AR 40-61 lists four instances under which Army medical maintenance personnel may modify medical equipment: modification work order, quality assurance alteration, minor alteration, and component modernization. All four instances require manufacturer involvement or consent. Information was received from a Senior Manager, Government Service Programs for Philips Healthcare that only the OEM is authorized to sell the parts listed above for Computerized Tomography (CT) equipment. The OEM stated that if these parts were purchased from an unauthorized third party and installed in a Philips CT system, this system would then become ineligible for future service contracts with Philips Healthcare. Additionally, based on the justification stated above, this would also violate AR 40-61 as the OEM has directly informed the Government that there are no authorized resellers for these four (4) parts required at this time. This announcement fulfills the synopsis requirements under FAR 5.203(a). The government does not intend to post a solicitation for this requirement nor is this a request for a solicitation or competitive proposals. However, if a company believes it could meet or exceed all the needs of U.S. Army Medical Materiel Agency for this requirement, it may submit documentation as such (i.e. a proposal, quote or capabilities statement) and any reasonable offer shall be considered by this agency. All responses to this notice must clearly indicate to the Government that pursuing competition in future procurements would be advantageous. If qualified sources are not presented to the Government by a response to this notice by the date listed below (which reflects fifteen (15) days after the publication of this notice), then a contract shall be awarded directly to Philips Healthcare, a Division of Penac; in accordance with a Sole Source Justification (SSJ) in accordance with FAR subparts 13.106 using Simplified Acquisition Procedures (SAP); pursuant to 41 U.S.C. 1901; simplified acquisition procedures, as implemented by FAR 13.106-1(b)(1)(i), Soliciting from a single source. No telephone inquiries will be accepted. This notice of intent to sole source does not obligate the Government to award a contract or otherwise pay for the information provided in the response. The Government reserves the right not to compete this requirement. Any qualified offerors must submit their capabilities statement in writing no later than Thursday 20 April 2017 by 9:00AM Eastern Standard Time to USAMRAA, Attn: Lisa Walters, Lisa.D.Walters13.civ@mail.mil. Any responses received after this date and time will not be considered. Any response documentation received shall become the property of the Government.
