Attachment 6- DHS NDA Form Attachment 5 Draft DOMAIN BPA SOW 04_12_2017 A. Overview The Transportation Security Administration (TSA) is providing a Draft Statement of Work (SOW) for the Security Technology Integrated Program (STIP) Domain Awareness Integrated Network (DOMAIN) support services. This Draft SOW is being provided for information purposes only, and does not obligate or commit the Government in any way. The Government will not pay for any costs associated with this posting. Through this special notice, TSA is allowing industry the opportunity to submit a request for Sensitive Security Information (SSI) vetting in order to access the SSI documents listed in the Draft SOW. This opportunity to request SSI vetting is in advance of any solicitation the Government may or may not issue. Although SSI is not classified information, there are specific procedures for recognizing, marking, protecting, safely sharing, and destroying SSI. Instructions to request access to the SSI documents are listed in the following section. TSA may or may not issue a solicitation for STIP DOMAIN support services. In the event that TSA chooses to release a solicitation for STIP DOMAIN support services, the SSI requests that are submitted by vendors in response to this post will carry over to the solicitation phase. TSA will not provide the SSI documents to the vendor unless a solicitation is released. TSA is allowing vendors to submit questions or comments regarding the Draft SOW. However, TSA will not respond to questions or comments submitted in response to this notice. TSA will not return any information provided in response to this notice. B. Document Request Instructions: The following instructions must be followed in order to request access to the SSI documents listed in the Draft SOW. All information shall be provided via a single email to request the documents. 1. Each interested company must designate a single Senior Corporate Official who will serve as the single point of contact for SSI information. This individual must certify (in writing through an email) that all appropriate protections will be followed, only authorized individuals will have access to the SSI information, and that those individuals adequately understand their responsibilities to protect the information. This official must also ensure that the TSA Contracting Officer is notified of staffing changes or circumstances in which individuals no longer need access to the information. 2. The Senior Corporate Officials shall provide the following information to the Government points of contact listed in Section C of this notice. (Note that this requirement applies likewise to any prospective subcontractor, joint venture partner, or "team" company whose access to the specified SSI is necessary). a. The CAGE code of the vendor's facility that will store the SSI b. The company DUNS number and address c. A description of the company, specifically the products and services that it offers d. A summary of the past experience or contracts that the company has performed related to the requirements e. The products or services that the company intends to provide to DHS related to the requirements f. Single password protected Microsoft Excel spreadsheet that includes the following information for each of the anticipated individuals: i. Employee Full Name ii. Employee Gender: (e.g., Male or Female) iii. Employee Birth Date: iv. Employee Citizenship: v. Social Security Number or equivalent if Foreign National: vi. Indication of whether any nominated employees have: • Previously received a DHS/TSA suitability determination; • Undergone a federal background investigation; or • Possess an individual security clearance. vii. A completed and signed Non-Disclosure agreement (DHS Form 11000-6) for each individual anticipated to access this information. The Offeror should understand that employees granted access to SSI and signing a non- disclosure agreement are bound by the terms of that agreement indefinitely, notwithstanding their employment status or any other background checks or clearances granted by any Government agency. g. The number of persons that can access the specified SSI documents is limited to a total of five (5) individuals per vendor, unless otherwise agreed to in writing by the Contracting Officer. Vendors should indicate the type of documents to which each of the anticipated individuals would need access. 3. Written requests, including the names of the anticipated individuals and other information above, shall be submitted no later than April 28, 2017 at 5:00 PM Eastern Time to the Government points of contact listed in Section C of this notice. 4. Access to SSI information is based on "need-to-know" as determined by the holder of the information. If it is determined that covered individuals are not eligible to receive access to the SSI document, DHS/TSA will provide the vendor a written determination that provides notification that the individual does not qualify to receive SSI. Appeal of the determination will not be permitted. 5. TSA will use the information provided by the Vendor to conduct a security threat assessment on individuals who seek access to Sensitive Security Information (SSI). The information will be shared within DHS with personnel who need the information to perform their official duties. The Security Threat Assessment may include a verification of site facility clearance in the National Industrial Security Program (NISP), contractor suitability determination or other federal background investigation, individual security clearance(s), and if required, a criminal history records check (CHRC) and/or a check against terrorism databases. Additionally, TSA may share the information with law enforcement, intelligence, or other government agencies as necessary to identify and respond to potential or actual threats to transportation security in accordance with the routine uses identified in the applicable Privacy Act system of records notice (SORN), DHS/TSA 002, Transportation Security Threat Assessment System (T-STAS). This SORN was last published in the Federal Register on November 8, 2005, and can be found at 70 FR 67731- 67735. Authority: 49 USC 114. Furnishing this information is voluntary. However, failure to furnish the requested information may delay or prevent the completion of your security threat assessment, without which you may not be granted access to the SSI. C.
