- Notice of Intent (Amendment) Phenomenex BPA Equipment Listing The Centers for Disease Control and Prevention (CDC), National Centers for Environmental Health, Division of Laboratory Sciences intends to award a sole source Firm-Fixed Price, Blanket Purchase Agreement (BPA) for laboratory supplies to Phenomenex, Inc. 411 Madrid Avenue Torrance, CA 90501. This BPA will be for 60 months (5 years). The statutory authority for this sole source acquisition is FAR 6.302-1 (C) and HHSAR 306.302-1- Only One Responsible Source; and 41 U.S.C. 253(c)(1). The NAICS code is 334516 Analytical Laboratory Instrument Manufacturing with a size standard of 1,000 employees. Please see the attached equipment listing of supplies that will be covered under the BPA. The BPA will provide the basic needs of lab supply from Phenomenex, Inc. for 27 laboratories within the Division of Laboratory Sciences. The parts list of preferred lab supplies from Phenomenex, Inc. are compiled by 7 branches, and this compiled list should cover the basic lab supply needs of the division. These parts include analytical columns and guard columns. These analytical tools are solely manufactured and distributed by Phenomenex, Inc. and are crucial for lab analyses that are already using them. The laboratory methods in DLS are validated to meet the Clinical Laboratory Improvement Amendments (CLIA) requirements and any changes in method would require re-validation of the method. DLS laboratories and methods are CLIA regulated and approved. As such a substitution for Phenomenex products in these methods is not an option as it would invalidate the method. Any changes to the method would require extensive method revalidation and certification at significant monetary, time, and quality costs. Phenomenex, Inc. is the sole manufacturer and distributor of these lab supplies and consumables. Thus, these supplies must be acquired from Phenomenex directly. No solicitation will be posted to FedBizOpps. We will only issue a solicitation to Phenomenex, Inc. Phenomenex, Inc is the only source available to provide this equipment that meets mission critical requirements. This notice of intent is not a request for proposal. A determination to compete this procurement based on response to this notice is solely within the discretion of the Contracting Officer. Interested parties who believe they possess the capability to satisfy this requirement should submit a capability statement demonstrating their ability to meet this requirement.
