- Provisions and Clauses Timeline Statement of Work COMBINED SYNOPSIS/SOLICITATION SB1341-17-RQ-01910 Preparation and Bottling of Coal This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6 - Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested, and a separate written solicitation document will not be issued. This solicitation is being issued under the authority of FAR Part 13 Simplified Acquisition Procedures. This solicitation is a Request for Quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-95 effective 01/19/2017. The associated North American Industrial Classification System (NAICS) code for this procurement is 541990 with a small business size standard of $15.0 million. This acquisition is being procured using unrestricted, full and open competition. The National Institute of Standards and Technology's (NIST) Materials Measurement Laboratory Division requires coal material to be prepared and bottled in accordance with the attached Statement of Work. EVALUATION CRITERIA The Government intends to award a single purchase order resulting from this solicitation to the responsible Contractor whose quotation, conforming to the solicitation, will provide the best value to the Government, price and other factors considered. In addition to price, the following factors shall be used to evaluate quotations: 1.Technical Approach 2.Past Performance. 1. Technical Approach: NIST will evaluate the extent to which the Contractor's quote demonstrates their ability to satisfy the requirements in the Statement of Work, ensure work quality, and on-time completion of tasks and deliverables. The proposed technical approach will be evaluated to determine overall feasibility and likelihood for success. In addition, NIST will evaluate the Contractor's experience in preparing coal or coke samples to assess the contractor's abilities to: 1. air dry, crush, pulverize, screen, and spin-riffle bottles into containers; 2. analyze (in-house or by subcontractor) chemical constituents, including sulfur, in the contained sample; and 3. evaluate the results of the chemical analysis to determine conformance to specifications. The Contractor's proposed methodology will be evaluated to determine its ability to complete the project successfully to produce a bottled material with negligible heterogeneity. Additionally, stronger consideration will be given to Contractors who quote an alternative packaging for Task 10, Optional Item 0003 which includes sealing the non-bottled splits under argon inside sealed aluminized bags (e.g., Mylar). 2. Past Performance: Evaluation of past performance will be based on the references provided and/or the Contractor's recent and relevant procurement history with NIST or its affiliates. Past Performance will be evaluated to determine the overall quality of the product/service provided by the Contractor. The Government will evaluate past performance based on Past Performance Surveys and by contacting appropriate references, including NIST references; if applicable. If the offeror intends to subcontract with another firm(s) for technical portions of this requirement, that firm's past performance information shall also be provided. The Government reserves the right to consider information available from other sources. In the case of a Contractor without a record of relevant past performance or for whom information on past performance is not available, the Contractor will be evaluated neither favorably nor unfavorably. PRICE The quoted price will be evaluated to determine whether the prices are fair and reasonable in relation to the solicitation requirements. Prices must be entirely compatible with the technical portion of the quotation. The Government will evaluate quotations for award inclusive of the prices quoted for all optional line items. Evaluation of options does not obligate the Government to exercise the options. NIST intends to evaluate quotes and issue a contract based on the initial quotes received. Therefore, the Contractor's initial quote should contain the Contractor's best terms from a price and technical standpoint. NIST reserves the right to request revised quotes from, or negotiate final contract terms with, one or more, but not all, Contractors if later determined by the Contracting Officer to be necessary. Please note that this procurement IS NOT being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If a contractor submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the contractor's FSS or GWAC contract, and the statement required above shall be included in the quotation; CONTRACTOR INSTRUCTIONS FOR SUBMISSION OF QUOTATIONS Quotations shall include the following required submissions: 1.Technical Approach. The Contractor shall provide a detailed technical approach demonstrating their ability to satisfy the requirements in the Statement of Work, ensure work quality, ensure negligible heterogeneity, and execute on-time completion of tasks and deliverables. Details shall indicate the exact number of bottles that will be filled to accomplish line item 0001 and optional line item 0002. Additionally, the Contractor shall provide detailed information on the alternative packaging method and materials chosen for optional line item 0003. Finally, the Contractor shall also provide documentation to demonstrate that they have prepared [1. air-dried, crushed, pulverized, screened, and spin-riffled into containers; 2. analyzed (in-house or by subcontractor) chemical constituents, including sulfur, in the contained sample; and 3. evaluated the results of the chemical analysis to determine conformance to specifications] coal or coke samples within the last three (3) years for use as reference or test samples. This documentation shall demonstrate that the Offeror has performed such preparation on at least 4 discrete lots of coal or coke material within the past two (2) years. 