Description
The U.S Environmental Protection Agency (EPA) intends to negotiate on a sole source basis with the National Institute of Standards and Technology (NIST) under the authority of FAR Part 13.106-1(b), as implemented by the Federal Acquisition Regulation(FAR) Part 13 for the procurement of a NIST SRI 6008 Ozone Standard Reference Photometer (SRP) for the use in the ozone abatement program. This procurement is recommended to be processed without full and open competition. The EPA intends to procure the required system under a Firm Fixed Price Purchase Order using Simplified Acquisition Procedures for Commercial Items (FAR Parts 12 and 13). The NIST SRP serves as the International Reference Standard and is used by the Bureau of International des Poids et Mesures (BIPM) as a reference for ozone measurements. The EPA implements the SRP for the Ambient Air Monitoring Program. Currently, the EPA has two SRPs in the Research Triangle Park (RTP), NC and has nine SRPs in the EPA Regional offices. Regions then provide verification services to the monitoring organizations who bring their transfer standards to the EPA Regions for verification each year. Through market research, it appears that no other firm in the world makes the SRP other than NIST. No other sources meet the International Reference Standard accuracy conditions that are needed for this requirement. The North American Industry Classification System (NAICS) code for this acquisition is 334516, with a size standard of 1,000 employees. A determination by the EPA not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the EPA. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No solicitation package will be issued. This notice of intent is not a request for competitive quotations. All interested parties who believe they can provide the required product should fully explain their capabilities and qualifications in writing within 15 days from the date of this announcement and provide a detailed explanation of how the contractor can provide this equipment as well as itemized pricing that is sufficient to make a determination that competition is feasible. The intent of this notice is to determine if any other source(s) exist, and therefore, no solicitation is available. Consequently, anyone failing to provide the aforementioned and instead chooses to merely submit a routine letter requesting a copy of the statement of work or more information about the project will be ignored.
