COMBINED SYNOPSIS/SOLICITATION W91ZLK-17-T-0052 COMPLIANCE TESTING, REPAIR AND MAINTENANCE PETROLEUM, OIL, AND LUBRICANT UNDERGROUND STORAGE TANKS, ABOVE GROUND STORAGE TANKS AND OIL-WATER SEPARATORS This combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 05-95. The solicitation number for this request for proposal (RFP) is W91ZLK-17-T-0052. This requirement is under the associated North American Industry Classification System (NAICS) Code 238990, All Other Specialty Trade Contractors and the Small Business Size Standard $15M. The Government contemplates award of a Firm-Fixed Price in accordance with FAR 13.5, Test Program for Certain Commercial Items. This procurement will be evaluated as lowest price technically acceptable, for the procurement of the following services/materials. The objective of this contract is to provide annual regulatory compliance testing, maintenance, and repair of petroleum, oil, and lubricant (POL) underground storage tanks (USTs), aboveground storage tanks (ASTs), oil-water separators (OWSs), and related system components such as, but not limited to, piping, gauges, protective devices, etc. 52.212-1 Instruction to Offerors Commercial Items This clause applies in its entirety and there are currently no addenda to the provision. PERFORMANCE WORK STATEMENT POL UST, AST, OWS COMPLIANCE TESTING, MAINTENANCE AND REPAIR FOR ABERDEEN TEST CENTER C.1 GENERAL. The objective of this contract is to provide annual regulatory compliance testing, maintenance, and repair of petroleum, oil, and lubricant (POL) underground storage tanks (USTs), aboveground storage tanks (ASTs), oil-water separators (OWSs), and related system components such as, but not limited to, piping, gauges, protective devices, etc., on Aberdeen Test Center (ATC). The list of UST, AST, and OWS systems is below in this PWS. C.1.1 SCOPE. This is a non-personal services contract to provide compliance testing, maintenance and repair of ATC's UST, AST, and OWS systems. Repair may include maintenance, replacement, or removal of existing systems or components of existing systems; cleaning tanks or other system components; or transferring fuel products to facilitate maintenance or repair actions. The Government shall not exercise any supervision or control over the contract service provider performing services herein. C.1.2 BACKGROUND. Aberdeen Test Center (ATC) is a multi-purpose test center with diverse test capabilities and facilities. The unique combination of ATC's experienced personnel, state-of-the-art facilities, instrumentation, equipment, automotive courses, firing ranges, and industrial fabrication/repair capabilities provide a comprehensive facility available for testing a wide variety of military items, both domestic and foreign, as well as commercial items. Testing is conducted on full systems, as well as system components and includes such items as: combat and general purpose vehicles, automotive technologies, weapons and munitions, general support equipment, individual equipment, generators, night vision devices, bridges, sensors, communication systems and robotics. ATC also conducts vulnerability/survivability tests, flammability testing, and crash worthiness testing. ATC conducts and/or supports tests at other locations throughout the world with extensive mobile instrumentation and experienced technical staff. ATC operates a number of facilities that require POL products. Storage of POL products is regulated by Code of Maryland Regulations (COMAR) 26.10. Providing POL products at ATC test facilities is a critical support mission. C.1.3 PERIOD OF PERFORMANCE (POP). The POP shall be a base period of 12 months from date of award plus two 12-month option periods. Any changes shall only be approved by the contracting officer. C.1.4 PLACE OF PERFORMANCE. Work shall be performed at the U.S. Army ATC, Aberdeen Proving Ground, MD. C.1.5 WORK SCHEDULE. C.1.5.1 ATC is currently operating under an alternative work schedule. When contract performance takes place at ATC, the contractor shall perform within the hours of the government alternative work schedule. The work schedule is 8 workdays of 9 hours each, 1 workday of 8 hours, and every other Friday known as the Regular-Day-Off (RDO) as shown below. All workdays commence at 0700. Work shall not be scheduled during the following Federal Holidays: New Year's Day, M.L. King Birthday, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. C.1.5.3 When contract performance takes place at ATC, all work shall be coordinated in advance with the Government TPOC. C.1.6 PERSONNEL. The contractor shall accomplish the assigned work by employing qualified personnel with appropriate combinations of training, certifications and