2.Past Performance. The Contractor shall provide past performance information regarding at least four relevant contracts for the past three years with federal, state or local governments, and commercial customers. The information shall describe contracts of a similar type and scope as the current requirement. If the Contractor has no relevant past performance it must include a statement to that effect. The description of each contract described in this section shall provide the following information, as applicable: • Contract Number • Description of work performed and relevance to solicitation requirements • Period of Performance • Point of Contact Information (name, email, phone number) for the client reference 3. Price. Contractors shall provide a firm fixed price to complete the requirements of the Statement of Work, in the following format: LINE ITEM 0001, Firm-Fixed-Unit-Price (BASE LINE ITEM): The offeror shall furnish the necessary personnel, material, equipment, and services to prepare four (4) drums of bituminous coal [approximately 1100 lbs. (500 kg)], provided by NIST, for air drying, crushing, pulverization, screening, and subsequent spin-riffling into a minimum of 2,500 bottles, and a not-to-exceed 3,000 bottles for a renewal coal SRM, in accordance with the statement of work below. Price: $______________ / bottle, not to exceed 3,000 bottles OPTION LINE ITEMS: (refer to FAR Clause 52.217-7 Option to Extend the Term of the Contract, below). The Offeror shall provide a price quotation for option line items 0002 and 0003. These line items will be evaluated in accordance with FAR Clause 52.217-5. The price quoted for line items 0002 and 0003 shall be effective from the date of award through delivery and acceptance. The Government may exercise these option line items at time of award. If the government exercises option line items 0002 and 0003, the work shall be performed simultaneously with work required for line item 0001 so that at least 3500 and no more than 4500 bottles (total) will be produced. OPTION LINE ITEM 0002, Firm-Fixed-Unit-Price: The offeror shall furnish the necessary personnel, material, equipment, and services to prepare four (4) drums of bituminous coal [approximately 1050 lbs. (475 kg)], provided by NIST, for air drying, crushing, pulverization, screening, and subsequent spin-riffling into a minimum of 1,000 bottles, and a not-to-exceed 1,500 bottles for a renewal coal SRM, in accordance with the statement of work below. NIST reserves the right to partially exercise this optional line item for less than the maximum amount, based on funding limitations. Price: $______________ / bottle, not to exceed 1,500 bottles OPTION LINE ITEM 0003, Firm-Fixed-Price: The Offeror shall package the splits of material that will not be bottled using an alternative to the packaging specified in TASK 10 of the SOW, as long as the coal material is packaged in a primary liner of Mylar or plastic that is ≥ 4 mm thickness and the secondary liner is ≥ 4 mm thickness. Price: $_____________ (total) For line items 0001 and 0002 (if exercised), the total combined quantity shall not exceed 3,000 and 1,500 bottles, respectively. Any amount over those quantity limitations, the contractor exceeds at its own risk. 6.Terms and Conditions If the Contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state "The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:" [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the Contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor's acceptance of the Government's terms and conditions for inclusion into the resultant purchase order. 7.Required Provisions A completed version of all required solicitation provisions (see attached provisions/clauses document - required submissions highlighted in blue). 8.Contractor Identifying Information The DUNS number for the Contractor's active System for Award Management (SAM) registration. DUE DATE FOR QUOTATIONS All quotations must be submitted via e-mail to Heather Bauer, Contract Specialist at Heather.Bauer@Nist.gov. Submission must be received not later than 11:00 a.m. Eastern Time on Monday 24 April 2017. A quotation shall be considered received when it is received in the electronic inbox of Heather Bauer not later than the date and time identified herein. All questions regarding this notice must be submitted via e-mail to Heather.Bauer@Nist.gov by 11:00 a.m. Eastern Time on Wednesday, 18 April 2017. Questions submitted after this date may not be addressed by the Government prior to the quotation submission deadline.