experience. The contractor shall match personnel skills to the work requirements. Service Technician: Minimum 3 years working on petroleum, oil, and/or lubricant (POL) systems Service Helper: Minimum 1 year working on POL systems Mechanic: Minimum 3 years working on engines or pumps in POL systems Foreman: Minimum 5 years leading crews on POL systems Certifications are required as follow: MDE Technician (for the technician position at a minimum) MDE Remover - certifications not required MDE Inspector (for the inspector only) Level 2/3 or Level 4 Veeder Root alarm system technician (for the technician position at a minimum) C.1.7 SAFETY. The contractor shall provide all safety equipment required for contractor personnel operating in an industrial area in accordance with OSHA standards and ATC regulations and procedures. Contractor personnel shall have personal protective equipment in their possession at all times while performing modification services and shall utilize this equipment in accordance with OSHA standards, ATC regulations, and as conditions warrant. This shall include, but is not limited to safety shoes, hard hats, eye protection, hearing protection, work gloves and personal fall arrest systems. The Contractor shall abide by all ATC Safety Policies at no additional cost to the government. C.1.7.1 PERSONAL PROTECTIVE EQUIPMENT (PPE). All contractor personnel shall wear the appropriate PPE when in the following work areas: range areas where entrance is controlled by the Range Operations Team, industrial buildings, at construction sites, test sites and test facilities. Other areas may be reviewed to determine if hazards are present which necessitate the use of PPE. Failure to wear/use PPE may cause removal from the job site and/or seizure of non-compliant equipment/items. C.1.8 SECURITY. C.1.8.1 Usage of Privately Owned Personal Electronic Devices (PEDs) Within the Restricted Area (RA). Contractors are not authorized to bring any personally owned electronic devices into the Restricted Area (RA) without approval by ATC Security. A privately owned personal electronic device (PED) is defined as a civilian multifunction cell phone, Smartphone, personal digital assistant, tablet, blackberry, personal wireless fitness devices (PWFD), digital inventory devices and electronic recording/storage devices. Photography and recording devices of any kind is prohibited and will be strictly enforced. C.1.8.2 Reports of Adverse Information. The ATC Security Manager may deny a contractor access into APG restricted areas based upon adverse information that is discovered on that individual. C.1.8.3 Installation Access. All contractor personnel will comply with the requirements of APG Regulation 190-4, Movement Control Within the Installation, for entry, exit and internal control of personnel, material and vehicles on APG. To gain access to APG, the contractor will provide a valid driver's license and a valid vehicle registration. All vehicles and personnel are subject to search and seizure of contraband and/or unauthorized Government property in accordance with Army Regulation 190-13, The Army Physical Security Program. C.1.8.4 Access into the Restricted Area (RA). All access into the Restricted Area (RA) under this contract will be by escort only. Contractor personnel requiring access shall report to ATC Visitor Control, building 324, for visitor registration and badging. Visitor Control personnel will contact the government Point of Contact (POC) to escort the contractor in the RA. C.1.8.5 Foreign Nationals/Immigrant Aliens. Foreign nationals/immigrant aliens cannot be granted access to the Restricted Area and shall not be scheduled to perform work under this contract. C.2 APPLICABLE DOCUMENTS AND AVAILABILITY. C.2.1 APPLICABLE DOCUMENTS. Code of Maryland Regulations (COMAR) 26.10 C.2.2 AVAILABILITY OF DOCUMENTS. COMAR 26.10 is readily available online. The government will be responsible for providing the contractor all ATC and/or Department of the Army SOPs or regulations. C.3 REQUIREMENTS. Contractor shall provide regulatory compliance testing, maintenance and repair for all UST, AST, and OWS systems throughout ATC. As of 01 MAR 2017, ATC owned or operated the following systems: USTs: Perryman Test Area (PTA): Three 10,000 gal USTs (located in Aberdeen Area APG) Munson Test Area (MTA): Four 10,000 gal USTs (located in Aberdeen Area APG) Churchville Test Area (CTA): Two 10,000 gal USTs (located on APG property in Churchville, MD) Phillips Army Airfield (PAAF): One 25,000 gal UST (located in Aberdeen Area APG) ASTs Requiring Compliance Testing Generator Test Site (GTS): Three 10,000 gal ASTs (located in Aberdeen Area APG) Boat Dock (BD): One 10,000 gal AST (located in Aberdeen Area APG) Henry Field (HF): One 1,500 gal and Two 2,000 gal ASTs (located in Edgewood Area APG) Approximately 80 ASTs ranging in size from 125 gal to 5,000 gal located throughout ATC which do not require compliance testing, but may require maintenance and/or repair during the contract period. These ASTs are located in the Aberdeen and Edgewood Areas of APG, as well as the Churchville Test Area in Churchville, MD. Oil Water Separators: 12 (located in the Aberdeen and Edgewood Areas of APG and Churchville Test Area, Churchville, MD) C.3.1 REGULATORY COMPLIANCE TESTING All regulatory compliance testing for UST and AST systems must be performed in accordance with the most current requirements of COMAR 26.10. Systems that require compliance testing are as follows: USTs: Perryman Test Area (PTA): Three 10,000 gal USTs (located in Aberdeen Area APG) Munson Test Area (MTA): Four 10,000 gal USTs (located in Aberdeen Area APG) Churchville Test Area (CTA): Two 10,000 gal USTs (located on APG property in Churchville, MD) ASTs: Generator Test Site (GTS): Three 10,000 gal ASTs (located in Aberdeen Area APG) Boat Dock (BD): One 10,000 gal AST (located in Aberdeen Area APG) Henry Field (HF): One 1,500 gal and Two 2,000 gal ASTs (located in Edgewood Area APG) At a minimum, the following regulatory compliance tests must be conducted. This list may be revised if state or federal regulations change during the course of the contract. The following table provides the list of tests, the number of systems requiring the test (with location in parentheses), and the year(s) during this contract that the test is currently due (with month in parentheses). Note the month is provided for planning only. The exact month may change at the discretion of the regulator. A Maryland Department of Environment (MDE) technician, inspector, and remover certifications are required and shall be provided. Level 2/3 or Level 4 certified technician for Veeder Root alarm systems is required and shall be provided. All systems listed in Section C.3 above may require maintenance and/or repair during the course of this contract. For bid comparison, labor rates for typical labor categories should be provided. ATC anticipates 90% of the requested repair requirements to be on a standard response time of 3 days maximum, unless prior arrangements are coordinated through the COR. ATC anticipates 10% of the requested repair requirements to be on an expedited response time of same day service. The contractor should provide a premium percentage that will apply to expedited repair. At the time of the repair request, the COR will identify standard versus expedited response requirements. Any tank or piping removal actions will be handled as maintenance and repair, however, the response time will be extended due to the logistics of removing a tank. C.4 DELIVERABLES AND DELIVERY SCHEDULE: Results of compliance testing must be provided verbally at time of test and in written format within 30 days of test completion. Results of repair actions must be provided verbally at time of repair and in written format within one week of repair. C.5 GOVERNMENT FURNISHED FACILITIES, EQUIPMENT, AUTOMATION SYSTEMS, MATERIALS AND SERVICES Government will provide access to all UST, AST, or OWS systems when required for compliance testing, maintenance, or repair. C.6 CONTRACTOR-FURNISHED FACILITIES, EQUIPMENT, AUTOMATION SYSTEMS, MATERIAL AND SERVICES The contractor shall provide all facilities, equipment, automation systems, materials and services required for satisfaction of the contract terms. C.7 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP) Attached as a separate document. C.8 CONTRACTING OFFICER'S REPRESENTATIVE (COR) AND TECHNICAL POINT OF CONTACT (TPOC): TBD C.9 NON-PERSONAL SERVICE STATEMENT. Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the statement of work. Contractor employees will perform their duties independent of, and without the supervision of, any Government official. The tasks, duties, and responsibilities set forth in the task order may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). C.10 CONTRACTOR MANPOWER REPORTING (CMR). The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) has established a secure data collection site, Contractor Manpower Reporting Application (CMRA), for the purpose of capturing contractor (and subcontractor) manpower utilized during the performance of this contract. The contractor shall report ALL contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via CMRA. The contractor is required to completely fill in all required data fields using the following web address: https://cmra.army.mil Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year.
